    • 4 means that they need to name and then tell the people who will be affected that there has been an application made, what the application relates to (specificially "whether it relates to the exercise of the court’s jurisdiction in relation to P’s property and affairs, or P’s personal welfare, or to both) and what this application contains (i.e what order they want made as a result of it) 5 just means that teh court think it is important that the relevant people are notified 7 means that the court need more information to make the application, hence they have then made the order of paragraph 1 which requires the applicant to do more - this means the court can't make a decision with the current information, and need more, hence paragraph one of the order is for the applicant to do more. paragraph 3 of the order gives you the ability to have it set aside, although if it was made in january you are very late. Were you notiifed of the application or not?

    • Hi, In my last post I mentioned I had received an email from SS who were asking me to hand over the keys to my mother’s flat so they could pass them to the Law firm who have been appointed court of protection to access, secure and insure my mother’s property.  Feeling this, all quickly getting out of my hands I emailed ss requesting proof of this. I HAVEN’T HEARD BACK FROM SS.  Yesterday, I received an email (with attached court of protection order) from the Law Firm confirming this was correct (please see below a copy of this).  After reading the court of protection order I do have some concerns about it:   (a)   I only found out yesterday, the Law firm had been appointed by the court back in January.  Up until now, I have not received any notification regarding this.  (b)   Section 2   - States I am estranged from my mother.  This is NOT CORRECT    The only reason I stepped back from my mother was to protect myself from the guy (groomer) who had befriended her & was very aggressive towards me & because of my mother’s dementia she had become aggressive also.  I constantly tried to warned SS about this guy's manipulative behaviour towards my mother and his increasing aggressiveness towards me (as mentioned in previous posts).  Each time I was ignored.  Instead, SS encouraged his involvement with my mother – including him in her care plans and mental health assessments.   I was literally pushed out because I feared him and my mother’s increasing aggression towards me. Up until I stepped back, I had always looked after my mother and since her admission to the care home, I visit regularly.   .(c)    Sections -  4, 5 and 7  I am struggling to understand these as I don’t have a legal background.  I was wondering if there is anyone who might be able to explain what they mean.  It’s been a horrendous situation where I had to walk away from my mother at her most vulnerable because of; ss (not helping), scammer and groomer. I have no legal background, nor experience in highly manipulative people or an understanding of how the SS system operates, finding myself isolated, scared and powerless to the point I haven’t collected my personal belongings and items for my mother’s room in the care home.  Sadly, the court has only had heard one version of this story SS’s, and based their decision on that.     • Unless I've got an incorrect copy of the relevant regulation: The PCN is only deemed to have arrived two days after dispatch "unless the contrary is proved" in which case date of delivery does matter (not just date of posting) and I would like clarification of the required standard of proof. It seems perhaps this hasn't been tested. Since post is now barcoded for the Post Office's own tracking purposes perhaps there is some way I can get that evidence from the Post Office...

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

If this is a “work at home opportunity”, then do your research very carefully and find the biggest bargepole you can. A quick search turned more than enough horror stories, and a simple check on the (UK) domain was even more troubling.

As far as I am aware they are a reputable opportunity with access to work with npower etc. via creating your own mini call centre from home...

 

Whilst "go Daddy" doesn't sound very professional, nor does a lot of it these days and I don't have any experience of it. But will trust your input on that!

As for the horror stories, I'll not post any links so as not to provide any advertising for the outfit. In a nutshell, any company that requires you to spend money with them on equipment or training before giving you any work is probably running some sort of pyramid scheme.

 

A question for you: Have you been plagued by cold calls for PPI reclaims, home insulation, window scrappage schemes, or "free" boilers ?

 

If so, where do you think these "call centres" are located ?

To be fair Mr.P. I am not getting that impression at all from this company.

 

First hand I can say that I know a few who work for Sensee and that is a fantastic place to work. (I don't quite forfil all the requirements or I would). They do not do anything like "reclaims, home insulation, window scrappage schemes, free boilers" They also had to provide their own equipment and office though so I don't think that in itself is anything to worry about.

 

Here are two reviews I can see with the bulk of the reviews being from the American company:

Both pretty positive although I gather that the low wage of £7 per hour is because that person chose to not set up their limited company but worked for a limited company already set up.. Otherwise I think pay is around £8.50 per hour.

 

I haven't even considered employing someone else as that's too much to think about. I think I can just do it by myself...

I am also having problems, if it all checks out, with thinking up a name. Anything that I like is immediately ruined by "limited". So the best I could think of was UN Limited. I like the connotations of un and it makes a great logo. But that was taken already unlol :-/

I have not started another thread, maybe I should. But I am in the process of forming a company, as stated in this thread. A bit nervous since I have never done it before.

 

I am looking at Company Formation Made Simple.

An option is to pay £9 per year to use the address 20-22 Wenlock Rd London.

 

This is for privacy and data protection. I will be working from my home address and not an office.

 

Is this adviseable? I am probably going to do it anyway as I like the idea of it.

 

Is there any other insights anyone can share with me when filling out this form for Company House?

 

There will only be me in the company as "Director".

many small firms use an accommodation address as their registered company office. As long as you can actually get your post from there and they can handle possible enquiries then that is no bad thing.

Your reasons for doing this are totally wrong though and may breach companies law. The company can register there but as a director you have to give your home address anyway, not an address that you are not at. Some compay directors give an office address but that is because the company actually owns that address and has a physical presence. Again not strictly proper but with companies that are in the news and may get unwanted attention from assorted nutters it is overlooked

Privacy always sounds safer to me, even though there really isn't any way my company will be getting into any debt or problems etc. as there is no start up costs.

For those who are patient enough to help me follow this through. A brief re-cap.

 

One registers as a company in order to partner up with Arise. Arise then provide training via a paid course and then the job opportunity to several well known companies working as a mini- call centre from home.

 

The other way to do this is to go through one of their recommended partnered companies. This way you do not have the hassle of starting up a company etc.

 

Upon research the 5 companies provided - some appear to be in debt or just a little in profit

just because you have found something online doesnt make it fulfil the requirements of the Companies Act. The price makes me wary for starters Also they use the same accommodation address they want to flog you. In short they have no substance at all.

Your own reasearch makes it clear you shouldnt be touching this lot with a bargepolea nd the same applies to the list of didgy firms you are offered as a tie in.

Also ask yourself about Arise.... you have to pay them for a traing course and it is not an offer of a contract for work. Again, that should be shouting at you to run away as fast as possible. It is a pyramid scheme at best and they are illegal

 

these people make money out of desperation, my advice is find someone who has a proper office and proper contracts to offer or drop the idea altogether. the only ones making a shilling will be them and that will be from you, not Virgin, Microsoft etc.

As they are the ones dictating when you work, you should be an employee and be granted the protections & rights that go with it.

You pay for training and then get very little to no work.

Its a ponzi scheme.

The only people who make money is them.

Neighbour did it and regretted it.

The no pension, no sick pay, no holidays is all something I am living with now with the additional burden of having no income. Therefore I can see that although this is an unacceptable situation, it doesn't effect me.

 

The unpredictable hours again is something that can possibly work to my favour as I have an unpredictable disability (and have been denied benefits. I don't want to talk further about that).

 

 

On the positives, I will be able to train part time from home. (Most part time work seems to come with full time training schedules). I don't mind £30 for that. I do mind having to pay a monthly fee for the software. But it is what it is.

 

And most importantly I will be able to make money from home (£7 - £10 ph), paid fortnightly.

 

Does anyone know how to make money from home doing anything else? Because ALL my other attempts have failed or I have been conned.

 

Working from home apparently also saves 17 days a year in commuting. So that is pretty good. But it is for health reasons that I can not. So again that is in my favour.

 

The shock was looking up these 5 companies, which you join if you do not want to start your own company, as these are supposed to be the best. Unless I have researched it wrong, which I may very well have, they don't seem to be doing well at all.

 

I am being cautious in this process and have researched the companies due to this thread. There has been one direct reply from a member whos neighbour regretted it. Which is not much to go on.

 

I require the experience to re-build my CV etc.

 

Tell me, do any of you have ANY ways to make money from home on-line??? If not, then what is my decision?

Picking up a few design and manufacture jobs helped a little and it was fun for a while. However, the field I was involved in was highly specialised in comparison to most software support sectors.

 

My sister has recently embarked on a venture providing computer aided design services and appears to be picking up a fair bit of work both locally and via facebook. She has the skills, equipment, and finances to make a go of it. If that doesn't pan out, she can turn her hand to sewing.

 

What skills do you have that might be turned in to a business ?

What skills do I have? That's such a good question. I have the skills for running a business, integrity, tenacious, reliable, self motivated, good time management, organisation, lateral thinking etc. And I need to be my own boss so that I can work around my disability. I did not quite finish my degree due to my illness. Now they are too expensive.

I have an Advanced Creative Writing Diploma (two years part time at the OU) which I enjoyed. However my other work in the past, caring roles, palliative care for animals, rehabilitating animals, some office work, I am finished with and most of it was not done in a paid capacity, so is less official.

 

I seem to have lived an ad hoc life which in itself is anti-cv friendly. But this may be included in my skillset as it requires a certain calm remaining on the edge for such a long time.

 

I have managed to keep my mental health in reasonable condition too somehow. Probably by meditation and reflection, or luck.

 

It would be nice to actually find something I like to do now being middle aged. But I think I need to find some training in something, so that I create a fresh start based on now, rather than adding to the past.

 

Arise - Actually isn't a bad title at all for this discussion we have veered off into lol.

you say unpredictable hours, well I can predict how many hours you will work and that is ZERO. A lot of the negatives such as no holiday apy, sickness ect applies to all self-employed people so not a rarity but these peopel are supposed to be employing you on a zero hours contract or via agency work and that is different. It is unclear exactly what their relationship is with anyone so another reason to question whether they can provide you with any work.

How to make money online? You need a good idea of your own and be able to sell it to others. hoping some bandit that makes no money for themselves is somehow going to make you a fortune is fanciful so again, regardless how desperate you think things are spnding even a small sum of money is just a waste of that precious resource, not an investment.

If you have good computer and customer service skills then there are other sectors that take on staff such as out of hours doctors etc but all of these are few and far between as to when they are advertised. Try thinking about what you can do and offer an employer and then go sell yourself. you will receive probably hundreds of rejections but then hopefully get than one opportunity.

What business did you run previously? whay is it not possible to seek work in that sector?
