      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

 

I've spent the last 5 years trying to clear through all the mess I was in, and through some great help from this site I've done a reasonable job so far. I've cleared a big chunk of the stuff that was keeping me in trouble and have now looked through the payday loans I had.

 

 

Reading on here about irresponsible lending made me look at my old QQ loans, where I was quite shocked to see I had 59 loans one after the other,starting at £100 and ending up at £1350!

 

In total I borrowed over £50k in 3 and a half years and the interest paid was over £8,500

Irresponsible on my side I understand but I was getting in more and more of a hole.

 

Then I realised that was up to 2012 and my loans changed to a flex account that I could draw from, which seems to be blank on the QQ website.

 

I've asked for details to see how much interest I paid over the 18 months I had that.

 

At the time I also had loans with Wage Day Advance (small) and Pounds to Payday (pretty large), but understand the latter was based in Malta so I don't really have a leg to stand on there

 

What is surprising is I also had a loan with Pounds to Pocket (4 of them in fact) while I had my flext account and they are owned by the same parent company as QQ.

 

There is no chance they did any proper checks as my credit rating was shot to bits and 59 loans is not a short term fix

 

I've fired them an email to ask them to explain their process and see what comes back. I'll update as I hear anything

blimey thats a heck of a story...deff worth a complaint to them, ther'll probably fob you off then onto FOS....can you not check you bank details to see when loan payments were made in and taken back that way you'll get a clear view as to what you paid in loan fees etc - even if you dont have/use that bank account any more its worth phoning them to get copies of your statements for those years - i had a similar issue with PDLs I took out and my old bank sent me all the statements FOC

I had Pounds Till Payday loans over that whole period of that,

and they were usually around a grand a month!

It probably means I borrowed another £35k minimum through them.

 

 

I don't seem to have the details for them and for some reason can't seem to be able to search on my on-line banking at the moment.

 

 

I see they are now UK based, but wouldn't hold out much luck on anything back from them.

Wage Day Advance actually contacted me and froze the interest on my last loan and allowed me to pay back in instalments as a "responsible lender"

There isn't much on there, so not going to rock the boat

 

For QQ all the loan info is on the website, so easy to access. With the exception of the flexi account from 2013, which is what I have asked for information on. I have had an email today saying they can help and are looking into my query

 

Put the QQ loans into a spreadsheet and it makes sobering reading. This is just the loans and doesn't include the interest i'll have paid on my Flexi account, or the Pounds to Pocket accounts. As some of these go past 6 years, does that affect any claim? All this information is from QQ own website

Yes, that's £52k of borrowing and a minimum of £8.5k of interest in just over 5 years! 3 of those loans had £12 charges attached to them, I can't remember why

This morning I received a cut and paste reply for both my QQ and Pounds to Pocket accounts, this despite not raising any query with Pounds to Pocket. At least not yet. The emails were identical with the exception of the change in Customer ID, even coming from the same person

I have responded by thanking them for their cut an paste response, mentioned they haven't sent the information that I requested for my flexi loan and asking if I should take this as a final response. I even pointed out I hadn't complained about by Pounds to Pocket loans and that the emails were identical

 

Very quickly I have had this about my flexi loan, so have all the information I need.

 

 

Between 03/08/2013 and 31/12/2014, the cumulative principal advances you borrowed was £22475,00

 

The total repaid on this account was £29183,57,

 

The cumulative late fees and administrative charges assessed to the above balance was £0,00.

 

The cumulative finance charges assessed to the above balance was £6708,57 .

 

I am awaiting their final response so I can go to the FOS. Do I just supply them with the information I have available and some copies of my credit score at the time, maybe showing the arrears on my mortgage (not sure how anyone would lend to someone 2 payment late on a mortgage)?

 

 

What this does is show between 5th March 2008 and 31st December 2014 (6yr 10 months) I borrowed a total of £73,125.00 from QQ and paid £15,242.70 interest in that time paying back a total of £88,367.70. This is just Quick Quid

Are they seriously suggesting that they could see nothing wrong with reloan after reloan - sit tight it will be a long painful process with FOS on this one as lots of info to go through - in the end I should think you will get the loan fees back

Hi Neil, thanks for your response. The cut an paste email doesn't actually say its a final response so pretty sure I can't go to the FOS yet. I don't have any loans with QQ, although do have 5 months remaining on a P2P loan, that is all up to date, so I have nothing to lose and everything to gain. Now my reliance on these things is removed, due to some help from my mother (a difficult conversation to have, but one I'm glad I eventually did have, before I went under) I am happy to play any waiting game with QQ required, and go through the process. The fact they are a short term lender and ended up lending me money for 82 consecutive months doesn't really show that they are a responsible lender. I've paid all these loans back in full, never defaulted and been a bit of a model customer in that time, with 3 late payment fees, no wonder they saw me as a cash cow to milk.

 

 

Does anyone know where I stand on length of time though, am I stuck looking at the last 6 years only?

Flikofee will know more but I think you will be limited to 6 years - 82 consecutive months, they really are stupid if they think they are going to get away with this. I would think that opening a case up with for for irresponsible lending would best , probably steering clear off unafordable lending/borrowing as you paid the loans back.

Thanks Neil, i'll wait from some advice then and see what I can do.

 

 

The vast majority of interest is in the last 6 years anyway as the loans were smaller in the start. To be honest the only way I could pay these back was through bouncing the QQ and Pounds till Payday loans off each other. My paid date at work changed so I told one of them this and would pay back on pay day one loan, re-loan to pay the other, then re-loan that to pay my bills. Stupid I know, but once I was in that trap I couldn't get out. Maybe I should have just defaulted them a long time ago and not been in this mess. I've never tried to get out of paying what I owe, but looking at this spelt out in front of me its a bit of a horror show and no wonder I was in such a state

 

Pushed QQ on their email to see if I could get a final response but got a "we have 8 weeks to look at this" so looks like i'm in it for the long haul now. I don't expect anyone has had a response within this time? I also got an identical one from Pounds to Pocket, again never having approached them to discuss these loans, I just pointed out in my original email that I had loans from 2 parts of the same company at the same time. What are they worried about I wonder?

Pounds to Pocket is the trading name of CashEuroNetUK, LLC and so is QQ - both owned by the same parent company - which in this case makes your case even stronger as they were both lending to you at the same time - very interesting

joncow, the response you received is a standard qq repky which i receieved as well before finally winning. you should definitely win your case, if you check out the fos website and look at the decisions database, filter it in quickquid and u couls get some useful info to support your complaint. the main criteria which the fos seem to like to uphold are:

 

long term consecutive sequential borrowing either via rollovers or reloans

other payday lenders apparent

other adverse credit

 

based on the volume of lending alone, you should be in for a very nice refund of interest and charges but be prepared to wait a while

Thanks Acid! Just looked at the number of cases found in favour of the consumer is 80% for Casheuronet UK LLC which is the parent company of both Quick Quid and Pounds to Pocket. Just a shame I now have to sit and wait for 8 weeks to receive a no before the Ombudsman can start their investigation. Its 2 more months of interest I suppose!

 

Neil, I did mention to them about having loans with both, but they have been very quick to send me emails for Pounds to Pocket even though I haven't actually raised a complait with them

My point is that they share the same address and same mother company. That means that in all likelyhood that they sahre the same telesales, customer service, complaints teams and toilets.....so when you opened up your complaint with QQ their dumb complaints team (or could be intelligent as they pre-empted your other complaint) decided to respond for both accounts.

 

Whats more concerning here is that they share the same data on their debtors so really should have a far better view of your borrowing then say seperate companies.

I'm going to reserve if I think they are dumb until I get my final response, ha ha.

 

 

My guess is they are going to pan it out for the 8 weeks and then say they did nothing wrong. Reading the forums I don't see anyone that's had a positive result without going to the FOS with QQ or Pounds to Pocket. And then everyone pretty much seems to get a result! You'd think QQ would learn then and avoid the inevitable cost of the FOS opening up an investigation and the extra 2-3 months of interest that's been added. I'm certainly not looking to get out of anything, I borrowed the money and I've obviously paid it all back, but if I could get some of the ridiculous amount of interest back to sort the rest of my life, I'd be very happy.

yes, I'd be prepared to wait the full 8 weeks unfortunately and then the amount of time it takes to get through the FOS process which is prob between 3-6 months. In my case they accepted the adjudicators decision without raising it to the Ombudsman which saved a bit of time but at least you have a very nice lump sum awaiting you. the FOS can throw the odd curveball decision depending on what adjudicator you get but as you have seen with 80% of cases getting upheld and the sheer volume of your lending, I cant see how they can win your case

 

The good news in a perverse way is that QuickQuid has been granted a full consumer credit licence and is a big company with deep pockets so should be no risk to your money - my worry with a lot of my cases with the smaller lenders was that they would go out of business and I would never see any of it back (Minicredit, CashGenie being examples). I dont see given how the scale of some of these refunds how can of the smaller lenders can survive...

Don't worry about the 6 years. It's 6 years from when you discovered the problem.

Hi Caro, many thanks for the info on the 6 years. Very interesting, and at least I have all the information for all these loans to hand including amounts paid and actual numbers for the loans.

 

 

No problem fkofilee, I appreciate you all need to sleep at times! I've seen a few smaller claims on here, but nothing quite as big as paying over £80k to quick quid, which is a little daunting

So... Ive read and seen and this is an extensive case.

QQ send that response as a Copy paste as you know. CRAs will only have your searches for a maximum of 2 years.

 

Refer to the FOS with immediate effect. Let them do their digging. Did you do a formal complaint with them or just a simple 1 2 email?

I just sent them an initial email asking about the info on my flexi credit account as I couldn't see the detail on the Quick Quid website. I then totted up my payday loans with them that was the first 59 loans on the list. I followed up the next day with a little extra info from me in a "for the benefit of doubt who I am email" and expressing my concern at the amount of loans I'd had and for the amount, pointing out I had loans with Pounds till Payday and Wage Day Advance for the majority of that time and also with Pounds to Pocket as part of the same business though the length of my flexi account. I got a generic we can help you email with no timeline expectations or details. This was just last week.

 

 

Over the weekend I dropped them another email asking when I'd expect to hear anything. First thing on Monday morning I received the standard cut and paste responses, one from Quick Quid and one from Pounds to Pocket. Both were identical with the exception of the customer number at the top. Both came from Tiffaney and arrived less than a minute apart from each other. I relied to each thanking them for their cut and paste response and should I take this as a final response. On the Quick Quid reply I pointed out I hadn't received the information on my flexi credit account as requested. I received that info around 30 min later.

 

 

I didn't hear anything so spoke to the FOS who just said they wold send Casheuronet UK a letter stating I had a complaint and they had 8 weeks to respond from my initial complaint. That was Tuesday. Later on that day I managed to speak to someone at the resolutions team at QQ and they said it wasn't a final response and they had 8 weeks. I told her that none of the responses from QQ had been anything but vague and how was anyone meant to know what they were doing. I then received 2 emails - 1 for QQ, 1 for P2P from the response team stating they had 8 weeks to investigate. I received a letter from the FOS letting me know that they had wrote to Casheuronet, this came yesterday.

 

 

I expect to wait until March 24th for QQ to milk this out and then say they have done nothing wrong

I didn't hear anything so spoke to the FOS who just said they wold send Casheuronet UK a letter stating I had a complaint and they had 8 weeks to respond from my initial complaint. That was Tuesday. Later on that day I managed to speak to someone at the resolutions team at QQ and they said it wasn't a final response and they had 8 weeks. I told her that none of the responses from QQ had been anything but vague and how was anyone meant to know what they were doing. I then received 2 emails - 1 for QQ, 1 for P2P from the response team stating they had 8 weeks to investigate. I received a letter from the FOS letting me know that they had wrote to Casheuronet, this came yesterday.

 

 

I expect to wait until March 24th for QQ to milk this out and then say they have done nothing wrong

 

Okay well this is interesting.... I would suggest that you allow them to investigate and reject it / accept their fault. Lets see what they come back with.

Although I do have a good job and earn a decent wage, I did get into a bit of a hole through some gambling issues and then this constant payday cycle. I earn more than enough to not need these loans to survive, it just goes to show how much they can bring you down. Paying out £1700 to QQ, £1700 to Pounds till Payday and £300 to WDA each month is an impossible task. I have had late payment markers on my mortgage for a number of years (on and off) and a load of late payment markers for the last 8 year or so on credit cards etc. I've never defaulted or had any CCJ's, sometime I wish I'd just given up around 8 year ago and declared bankruptcy and I'd be ok now. However I've ensured I have paid or at least tried to pay everything back. Sometimes trying to do the right thing gets you in a bigger mess

Most definitely. But for now, wait to see what QQ come back with if they started the complaints process. When you get a response let us know what it says.
