      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

I started a Ppi claim with Lloyds a few weeks ago

there were 9 old loan account from 1992 to 2000 with Ppi.

I should have my response in Aug.

But this week I have received 2 letters in the same envelope to old address

even though Lloyds have new my address due to claim.

One is from Lloyds saying they have sold my debt to asset link the other from asset link.

I know there's a Lloyds charge on my old house from 2006 (ex wife and kids live there but my sole mortgage) as its on land registry.

Any one know why I've been sent letter?

I assumed they would offset against any debt anyway.

Any advice on what to do I will upload letter off asset link.

Ok will check other letter later.

Do I notify asset of my new address my ex wife bins mail and gives nothing to me.

I'm only lucky to get anything if it's my friends post round.

On saying that nothing should be going there I left in 2014.

Fo I sent a dispute letter Orr CCA to asset,

ignore them offer them a full and final settlement?

What happens to charging order?

charge will now be in their name I think you'll find?

I wouldn't be rushing to settle this just yet

but if the PPI gives you funds

it might be the only way to get the charge removed.

but we'll deal with that later

Ok thanks.

To be honest if Lloyds are paying me out over that amount then I will have no issue paying it.

I did think it was about £4000 outstanding on the debt and removing the charge.

I'm only guessing that Lloyds have come to conclusion but are not informing me until the 8 weeks are up.

That said I'm not to keen either On debt collectors chasing me until I know if my claim has been successful.

As I won't be able to offer anything until I know if Lloyds are paying me out or not.

But going on anything over 10 year old Ppi I've been told by an employee of the bank the standard payment is £1200

yes std on unknown claims with Lloyds is £1200

No I didn't think I needed to as when I rang up they give me all the account numbers and the dates

and sent form out with these account numbers already on.

 

 

It's just a waiting game now for a yes or a no!

once I get confirmation I will ring land registry.

 

 

Shall I send link an email given them my new agrees as I don't really want mail going to my old address

on Lloyds nicked letterhead

I'm waiting on CCA response from link and sar from Lloyds.

However a letter has come back from Halifax general insurance saying they 40 days to get info out to me.

I bank with Halifax now and am only really interested in past loans and info from Lloyds.

Any idea why the letter has come from Halifax general insurance?

Reply received from link today.

I notified them of new address on cca last week

but still they have responded to cca at an adresss I have not lived at since Jan 2014.

This is what I put on cca dated 18th July.

In respect of your letter dated 10th July I would like you to update your records with my new address.

I have not lived in the address you wrote to since January 2014.

What shall I do about them continuing to write to me at an 3 year old address?

Little update

Lloyds paid some money in my bank account yesterday the 8 weeks are up on Aug 3rd.

I haven't had a decision letter yet to show how the figures have been worked out.

But if they awarded me the standard redress on each loan and paid to debt collectors off it doesn't work out quite right.

I await letter patiently to see their calculations

Okey dokey there was 9 loans from 1992 to 2000. But what they've paid out is nowhere near the standard redress for old loans. I've had around 1/3 of that. But somethings better than nothing all. Strange I've been paid before I've even had paperwork to agree or disagree don't you think?

Even though link sent me letter below stating 30 days. Do I still write to them after the 12 + 2 days with a reminder letter allowing 30 days? Then if they don't respond after that write to say that they haven't complied with my CCA request and are now in default and put account into dispute??
