    • Hi all, I purchased a car in January from Big Motoring World Leeds. At the time of sale I was shown a tab on the salespersons computer marked 'service history' and I was able to take comfort knowing that the car had been serviced on 3 occasions as the date, mileage and company was there on screen. Being a 3 and a bit year old car that, in my mind, constituted full service history 🤷‍♂️ Anyway, collected the car a week later. Once home I settled down to through the book pack etc. Opened the service history booklet and it was completely blank. In addition there were no invoices detailing that any services had been done. I duly contacted BMW and asked them to supply me with proof of service history. They responded saying that on their 'vehicle documentation checklist' I had ticked and then signed to the fact that I had seen the service history and that I was happy with it. I dug out this checklist and what it actually states is 'seen service history online' which I had in the showroom. BMW seem to think that this satisfies their responsibility in providing service history. The reality is that I don't have any proof that the vehicle has ever been serviced! For my own peace of mind I ended up paying for a service that satisfied the manufacturers maintenance schedule to the tune of £330. I even complained to the finance company that the vehicle contravenes the Sale of Goods act 2015 as l, in effect, ot is not as described. Amazingly they weren't interested and instead I just got an email stating that it's not illegal to sell a vehicle without service history and that servicing costs were part and parcel of vehicle ownership. I've since complained to the ombudsman and am awaiting to see if they can help. I have no issue with the car but the treatment and customer service has been the worst I've ever experienced. I don't really know what to do next as I really do feel aggrieved that I've had to pay to service a car that should have already been serviced. Can anyone point me in the right direction please? 🙏

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

just wondering if anyone is having the HS2 train coming anywhere near them? I am in Nottinghamshire/Derbyshire and been told it will be coming through here!

 

Thoughts? good/bad? Do not really know much about it right now

my house is HA, I have a rail line near me but it is used mainly for goods trains, they do run sprinter trains on it and also other passenger trains at times, the main line is a lot further away

If the financial institutions desert London there may be far less of any case for HS2, even more so if the 'City Powerhouse' concepts are continued.

 

Consider also that if/When Scotland secedes, the Northern Cities may become centers of commerce with Scotland and Edinburgh, and not give much of a darn about London.

The major Northern Cities soon secede and Join the FoAS and then Hadriens wall is rebuilt from Ipswich to South of Bristol leaving Loondon in a state all on its own.

Westminster politicians are denied access to the FoAS.

 

Eire, Norway, Iceland, Greenland and Normandy quickly create ever closer ties with the FoAS within the EU.

Just had some more information re this, where I am a lot of people are against it while others say it will bring jobs etc to our town.

Seems completely wrong to me Snowdragon.

 

The railways cost too much and dont run on time, and ecologically damaging. There is no reason whatsoever to believe this will not be the same.

and how many people will this really benefit for the cost? Not enough to justify the massive cost in money, let alone the impact to greenbelt/farmland, areas of outstanding beauty, businesses and homes.

 

Far more sense is to upgrade the national Internet backbones between the major cities and create satellite offices with rooms to hire with high speed reliable network connections.

Cheaper, more ecologically friendly and far more travel time vs home time friendly and reducing the pressure on London transport and environment..

 

Real benefits to local jobs and the national infrastructure rather than just benefiting a few rich trypes (oops typo) who want homes away from their businesses in Loondon.

It is just an ego trip for someone and when a load of people in govt nodded it then became too late to cancel it without losing face, just like the millenium dome. £3 billion on consultants already spent.

 

I like trains, I like travelling on trains but TBH they dotn go where you wnat them to. saying they go from Liondon to birminham in a nanosecod is actually meaningless when it comes to the real journeys peopel make from door to door.

I live on the south coast and if I used th HS2 service I still have the problem of spending 2.5 hours getting to London and then another half hour crossing the city plus the time I need to fight my way out of the centre of Brum to get to Castle Bromwich or wherever. Now if I want to take a slow cooker I have bought as a wedding present with me that means I cant use the train. Then there is the cost of travel, I can take 4 other people in my car for less tha the price of my ticket and to pay for the infrastructure the new trains will ahve to carry 100000 people a day to even start to pay for themselves so that is still overcrowding unless you run a train every 15 minutes. Now, if the train does carry that amount of peopel the M40 will be half empty so even more reason to drive.

 

 

The biggest problem with railways in thsi country is where they go and when they were built it was London as a terminus. The fighting over passengers back in Victorian times stopped us building a railway that could actually transport peopel though or around London easily and that limits your rail capacity for train movements. In Amsterdam and Madrid they realised this and built new stations for though traffic and put the local services on a loop to get them out of the platforms pronto. A super fast A to B is still the same problem as the old A to B.

HS2 should be totally scrapped,we are sold the idea that London to Birmingham will be 18 minutes quicker and far more expensive,How about getting an earlier train if 18 minutes is the issue.To me the biggest issue is HS2 will not connect with HS1,you will have to change in London and go to another station.Totally Illogical
