New paragraph below paragraph 42 – the defendant merely relies on "standard industry practice" You haven't pointed to the place in your bundle of the Telegraph newspaper extract. You have to jiggle the paragraphs around. Even though I have suggested new paragraph numbers, the order I have suggested is on your existing version 5.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Many of you will know and may have been helped by our site team member – citizenB.

 

I'm sure many of you would like to know that citizenB has decided to leave the team.

 

CitizenB has been our great friend and great colleague for over eight years on the site team and over nine years as a member of the CAG.

 

She has been with us and helped us through the difficult times and all of the good times which we have experienced during that period.

 

She has made a great contribution to all of us on the CAG and on the Team. In addition to providing direct help to the thousands of people who come onto the forum, she has also been the editor in chief of the monthly newsletter which she has managed to make sure has been published regularly and without fail for several years.

 

I think we will all miss her.

When I was in two minds about stopping posting on CAG it was CB that changed my mind.

 

I have spoken to them lots over the past few months and have learnt just how warm kind and extremely considerate they are and their words of wisdom changed my mind.

 

So I am still here on CAG

I will try not to be a stranger and visit regularly. There is just too much going on in my private life at the moment. It wouldn't be fair of me to stay on the site team in name only.

 

 

I would like to think that I have given good advice and where I haven't been able to, at least been supportive. CAG is a very special place and its membership even more special.

 

 

I am very sad that I no longer have the time to spare.

 

 

I will be seeing the March newsletter out and will be MIA from April 1st.

Seen the news & wanted to say thanks for the help you offered when my financial life was in a mess. The advice & suggestions of CB (as well as Ellen & AndyOrch) have helped me enormously & I know for sure I'm not alone in that.

 

CAG is losing a gem but all the best for the future CB :kiss:

CitizenB, thank you for all the help and support you provided back in 2010 when I fell foul of MBNA's foulness! Bizarre that I read your news 6 years to the day the (illegal) MBNA default came off my credit record!! Lol! Hope to see you around the board when things calm down a little for you. Thank you citizenB for your help over the years. This site changed my life and you are one of the main reasons why CAG is so wonderful. You will be missed.

CAG has helped me so much since I joined. Based on what I have learnt from others on here and my own experiences, I try to chip in and help others from time to time. I am not an expert and give my opinion only. Always check with the more experienced CAG members before making important decisions.
