Warranty issue for an item bought from a business store on eBay

Hi everyone,

 

I am hoping for some advice here.

 

Last November (15th),

I bought a Samsung S7 Edge dual SIM (non -EU model, it seems to be a Middle east model) mobile phone from progadgetsuk

- registered business store on eBay.

 

This was listed with 1 year warranty and new device and came in promptly , after I made the payment using PayPal.

 

When the package came,

everything seemed genuine and the phone worked perfectly

 

3 days ago it suddenly heated up and would NOT come on again ..

neither charges up, nor does the display screen turn on.

 

I remember clearly raising a query on item listing page where the seller had confirmed that any repairs would be handled by him directly with SAMSUNG under the warranty period.

 

I have contacted the seller for the last 3 days continuously with no response.

 

eBAy have no facility to report this item as it has passed their deadline of 30 days

for some reason their customer service stated that I should contact the seller directly.

 

Surprisingly eBAy DOES not provide me an option to report the seller or make any comment on the item listing ( from my history) which can affect the seller's credibility rating in any way.

 

Since I paid for this using my paypal account,

I opened a dispute resolution case with paypal,

but their reply was that they CANNOT do anything about cases which fall beyond the 180 day mark.

 

I have tried contacting SAMSUNG directly as well ,

they say the following:

 

SAMSUNG UK - This is a non- EU model and hence they WILL NOT repair it.

 

SAMSUNG (GULF/ Middle east) - They are saying that the 1 year warranty has expired ... though I bought the phone from the seller only on 15th November.

 

I have now run out of ideas as to what should be my next step and would be grateful for any advise that consumers like me might have faced.

sorry,dx100uk , not quite sure what you mean by pay your paypal balance... I have my credit and debit cards linked to paypal... I had used my credit card via paypal to pay the amount.

 

couldnot find the link to start a claim in the CRA link you share .. how and where can I do that ?

so you paid the balance owed regarding this item by credit card or a debit card?

 

consumer rights act is against the retailer [much like SOGA]

 

you write to them.

 

you could do a section 75 reclaim if you paid by credit card

but most credit card companies reject section 75 where paypal are involved

but they cant stop chargeback if you settled the sum by a debit card.

yep go do a chargeback

nothing to do with CA

 

 

ring your bank tomorrow

simply return the phone to them [the retailer]

you PP account will be trashed

but they never do anything about it

simply use differing details to start a new one.

the sellers ebay page is obliged to carry the traders business address on it

contact the retailer directly using that information.

 

Saying ebay wont help is like me going into town on a bus and buying something and them blaming the bus company when the item doesnt work.

 

You then let the retailer know that you are after a repair as per the sale agreement and also under consumer law and you will be enforcing your consumer rights. Do this before doinga chargeback but dont give them an age to respond, a couple of days is enough.

Already tried reaching the address mentioned, but there is NO business of the type in there... The address is a building which houses Regus, who affirmed the non-existence of this ProGadgets Uk.

Now I am stuck without a contact number or definite physical address and only an email address, which is NOT responding. What seethes me about eBay is that there is no way for a buyer to feedback about a purchase on the warranty compliance ( as per stated in the invoice)....

 

@DX100Uk - Given that I used my debit card via paypal account the chargeback literature states that the transaction should be under 100 ... though for a credit card it is >100

I have known sums in excess of £1500 to be charged back
