Hello

About 12 month ago i was receiving phone calls and letters from a debt collection agency,

demanding payment of £2700,

 

during the 1st and only conversation i requested proof of debt in writing,

ie

signed paperwork, payment details,

how, where and how this debt came to be, as i have had no claims or dealing with tax credits for over 10 years.

 

Any hoaxer can send mail out like this,

i have not received any of the above.

 

My partner and i have now received a letter each from tax credits stating that the debt has been returned to them unpaid and demanding the payment in full, again no proof of debt just a sum of £2700.

 

What do we do next ignore or do we make contact with tax credits,

 

ive been told that if we contact them its admitting liability to the debt.

send hmrc the free sar that is on their website

make them prove the debt.

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

got 4 letters each back from 03 - 07 just showing our awards

 

on one it states that we informed them about a change in circumstances,

on another it's says we have not told them in what way our circumstances changed

 

my partner recalls telling them on two occasions that our circumstances had changed

 

they said that everything would be sorted at end of that tax year,

 

hmrc have not sent any recorded phone calls,

 

maybe the conversations are on there.

It took them 5 weeks to get my SAR stuff together.

 

Go look at the Web site tax credit casualties.

 

 

They will take you through the appeals process and what to do when you receive the SAR information.

 

 

In fact I would recommend setting a couple of hours aside to study it.

 

I used the information to mount an appeal and shove their £12 k 'overpayment' where the sun doesn't shine.

 

The system is completely and utterly broken!

Have you filled in a TC846 and kicked off an appeal?

 

Have you also sent a letter saying you are appealing?

 

Have you looked at the Tax Credits COP 26 (code of practice?) to see if there are other grounds under which you can use to strengthen your appeal?

 

Have you considered making a Tax Credits claim? They will take re payments off your entitlement, you can even ring them and ask to use the whole thing to pay back the debt?

 

Simply writing to them, as you did, will have no effect at all...

my objection was that I provided enough information for them to stop making payments to me,

and they did not act on this information this caused the over payment,

 

we told tax credits to stop or adjust our payments but they insisted that all would work out at end of year.

 

I explained this in my completed TC846.

 

I still feel that if tax credits had acted on information on change of circumstance given at the time this would not have happened.

 

Anyone been in this situation and what was the result
