I hope this is the correct section of the forum for such a post.

Last year my son was travelling daily on a Kings Ferry coach, from his home to university. The coach company axed the service in 2016 and he still had unused "trips" on his annual ticket. He applied for a refund a number of weeks later (being bogged down in exams and projects); the company responded and said it would take a while to locate his details because "the computer data was being dismantled" (???). Over the past year a number of emails have been sent to KF, plus phone calls, but there has never been a refund. A recent posted letter has also gone unanswered.

We are talking about £80-£100 outstanding.

Any thoughts? or are we now facing a costly battle to recover a "small" amount of money?

how much is the small amount?

So, £80-100 ......

Send a letter before claim. If they then don't settle : county court claim (in the small claims track), provided you have no concerns they are going insolvent.

Right; thank you. I doubt if insolvency is involved, they are still a large operator. If it goes to claim, in which county do we have to start the claim in? The coach operator and ourselves are in different counties. Sorry if this seems daft, but I've never done one before.

(Assuming you and they are both in England or Wales) : They are a business, you are an individual, so if it went to a court hearing it'd be in your local county court, not theirs. This relates to where a hearing would be, though, and you were asking about starting a claim (which had been centralised now, so it isn't via your local court anymore).

You can start the claim online (money claims online / MCOL)

https://www.gov.uk/make-money-claim-online

If the claimant qualifies for fee remission it has to b done by post, but that page provides details.

With a helpful guide at:

Hopefully, though, they'll settle when faced with a letter before claim if they realise you aren't bluffing and won't be stalled any longer.

  • 3 weeks later...

UPDATE:

Prior to tackling a court claim, we located and visited a local volunteer-run citizens' advice bureau (to be fair, we didn't know of its existence). The volunteer who handled our queries was actually very on-the-ball; she tackled the coach company by phone on our behalf and managed to stir some mud. We kept all the court claim links to hand and said that we were prepared to go this route if the company didn't respond.

Well....a few days later, my son received a message, asking by what method he would like his money returned!

Mission accomplished and money in the bank.

I checked out the links you all kindly provided and have made a note of them for any future disputes with anyone else.
