    • Aesmith - Thank you for your recent interest in my issues.  Input on people's topics can be most useful from specialised experts or those that have similar experiences.  Some people really struggle with knowing what to do (I certainly do) - so it is most useful and helpful and reassuring when solid sensible advice is offered.  I have found there to be some very kind, helpful, supportive and legally knowledgeable people here on cag over the years - who give sound legal advice for people to roll up their sleeves and follow up on.   Of course, sometimes it can be quite challenging sifting the wheat from the chaff.  I don't have lawyer or barrister.  I sometimes attend pro-bono legal clinics for help.  And sometimes have access to barristers via a pro-bono service called Advocate.  Both ad-hoc. Pro-bono means 'free'

    • Ok you are in the clear. The PCN does not comply with the Protection of Freedoms Act 2012 Schedule 4 for two reasons. The first is that in Section 9 [2][e]  says the PCN must "state that the creditor does not know both the name of the driver and a current address for service for the driver and invite the keeper— (i)to pay the unpaid parking charges ". It does not say that even though it continues correctly with blurb about the driver. The other fault is that there is no parking period mentioned. Their ANPR cameras do show your arrival and departure times but as that at the very least includes driving from the entrance to the parking space then later leaving the parking space and driving to the exit. It also doesn't allow for finding a parking spot: manoeuvering into it avoiding parking on the lines: possibly having to stop to allow pedestrians/other cars to pass in front of you; returning the trolley after finishing shopping; loading children disabled people in and out of the car, etc etc.  All of that could easily add five, ten or even 15 minutes to your time which the ANPR cameras cannot take into account. So even if it was only two hours free time you could  still have been within the  time since there is a MINIMUM of 15 minutes Grace period when you leave the car park. However as they cannot even manage to get their PCN to comply with the Act you as keeper cannot be pursued. Only the driver is now liable and they do not know who was driving as you have not appealed and perhaps unwittingly given away who was driving. So you do not owe them a penny. No need to appeal. Let them waste their money pursuing you .

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Wants hard brexit to pursue the non-existent or massively poorer UK international trade deals, as do a limited number of mega-wealthy who a low tax, low environmental, workers and peoples rights would benefit enormously (end of empire Hong Hong Britain myth)

- despite everyone else being massively poorer to pay for their excesses

70%+ brexit at any cost it would seem - but that 20%+ is a problem to the 70%+

Wants to be the NI ruling arm of a right wing British government that can happily accept abuse of minorities and religious and personal freedoms without interference (IMO)

Wants Hard Brexit - but wants any Brexit off the Table for May

Won't have remain

Wont have a referendum - despite Party and momentum wanting it

Has 6 tests for others deals - that are unachievable by anyone - so wont apply to him

Demands inclusion - then says wont work with them when its offered

Is the voice of the people - as long as its his voice

Is the man of the people - but they better be his people

Wont support ANY Tory deal - but has nothing but a suggestion of a Labour cake and eat it solution

Clearly just wants chaos to give himself a chance at power at any cost to anyone else

Now would seem to be 70% Remain but thats not a problem to the minority of leavers or Corbyn

 

 

The British People

God knows what they want.

 

 

 

 

So what WAS voted for in the referendum, and what might still be on the table

 

'VIsions'

 

1. Cake and eat it Brexit (guesstimate at least 50% of the Brexit vote or more? - it was sold as this)

All the EU benefits, none of the downsides, none of the cost, everybody queuing up to give us great deals - easiest quickest deal in history.

 

Not going to happen - Never was - Never will

AT LEAST 36% of the whole vote or more are NOT going to get what they voted for

 

2. Hard Brexit - Rule Brittania (guesstimate at least 10-20% of the Brexit vote)

Britain says up yours to the EU, doesn't pay its bills, sails the British Navy into the Seas loaded with marines and takes back its Empire and whatever it wants. We all become pirate sailors or Sharpe. Arrr Jim Lad. Pieces of eight.

 

I'm afraid cuts to our Military let alone the opposition of the USA, Russia, China, The EU and NATO and most of the rest of the world really make that simply unrealistic,

... although Russia and China might work with us on bits that are in their interests.

The USA really does NOT want competing Empires (especially us) - thats not changed since WW2 and Suez

 

3. Hard Brexit v2 - Sweatshop UK (guesstimate 10% of the Brexit vote - but not realising what it actually was)

The UK leaves the EU, Doesn't pay its bills, Reduces Taxs for the mega-wealthy and corporations, Reduces workers rights, environmental rights, food standards, Fracks the countryside away then concretes it over.

A few get even more obscenely rich - everyone else ends up poor and poisoned and living in a rabbit hutch apartment at the whim of the landlord.

A mix of end of Empire Hong Kong and sweat shop China/India

 

(err how many voted for this? a couple hundred maybe?)

Still very achievable and actually probably still the most likely outcome.

 

 

4. Make Britain Great Again

 

Yes we all feel that some. but what does it mean? what IS actually achievable?

and would that be best served with a lot of partners?

 

 

5. Remain (almost half the votes despite many ex-pats not getting the vote and the Leave spin)

It seems we can still keep our existing (nearest a cake and eat it) deal if we revoke article 50

 

 

 

 

Issues

 

1. Immigration

Undoubtedly an issue for many,

BUT the UK could have sent non working EU immigrants home (not the same with non EU immigrants

EU immigration has fallen massively - causing massive problems for our health and welfare services and agricultural businesses

Its has been clearly shown that the EU migrants and immigrants actually ADD to our society both monetarily and culturally

 

2. Cost of EU membership

All clubs have membership costs and Iour membership costs are simply good value if you look at it dispassionately,

and the poorer regions who voted leave actually directly benefit from those EU rebates - rather than it going in tax relief to the rich as the UK government does and would.

 

3. Take back Control

The world is run on rules and agreements. Even the WTO is and has Rules which we would abide by.

and look at the sort of control our government on all sides isnt showing ...

 

 

Seems quite clear to me that whatever else happens, the vast majority of what people voting Brexit voted for - is a lie and IS NOT DELIVERABLE in any circumstances

 

So if you can't have cake and eat it Brexit and don't want Sweatshop tax haven Britain

- Only REMAIN remains?

It isn't clear if May wants to negotiate does it, as she's already announced that her red lines haven't changed. The ERG must have got to her early on. Caroline Lucas has already said that she [Maybot] wants to talk to other parties but only if they agree with her.

 

Rather than listening to the other parties, it sounds as if she wants them to think of ways nobody else has thought of to have a good deal from Europe with all the same conditions that she's imposed. A good deal from Europe is impossible as long as she maintains the red lines and demands the same terms as we had before.

Caroline Lucas has already said that she [Maybot] wants to talk to other parties but only if they agree with her.

 

She has flatly said:

No referendum on the options NOW actually available

Her deal or No deal (and her deal is nothing anyone voted for - and cake and eat it Brexit voted for isnt available)

Britain leaves in March whatever

Her red lines are uncrossable and not for negotiation

 

 

Pretty much the same as Corbyn says isnt it?

Whats really happening at the moment?

 

May is corralling the Tory party into supporting her deal on a rerun, including the Brexiters

 

Whats changed?

With Corbyn 'indicating' he is against any 'no deal', Mays deal is now the best option to get a Tory managed hard Brexit.

All the Brexiters need to do is support Mays deal and then put some kybosh on the Backstop or renege on some sort of the deal over the next 2 years and they still get their hard Brexit crash out.

 

 

Likely to suit Corbyn as he will just get to do nothing but carry on with his feeble grandstanding with no chance of an election, no responsibility and not have to carry out the wishes of the party.

Very little effort on his part needed to ensure the Brexiters plans work.

 

May is refusing to take Hard Brexit off the table

Corbyn is having to say 'take hard Brexit off the table' despite only having his 'cake and eat it' fantasy option.

 

 

Depends on how many Tories will rebel against the 3 line whip, and all Corbyn has to do is allow a 'free vote' (this time despite all the prior whipping to prevent votes against Brexit) knowing there are likely enough Brexiter Labour MP's to nullify the Tory rebels.

 

The voting on the amendments might give further insights.

 

 

It must be getting clearer to everyone what a complete disaster hard Brexit will be for the UK and the Union

 

It must also be getting very clear that ALL other deals are vastly inferior to the one we have

 

 

 

Again the reminder of what people voted on

Also interesting that some of the proposals to reject the lie that is Brexit - actually potentially do 'return power to Parliament' - out of the hands and reducing the power of the Government Minsters and Cabinet

 

May, Duncan Smith and suchlike are up in arms about that, but it sounds good to me.

One of the Brexit lies, possibly turned into a valuable truth by those who realise and don't want the country damaged by the nationalist radicals and self serving mega rich Brexit Crew.

Even after the latest antics of the brexiters, this one has quite surprised me.

 

We know that the Brexit Crew have been stating (quite falsely) that WTO rules trading is no problem

It is a problem as we are

* not simply guaranteed WTO trade rules - its a club, with rules (some the brexiters seem to think they can flout) and some don't want us - Just like the EEA doesn't

* Even if we are admitted - its far far worse than the deals we have even including the fantasy deals touted

* It doesn't address the Irish border/Belfast agreement/good friday agreement issues.

 

 

BUT

It actually worse than that

 

The brexiters seem to be touting that a WTO rule which ALLOWS continued trading on existing terms for up to a decade while a new deal is agreed can be enforced in the event of a no deal Brexit to FORCE the EU to continue trading under the existing rules until a new deal (if ever) is agreed.

 

 

I dont know whether to laugh or cry

Total fantasy - just like cake and eat it.

All the many many other things aside, they seem to be missing the point that continuing on existing terms means exactly that - paying the EU and abiding by EU rules etc etc as is the case now ... not just the bits they do or dont want ...

... which is hard brexit but with an up to 10 year transition as a member state with all the responsibilities etc ......

 

Of course the Brexiters claim they can just get the goodies with none of the costs through it.

Well, it takes two to agree it Brexit boys ... Just like the original cake and eat it deal promised.

Hate these foreigners interfering in UK sovereignty - but want Poland to veto UK parliamentary decisions

 

Want to return power to parliament - but want Parliament closed to prevent it

 

Hate the EU and want out - but want to force them to continue trading under the existing terms

 

Are the voice of the people - but definitely dont want to hear anything else from them

 

Are a minority - but think they should be treated as if only their opinion counts
