You need to go online now and acknowledgement the claim and that you will defend in full.

 

You are a day late, but should be able to do it.

If you leave it, you will end up with a default CCJ.

 

Once you acknowledge, then we can help you with the next stages i.e to defend it.

Date of Issue: 6th Sept

 

Claimant Lowell/Tmobile

 

What is the value of the claim? £566 including court fee and legal costs

 

Is the claim for - a Bank Account (Overdraft) or credit card or loan or catalogue or mobile phone account? Phone account

 

When did you enter into the original agreement before or after 2007? After

 

Has the claim been issued by the original creditor or was the account assigned and it is the Debt purchaser who has issued the claim. Debt purchaser

 

Were you aware the account had been assigned – did you receive a Notice of Assignment? yes

 

Did you receive a Default Notice from the original creditor? can't remember

 

Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year ? can't remember

 

Why did you cease payments? financial difficulties

 

What was the date of your last payment? can't remember

 

Was there a dispute with the original creditor that remains unresolved? no

 

Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management plan no

Could the last payment to TMoblie have been more than 6 years before this court claim was issued ?

 

If it might have been, i think you should contact TMobile to find out when you last made a payment on the contract you had.

If it was over 6 years ago, you can then file a statute barred defence.

Hi last payment was 19th july 2012 strange that its not showing is it not ?

 

So, if your last contractural payment was due August 2012, which you did not pay, then the debt should be statute barred.

 

dx, do you think an SB defence should be entered at this stage or would you send the CPR asking for disclosure first ?

Its not statute barred.....would have been Aug/Sept 2018 without a claim being issued
