      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

It was really good and I was shocked to see the unnecessary waste not just by households but by Supermarkets and Fast Food Chains.

 

Hugh Fearnley-Whittingstall has a blog where he encourages us to help force Supermarkets to reduce the waste.

He interviewed a Parsnip farmer and was astonished to see how many of these were rejected because they were "cosmetically challenged" . Apparently the Farmer had a contract with Morrisons and they set the standards for the parsnips.

 

The Farm was barely covering its costs - Morrisons refused to speak to the programme. They later ended their contract with the Farmer because they spoke out on TV.

 

Hugh took the "cosmetically challenged" parsnips and set up a stall outside a Morrison's Store - where he asked the opinion of Morrison Shoppers as to whether they would buy/use the parsnips - they all said they would.

 

He later went to an amazing recycling Centre where a few recycling sceptics were given a tour to see how stuff was recycled and then the end waste used to make bicycles, clothes, furniture.

 

Next week he is going to look at the amount of perfectly useable clothes that are being thrown away.

 

A very interesting programme.

didnt see it

but recently saw something about re a new company now taking some food (which is passed its sell/display by and so disposed of by the supers etc) and preparing it for sale (cheaply) in its cafe/restaurants. apparently it is popular and growing.

We are breaking the law in their eyes. But we want to fight the law and take the fight to the general public."

Mr Smith said the cafe regularly sources its food from some rather unorthordox sources.

 

"We regularly take food from supermarket bins if we have to," he said. "We watch them throw it away, then we go and take it back out again 10 minutes later. Over 90% of the goods are perfectly fine."

I do heartily agree with the sentiments expressed here, but in this ad sick blame culture world, its a matter of public liability. If you quietly go and rummage for some past sell by stuff then its all down to you - and good luck. If a 3rd party interposes and collects quantities of discarded goods and then retails them at cut price, who carries liability for anything going wrong, causing an incidence of food poisoning. You are probably fairly safe with fresh vegetables, processed food taken from a chiller? I daresay if there were a way of donating PSB food free from potentially liability to charitable organisations, supermarkets would jump at it, as they don't have to pay costs of disposal.

 

Its a PC world with litigators ready to pounce:mad2:

I watched Hugh's War on Waste and found it very interesting.

That interesting that i got in touch with the film company when a mistake was made on Twitter and got a reply.And it was changed.

I was quite pleased at the time I think you can still download the episodes though not sure.

Pleased that ASDA has decided to sell

Anybody else got any news on what this program has achieved in your areas.

Any major changes been made.Supermarket perhaps near you may have changed their habit of throwing good food away.

Things like that.

I would not usually mention supermarkets but Aldi and Lidl have astounded me with some of the bargains they have on food.

I would be worried if i was one of the big boys at the moment.

And change my ways rapidly.

I saw those boxes of imperfect vegetables - very good bargain for families living on tight budgets and no reason now for them to say that they cant afford to give their families fresh veg. I would like to see the same with fruit.

 

I still buy my fruit and veg from either the farmers market or shops. I found the supermarket stuff often was rotten before I got it home - especially those that were wrapped in plastic bags - potatoes and carrots for instance.

 

I think the likes of Aldi and Lidl were a wake up call for the larger chains such as Tesco and Asda.
