And unlike some domestic goods manufacturers you can buy from them direct and I believe they employ their own service engineers, Is that your situation? You bought direct from Hotpoint and Hotpoint sent out their own engineer?
    • It's Hotpoint (but I believe they're part of the Whirlpool group now?). The part was bought direct from them as a consumer.

    • We used to recommend that people accept mediation but our advice has changed. The mediation process is unclear. Before you can embark on it you have to agree that you are prepared to enter a compromise – and that means that you agree that you are prepared to give up some of your rights even though you are completely in the right and you are entitled to hundred percent of your money and even though EVRi are simply trying to obstruct you in order to discourage you and also to put others who might want to follow your example off from claiming and even though they have a legitimate basis for reimbursement. Mediation is not transparent. In addition to having to sign up that you are prepared to give up some of your rights, you will also have to agree not to reveal any details of the mediation – including the result of the mediation – so that the whole thing is kept secret. This is not open justice. Mediation has nothing to do with justice. The only way of getting justice is to make sure that this matter goes to trial unless EVRi or the other parcel delivery companies put their hands up and accept the responsibility even if they do it is a gesture of goodwill. Going to trial and winning at trial produces a judgement which we can then add to our small collection to assist other people who are in a similar boat. EVRi had been leading you around by the nose since at least January – and probably last year as well – and their whole purpose is simply to drag it out, to place obstacles in your way, to deter other people, and to make you wish that you'd never started the process and that you are prepared to give up your 300 quid. You shouldn't stand for it. You should take control. EVRi would prefer that you went to mediation and if nothing else that is one excellent reason why you should decline mediation and go to court. If it's good for them it's bad for you. On mediation form, you should sign that you are not prepared to compromise and that you are not prepared to keep the result secret but that you want to share the results with other people in similar circumstances. This means that the mediation won't go ahead. It will take slightly longer and you will have to pay a court fee but you will get that back when you win and you will have much greater satisfaction. Also, once you go the whole process, you will learn even more about bringing a small claim in the County Court so that if this kind of thing happens again you will know what to do and you will go ahead without any hesitation. Finally, if you call EVRi's bluff and refuse mediation and go to trial, there is a chance – maybe not a big chance – but there is a chance that they will agree to pay out your claim before trial simply in order to avoid a judgement. Another judgement against them will simply hurt the position even more and they really don't want this. 300 quid plus your costs is peanuts to them. They don't care about it. They will set it off against tax so the taxpayer will make their contribution. It's all about maintaining their business model of not being liable for anything, and limiting or excluding liability contrary to section 57 and section 72 of the consumer rights act.     And incidentally, there is a myth that if you refuse mediation that somehow it will go against you and the judge will take a dim view and be critical of you. This is precisely a myth. It's not true. It would be highly improper if any judge decided the case against you on anything other than the facts and the law of the case. So don't worry about that. The downside of declining mediation is that your case will take slightly longer. The upside is that if you win you will get all your money and you will have a judgement in your favour which will help others. The chances of you winning in this case are better than 95% and of course you would then receive 100% of your claim plus costs

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just been looking a touch deeper into The Daily Mile.

ITV is joining forces with INEOS to launch a national campaign to encourage all primary schools across the UK to take up The Daily Mile.

Just remembering the Payday Loan companies as they threw money about to try to get a clean image.

Bad memories just came back but no use dwelling on the past.

Into schools they marched,all been done before by the predators.

Image is so important for a company.

Perhaps this is the last news report from KM8 Kirby Misperton where Third Energy have retreated back into the darkness.

 

A children’s health charity has been slammed for its work with a fracking giant.

A children’s health charitable foundation is facing criticism for involving itself with a fossil fuel giant; not least because it encourages youngsters to get out in the “fresh air”.

But fresh air is something the company involved would know little about because its activities cause, at best, air pollution.

Couple of comments much more on the article.

The Canary asked The Daily Mile and ITV to comment but none was received at the time of publication.

INEOS previously defended Go Run For Fun, saying it was:

 

extremely disappointed by the actions of a handful of individuals in association with anti-fracking groups… Their ‘bully boy’ tactics have put inappropriate pressure onto primary schools… preventing 1500 young children from taking part in an event that can only improve their health and wellbeing.

 

But people have hit back at The Daily Mile and ITV for partnering with INEOS.

As a qualified teacher and early years’ specialist, I would not involve myself or my children with an initiative like this.

I find it disturbing that a company like INEOS should be associated with such a health initiative.

 

This is completely unethical and we cannot teach our children that this is at all acceptable.

Imagine if the tobacco industry sponsored The Daily Mile? There is no difference.

In years to come… everyone will be shocked by this.

Well early start today for myself,a little work to do.Walking The Shoreline,a strange way to make a living but very enjoyable.Just the way life took me.

And not as easy as it sounds though i suppose sounds wonderful for those living in Cities or Towns far way from the sea.

 

Just been looking back a little,been doing that a lot lately maybe a age thing.

Listening to the seagulls and the waves crashing on the shore hardly a soul around.

And more last year than this but then when i could popping off the Shoreline to The Road To Hell.

Use to shock me approaching the Fracking Site as many think perhaps who have not been to The Gates To Hell.

Plus being by myself mostly seeing so many people took some getting used to.

But you meet people you will never forget and see things that will live on in your memory as the mists of time roll slowly by.

And done things i never imagined i was capable off,filming,talking,writing,photographing,observing.

Plus having some Vegan food kindly offered to me a few times.Very nice indeed.

Tina Rothery is a mother, a grandmother, auntie and tireless anti-fracking campaigner with Nanashire and United Resistance.

Over six years fighting the Frackers,missing out on family time and all the rest that many of us enjoy.

I try to understand why the ladies the protectors take such a active role.

It seems comes down to a fierce sense to protect their young.Or anyone,they see the danger rolling out in their midst.

The Frackers are desperate outfits,all they have done so far is throw money down the well,one hell of a lot, and spread it around trying to influence.Next it will be schools,donating a roof for the village hall things like that.

Already been done i would think.

New satellite to spot planet-warming industrial methane leaks

Multimillion dollar project will scan and make public methane leaks from oil and gas plants that are a major contributor to global warming

 

Methane leaking from oil and gas facilities around the world – a major contributor to global warming – is set to be spotted from space.

 

The Environmental Defense Fund (EDF) has announced it aims to launch a satellite called MethaneSAT by 2021 to scan the globe and make major leaks public. That information will then enable governments to force action, EDF hopes.

Building and launching the satellite will cost tens of millions of dollars,but EDF says it has already raised most of the money.

two reports released which should have reduced the fracking industry’s stocks of paracetamol.:lol:

The first came from the University of Stirling and looked at the research that underpinned the Scottish parliament’s ban on fracking.

 

In the first study of its kind, the team compared the approach to 14 assessments carried out around the world, including in the United States, Australia, and Germany.

They found that Scotland carried out the most extensive assessment – focussing on key factors including public health, climate change and economic impact.

 

The report concludes: “In terms of breadth, depth and scale, this approach appears more detailed than any undertaken to date globally.”

Researchers on Sustainable Industrial Systems at the School of Chemical Engineering and Analytical Science

At the University of Manchester have looked at the full life cycle costs of shale gas extraction and concluded that:

 

UK shale gas is 2 times more expensive than LNG and 3 times more than US shale gas.

Shale gas would have little effect on energy prices and consumer bills.

The contribution to the GDP is small, an order of magnitude lower than in the US.

The economic success of shale gas in the US may not be replicated in the UK.

Community Liaison Meeting

Monday 9th April 2018

The official minutes for this monthly meeting are taken by

Lexington Communications, who are Cuadrilla’s PR firm.

They also run the “Community Helpline”. Cuadrilla’s minutes usually are issued within a week of the meeting, one month in arrears.

So for example March’s minutes will be published on Cuadrilla’s website in April.

Cllr Julie Brickles, Cllr Dawn Ansell and myself, take our role extremely seriously and ask many questions of the regulators, the police and Cuadrilla. Many questions arise from residents and those protesting roadside, and often concern the fracking process, traffic and noise.

A number of questions reflect the nature of the protest.

Attending these meetings enables us to challenge and present evidence and issues to industry and its regulators.

It also enables us to provide some feedback to our communities. I can only repeat here the answers we are given.

Fracking gas pipeline heralded by Ineos closed to prevent "catastrophe"

A FRACKING gas pipeline key to the “shale gas revolution” promised by Grangemouth petrochemical giant Ineos has been

shut down by US safety regulators to prevent “catastrophic results impacting the public”.

 

State authorities in Pennsylvania ordered the closure of the 300-mile Mariner East pipeline after three large sinkholes

were discovered near drilling for another adjacent pipeline. Continuing to pipe huge amounts of inflammable

and explosive gases presented “a clear and present danger to life or property”, a state investigation concluded.

Well as some say the Corporate enforcers were there in force.

It is time perhaps the Frackers were made to pay for this not the Council Tax Payer.

INEOS legal case against National Trust takes another step forward

The UK’s biggest shale gas company is expected to issue court documents in the next few days in its legal challenge against the National Trust over access to Clumber Park in Nottinghamshire.

 

INEOS Upstream wants to carry out surveys for shale gas in the Grade 1 historic park. But the National Trust has refused access. It said INEOS had not demonstrated why the surveys were necessary.

 

In February, the Oil and Gas Authority, acting for the government, granted permission to INEOS to bring its case against the Trust.

Updates from Day 5 of the reopened public inquiry on Cuadrilla’s plans to drill and frack at Roseacre Wood in Lancashire.

 

Yesterday at Blackpool Football Club, heard from witnesses from Roseacre Awareness Group, which opposes Cuadrilla’s revised plans to manage lorry deliveries to the site. The plans include two additional lorry routes, 39 passing places and new traffic signals. The cross-examination of Lancashire County Council’s highways expert will also continue.

If this happens a few wells get going you would think the Frackers maybe thinking the Protectors will be stretched and oposition will melt away.

But would it or would it rise.7 million police costs at one site alone,and i see other communities forming groups to oppose and growing.

So the pressure must be on the powerful ones to let the Frackers roam free in England,accept that risk and expense.

The money they have to burn and powerful lawyers maybe putting off councils who are short of cash and have far better ways to spend money challenging to hard the Frackers mission to Frack this green and pleasant land.

Meanwhile the investors keep throwing money down the well.

What are they thinking as they see this opposition.I do not know but will try to find out.But i would be keeping my money under my floorboards for sure.

But some like the risk and future possibilities i suppose.Hoping for big bucks.

So where do we go from here.

Will things end like this.

The Shale Revolution has a big problem. It is heavily dependent on institutional investors and lenders, and they are starting to lose interest in the business.

Investment in shale has benefited from a Silicon Valley-like syndrome of focusing more on growth than profitability.

But in the past similar strategies of growth-at-all-costs have led to busts. In a boom/bust industry like oil, businesses fall hard.

When investors give up waiting for profits, they flee in unison, and when that happens, the Shale Revolution will end.

Monday and Tuesday were off the scale regarding rights to protest and for the last two days the bellmouth has been more or less off limits for any form of protest,

 

We have seen pockets of people having fun and resisting but they was thrown about and denied movement in or around the bellmouth.

 

Today the women took back control of the bellmouth and restored a little calm to the proceedings.

World May Hit 2 Degrees of Warming in 10-15 Years Thanks to Fracking, Says Cornell Scientist

 

In 2011, a Cornell University research team first made the groundbreaking discovery that leaking methane from the shale gas fracking boom could make burning fracked gas worse for the climate than coal.

 

In a sobering lecture released this month, a member of that team, Dr. Anthony Ingraffea, Professor of Engineering Emeritus at Cornell University, outlined more precisely the role U.S. fracking is playing in changing the world's climate.

 

The most recent climate data suggests that the world is on track to cross the two degrees of warming threshold set in the Paris accord in just 10 to 15 years, says Ingraffea in a 13-minute lecture titled “Shale Gas: The Technological Gamble That Should Not Have Been Taken,” which was posted online on April 4.

That's if American energy policy follows the track predicted by the U.S. Energy Information Administration, which expects

1 million natural gas wells will be producing gas in the U.S. in 2050, up from roughly 100,000 today.
