There are no guarantees of course, but when it comes to put or shut up they definitely tend towards shut up. The defendant seeks to exclude their liability in breach of section 57 Consumer Rights Act. The secondary insurance contract is in breach of section 72. The claimant seeks reimbursement of £265, plus P2G fees of £9.10, plus postage costs for two first class letters to P2G of £2.70, plus court fees, plus interest.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Guys, I picked up a Sony Vaio for next to nothing and it's in pretty good nick. I am however having internet connection problems. I have connected it to my router via ethernet and wirelessly, but Internet Explorer still can't display the web page. The internet icon says connected with 100mbs speed, but still can't work out what's wrong.

Is there any software on it, which has an update option ? Try it to see if it downloads.

 

Also there is a diagnostic tool in windows tools page to check the internet connection.

We could do with some help from you.

xp is no longer supported for updates so you need to do the little reg dodge to turn it into a business version of XP

then it will update

 

then IE will work.

LONG process though hours of updates to install.

 

download the attached file

rename it to xp.reg

 

pop it on a penstick.

 

pop the penstick into the XP machine

 

right click it install

 

 

or double click it [some xp version vary in the way it installs

I've got a Vaio SOD'EM, don't think they make them anymore.

Any advice I give is honest and in good faith.:)

Also, when I put in my wireless password, it says

 

The network password needs to be 40 bits or 104bits depending on your network config.

This can be antered as 5 or 13 ascii characters or 10 or 26 hexadecimal characters. :???:

read what I posted properly

you need to RENAME THE FILE TO XP.REG

 

 

then double click on it

if its successful you'll get a that's been added to the registry pop up.

 

 

them restart the pc..

 

 

give it an Ethernet connection

any run windows update again and again till everything is updated.

 

 

typically will be several hours and several reboot and re updating needed.

 

 

the otherway to do it is to load 360 anti virus

vios do work on xp quite happily once fully updated

I did rename it, before I transfered it to a Flash Drive. I didn't use capitals, but I wouldn't have thought that would make a difference. When I right click on it, there is no option to install it. Just open it etc. Double clicking it just opens it in Notepad.

Just restarted it and it's been on the welcome page for ages, so maybe it did work after all lol. Just waiting now.

its a very long process

you MUST keep returning to windows upgrade or use the 360 patch tool.

 

 

you'll also probably have to download and install manually winxp sp3.

 

 

but up mustn't do that until your current version exhausts everything at windows update including the optional patches too.

 

 

usually takes me about 2 days on even a 20Mb fibre connection.

 

 

don't be impatient

 

 

do it properly till everything is updated fully then it will work./

 

 

you'll probably have to update IE too IE8

that's the highest you can go on winxp SP3.

 

 

you'll need to upgraded the ram too

the max a vio will take is 2GB.

les than that and forget trying to use it on the internet

If you still have this problem post,

 

I vaguely recall having exactly the same problem on an old vaio on XP and also on an updated PB, and what seemed like a similar issue on an upgraded HP.

On the HP it was the laptop firmware which blocked the upgraded wireless card - flashed a patched firmware that didnt just allow 'selected and approved' cards - all fine. Still using that much upgraded lappy. (Now 5TB in 3 hdd - one replacing the dvd)

 

The PB and the vaio were both failures of the wireless card connector or bridge chip and cheap usb wireless sticks worked fine with xp sp3

 

Be aware that older xp versions still succumb to the blaster virus as soon as you connect to the Wild World Web unless patched
