Hi,

i have a halifax credit card (pre-2007) where i have issues regarding interest rates, currently with 1st credit. they've told me to write to halifax to request the documentation (original form) as they don't have it, and halifax say they don't either. at the moment, my account's on hold, but i wasn't sure if you give advice on pre-court issues....

Well if neither have it hope your not paying 1st Credit?

 

Whats the problem with the interest rates ? given the debt been assigned there should be no interest.

i'm not paying at the moment, no....my original query was around the interest rate when opened being different from what i was actually charged....one of the "sheets" of info they sent had the rather coincidental title of "pre-sue". so either something for me to see, or a cock-up on their part.

Wouldn't concern yourself with it given that your not paying the debt anyway.

If you have made a section 78 request and they are unable to comply...then there is nothing further for you to do...they are and remain in default and know they cant enforce the agreement whilst being in default...

 

So you have no need to to state or write anything.
