hi all...

my partner lived in France for years and recently moved back to the Uk.

.. since returning French authorities are demanding 6000 Euros for some supposed over-payment of low income supplement that she received while in France.

 

She emailed them explaining that as well as not understanding why this is owed, that she is on low earnings here and could only afford to repay 20 Euros per month.

 

They have said this is not acceptable and want more than 200 Euros per month.

 

The other day we have received a letter demanding the full amount from "Titre Executoire" ...

 

Are we likely to have bailifs on the doorstep next?

 

What should we do??

we haven't received anything from any debt collection agency yet as far as i can see this letter looks from official local government from where she lived...

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

was just wondering if they could... so since they have ignored her offer of small payments , you think we can ignore future correspondence?

 

You really need to get French debt advice on this matter, as the French have very different ways of dealing with debts. As this seems to be a debt owed to French Government, i would hate for you to follow UK debt advice and end up getting into trouble.

 

Within the EU there are cross border arrangements and if the matter has been decided upon in a French court, they can transfer this to a UK court to gain enforvement powers here.

 

Suggest you contact whoever is the owner of this debt e.g French Government and to request details of how the amount has been calculated, as well as details of their appeals process.

 

Nothing will happen at the moment. But don't ignore it, hoping it will go away.

That's an enforcement order..

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Yes, that does suggest it has already been to court in France and they have enforcement powers in France. However, to enforce in the UK, the claimant might have to make a further application in a court to enforce in the UK. What the process is, i am not sure. Most Google results are in French.

 

Get French legal/debt advice to avoid the matter escalating, making the situation worse.

When from?

 

Waffling again. You can easily enforce court orders from other European countries in the UK.

 

For the op, if they were to go down that route, you would receive advance notice so wouldn't worry about that just yet.

 

Others may be along shortly with advice about French debts but you may need to seek more specialized advice.
