Lowell cant find Aqua CCA - follow up?

Hello,

 

Just a quick back story.

 

 

I was out of a job last year failing to pay credit card since Oct 15 and has since gone to lowells.

 

 

I initially ignored letters but i had the pre court assessment letter on the 18th april this year.

I sent a cca off on the 28th april (not recorded).

 

 

I have received a customer service letter from them today (dated 8th may) stating we have received your letter..

.we have asked aqua to provide us with the requested documentation.

 

 

We aim to provide you with this within 12 working days.

In the meantime your account is on hold.

..if we have not heard anything after 40 days we will send you an update...

 

So my question now is,

where do i go from here?

What are the next steps?

I thought they had to produce documentation within 12+2 days?

Can any of you wiser folk help?

No such thing as a CCA follow up...you have sent it...they have it...clock ticking....if they cant comply they cant enforce or litigate on the agreement.

Calendar, that is what the 2 days are for, service via first class post.

so they have 12 days to get their act together or they dont have anything until they then satisfy this requirement.

 

 

They normally write a load of tosh in their response as they know trhat most people dont actually know what is and isnt the procedure.

 

Next step?

That's what I was thinking. So they have 12+2 (working or calendar?) Days to provide me with information from date of my letter or from when they received?

 

AFAIK it is Working days for a CCA, calender days for a SAR, unless of course the goal posts hAve been moved again?

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Back again, with partial information...

So Lowells finally sent me the credit agreement which arrived Friday 23rd June, after I sent the initial enquiry on 28th April and then their reply that they received my request on the 12th May. They have sent a "copy of the credit card statement and copy of the agreement as per my request". I havent personally seen them yet as I am away at the moment but I asked my partner to send me pics of what they sent. My question is, is what usually happens now?

Depends entirely on what it is they have sent you.

 

Without having sight of it, it will be difficult to advise.

You need to check the CCA is compliant with the CCA 1974 - If not then it will be difficult for them enforce this.

But of course you dont tell them if its not compliant etc

 

We need to see it ideally to advise.
