Hello

 

I am hoping for guidance please :-)

 

I have a capital one card that has a few charges on that I really can not afford to pay.

 

I told capital one this and asked them if they would consider freezing the interest and refunding the charges then agreeing to a repayment plan but they said no and that is their final answer.

 

So I then sent them a letter before action for the charges.

 

This was then ignored and I have since received a default notice.

 

 

The credit limit is only 200.

I have a standing order set up for 10 a month and this is all I can afford.

 

 

But when they are adding 24+ a month in charges plus interest it is obviously not reducing the debt.

 

Are capital one allowed to issue default notice in response to letter before action?

 

I can now afford the court fee this week so where do I start with putting together the information for the claim?

 

Can I now add the charges that they have added since the letter before action?

no need to issue a claim yet.

 

 

yes ofcourse they can issue a DN.

 

 

so you've been writing to them?

what did you send?

and when did you issue the LBA

and what time limit did you state?

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
