I wanted to write a conclusion to this thread as many seem to fall by the wayside and leave readers wondering what the hell happened.

 

So before i am bound by the terms of a Tomlin or consent order i am free to update as i see fit.

 

After a bit of letter tennis between myself and the solicitors for the defendant, an agreement has been reached, at least from a financial viewpoint.

 

I had included everything charged on the account during its term that wasnt capital or interest on the same.

 

 

I knew i wouldnt be able to successfully get it all so it gave me a huge cushion to negotiate with and that worked a treat,

3 or 4 offers in and way before it will see court, a settlement figure has been agreed which is the amount i originally wanted back in the first place.

 

So im hoping this will give others the impetous to go on and reclaim their right to their money back.

 

It was said they were a tough nut to crack, they arent at all if you set your stall out correctly at the outset.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

may I ask a question?

 

 

Did the figure you were claiming include interest charged on the fees or just the fees.

 

 

I had an offer from them to wipe just the fees,

which I rejected asking for the interest to be removed as well.

 

 

We're just at the end of the second stay,

with a date of 8th July to inform the court if settlement has been agreed.

 

 

Not heard anything from them for a while now.

As a general rule, if you have been charged fees and then interest upon thise fees, you should reclaim it.

Additional interest is slightly different as this relates to additional interest on the main balance if an instalment is missed for example.

very inspiring thread.

 

I would like peoples opinions on whether they think my claim below (simliar to martin's i think?) is worth pursuing please?

 

Do i have a chance with the following:

 

I have a mortgage with Leeds Building Society

 

Each time i miss a mortgage payment and they send an automated letter out chasing it i incur a £27.50 fee and have paid out (over 3-4 years) roughly £500 from this

 

Worth pursuing a refund? (or am i likely to get nothing back)
