My husband and myself both contracted out of SERPS in the 1980s.

I was contacted earlier this year by Zurich to say I was entitled to my Husbands pension money.

 

My husband died in 2005, and Zurich have told me that I must buy an annuity with the money,

but unlike everyone else,

I am not allowed to take a 25% cash lump sum.

Is this correct?

If so why?

From memory, karrie, you weren't allowed to take tax-free cash from a SERPS contracting out policy. As Mariner says, best to talk to Zurich, Pensions Wise or someone like TPAS, the pensions advisory service.

whatever the answer about an annuity, it wont have to be with them.

 

Usually when someone dies the money is passed on to the next of kin in the way where possible outlined in a letter of intent your hubby would have signed when agreeing to the pension contract.

I think they should have paid you the value of the pot in cash back in 2005

 

 

best advice is to contact the PAS and ask them to intercede as they will be able to ask for copies of contracts etc and then give advise of what can and cannot be done.

 

Zurich have presumably contated you now because the contract has matured and they are treating as a "live" pension.

 

 

Again,this is probaly a misinterpretation on their part

you will need to read the contract hubby signed back in the 80's and TPAS can get hold of a copy if zurich are tardy in wanting to send you one.
