Hi,

 

I recently sold an iPhone on Ebay.

The customer had damaged his/her phone, and then messaged me on Ebay and then finally purchased the second hand device from me.

 

Everything was tested before hand and working.

However, the customer decided to use it for 3 weeks and then ask for a refund using eBay's Not As Described policy.

The customer actually messaged saying they've now purchased an iPhone 7.

The whole thing sounded like he/she purchased my phone just as a get me by until he/she got a new phone.

 

he/she eventually returned the phone and it was not in the same condition as it went out.

The headphone jack was no longer functioning.

Although, the day before it went out i was listening to music on it!

 

PayPal automatically took the funds from my account.

they actually made it a negative balance, because there were no funds in there!

 

 

Days later, PayPal tried to take the money from my bank account, which i found out later was declined.

PayPal didn't inform me of the funds being declined,

and i was so miffed about the whole eBay thing that i just closed my PayPal and Ebay account.

 

The PayPal balance was showing as 0 and the eBay case was closed.

Now i'm getting calls from PayPal, but i'm currently just blocking them.

I really do not want to pay them back.

 

 

What can they do?

Will they take me to court over this?

 

Any advice will be greatly appreciated.

I have never heard of PP taking anyone to court, IMHO I'd simply ignore them, blocking their calls is a good thing, whatever they wish to convey can be committed in writing!

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Thanks for the reply! I will do just that.. They set my account to £0 and allowed me to close my account. So i can say as far as i'm concerned everything was settled if anything does happen.

 

Also, with the eBay case closed, i doubt eBay will get involved?

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

they have

NO SUCH LEGAL POWERS.

 

 

all they can do is what you or I could do if we think someone owes us money

that's start a court claim.

 

 

that's the only thing you never ignore

 

 

but I don't think I've ever heard of one case of a DCA doing court for a spoof like you've suffered

its a std stunt that gets pulled every day by buyers.

PP and Ebay are two separate entities now anyway.

 

A court claim is the ONLY thing you don't ignore, powerless DCA's and toothless PP you can do.

 

And NO you DON'T pay anyone anything!

This happens to everyone sooner or later, Ive had it a few times, if you are unlucky PP take money from your account, you like me have avoided this, they will continue to pester you but you can ignore, I too am unaware of them ever starting court action, its questionable whether their complex T&C's would stand up or be understood in court, also they appear to be at least partially based in Luxembourg ?

 

If you are a bit clever/sneaky you may be able to open another PP account but youd have to use diff bank account and sometimes they cotton on.

 

Im fed up with being conned this way by fraud buyers, ebay couldnt care less, they just assume all sellers are crooked.

I will ignore PayPal for the time being. If they pass it over to a DCA i will ignore them also.

 

My only concern is if they try to take this to court. If that happens i'll pay up i guess.. it's for £300 so it's not an insignicant sum of money.

 

I assume PayPal already refunded the seller anyway as it went to -£300, before it then went to £0 after they tried to take the money from me? i'll just claim ignorance as far i a knew the money came out, then i just closed my account. Thier systems allowed me to afterall..

Your concerns are unfounded. they don't do court, and if they did, then they'd be ripped to shreds....pay em 300 quid, pah, that's funny!

Hi all.

 

I've now received a letter from a DCA called DLC. The price of the debt has increased to £430.

 

I'm worried this will escalate to court and effect my credit rating. Do i need to do anything? Should i just pay it?

 

Paypal only tried ringing me, they didn't send any formal letters asking for the money. Is that normal before getting a DCA involved?

 

Any advice welcomed!

Well you said before you would ignore a DCA.

Doubt they will take to court.

DLC tend to act on behalf of original creditors, so presumably they state Paypal as their client.

 

Can't see how they would note your credit record.

Do Paypals terms state they will note credit records in this situation ?

 

Looking at this issue in general.

 

You received payment for the phone.

 

The phone was rejected 3 weeks later, Paypal issued the buyer a refund.

 

You have received the phone back with damage, but you still have the money paid by the buyer.

 

So at this stage, you have the money and the phone back.

 

You registered a dispute with Ebay and have rights to see this through. If you are worried, continue to dispute the matter.

unclebulgaria67 - Hi thanks for your reply.

eBay closed the case before any disputes could be made by either party.

 

 

As previously mentioned, at the time i was going to just pay the person and closed my paypal account before realised the payment didn't go through.

 

If you were in my shoes, would you re-open a case with ebay, or just sit back and wait?

Think you need to register a complaint using Ebays process, just in case you need to evidence this.

I rage closed my ebay account after my paypal account!! think that option is out of the window.

 

I have never used Ebay to buy or sell, for the reasons your case evidences. I have heard of too many people ripped off.

 

I suspect that Ebay must have a way of registering a complaint made via an email to their customer services. You are not the only customer who has closed their account in disgust.

 

The reason for maintaining evidence of a complaint, is in the unlikely event of a court claim ever being issued. At least then you can say the matter was disputed.

ignore everyone

Paypal/ebay do NOT do court

they don't sell debts on either

 

 

and most certainly can never appear on credit files..IGNORE!!
