      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello

I hope I can get advice.

 

I took out a secured loan in January 2002 for 8000.

 

I obtained the loan through dial4aloan.

 

The loan was arranged and the lender was endeavour.

 

It appears I also was sold ppi of 1200 added to the loan.

 

Well I am trying to reclaim the ppi.

 

However all organisations are blaming each other for selling it.

 

Dial 4 a loan state they only recommended ppi.

 

Yet the ppi policy is on endeavour paper.

 

Aviva say they have no responsibility either.

 

So what happens when no one will accept responsibility?

This is the email I received from the FOS today. What does it mean??

Hello Mrs xxxx

 

Based on the final response which Dial4aLoan issued to you, it does not dispute that it sold you the PPI policy. It instead argued that you had made your complaint too late to be considered and that our service would not be able to consider the complaint against it in any event due to the date of sale.

 

Our service it not able to consider all complaints about PPI policies, particularly those which occurred prior to 14 January 2005.

From that date businesses selling this type of insurance had to be covered by our service, but prior to then many were not.

 

 

I can confirm that Dial4aLoan was correct in its assertion that it is not covered by our service with respect to the sale of your policy.

 

 

This does not mean that it was not responsible for the sale, but rather that the rules under which our service operate do not allow for this complaint to be considered.

 

As we cannot consider a complaint against Dial4aLoan, we agreed to review whether HFC has any responsibility for the manner in which Dial4aLoan sold the policy.

This is very much a last resort and we will give you an answer as soon as we are able.

 

 

Please be aware that it may take some time before we are able to do so,

but we will keep you updated as to any changes regarding the case.

If HFC is not found to have any responsibility in relation to the sale,

we will not be able to consider the complaint further.

Hi,

 

I'm trying to get PPI payments back for an old Endeavour Personal Finance Loan, I've been told by HSBC (HFC) I used a broker called Central Capital Limited so I have sent my complaint to them.

 

The FOS are correct in saying they will not deal with claims prior to January 2005, these sales took place prior to the regulation of general insurance products (including PPI) by the Financial Conduct Authority (previously the FSA) and because of this their stance is that they will not investigate them.

 

Was the PPI missold to you.

Hi

Yes very miss sold.

Didn't even know I had it until last year.

I worked and still do for nhs and get paid for one year.

I also have genetic health issues.

So it would never have paid out anyway.

I can't even get travel insurance.

 

 

I am gathering my case together. If necessary will go to small claims court.

It was regulated so feel section 56 of CCA appropriate in my case.

Hi,

 

That's what I was going to suggest, I'm in the process of filing a Ordinary Cause claim in Scotland as the FOS told me there was nothing they can do regarding a loan I had in 2004.

This loan was also regulated by the CCA.

 

The company I'm claiming against are trying to tell me my claim will be thrown out because they state it is statute barred, I beg to differ :)

 

The limitation act states:

 

© the action is for relief from the consequences of a mistake;

the period of limitation shall not begin to run until the plaintiff has discovered the fraud, concealment or mistake (as the case may be) or could with reasonable diligence have discovered it.

You are correct.

I only found out about my ppi last year.

I have gathered a very good case together.

Found test cases to support my claim.

I am going after the broker.

I hope it goes well for you, I've also been having a good look around for cases that could help me.

I had another loan with the same company which they refused to pay out on as it was pre 2005 but after I sent my letter before action they suddenly said they were 'voluantary' regulated by the FOS and would agree to 'investigate' my claim.

Hi

I would like your help.

 

I had a secured loan with endeavour which was for 8k and ppi for 1240 added to the loan

 

. It was taken out March 2002 and settled in full on 30th May 2002.

 

The FOS cannot help due to the date.

However I came across old papers and discovered I still paid 1000 for my ppi with hardly any rebate.

 

I also found an old bank statements which show endeavour still took money for the loan months after the loan was settled

 

. Can I ask for pro rata rebate and get them payments back??

If payments were made via a DD after settlement

Then go get those back via the DD guarantee from your bank

 

As for the PPI

Have you the agreement still?

 

If you do. Then HFC should be coughing

I also have info from solicitor when the house was sold.

 

I am getting the run around from HSBC and HFC keep directing me to each other.

 

All a joke.

As dx has said, you need to know who the broker was, accounts owned by HFC Bank Limited (also traded as Beneficial Finance and Household Bank), Endeavour Personal Finance and Sterling Credit Limited have been transfered and now being serviced by HSBC Bank plc.

 

When I contacted HSBC regarding a Subject Access Request for a old Endeavour Personal Finance Loan they informed me who the broker was.

Any advice I give is honest and in good faith.:)

It was dial4aloan. Now part of the de function welcome group. I tried them. They say it's over 6 years so statute barred. So have no choice but to use the rebate calculation. As this was far from pro rata.

I think dx previously advised that Dial4ALoan (same broker as mine) were not regulated but in my case Welcome were the lender who were GISC and eventually FSA regulated around the time of my loan.

 

When I sent SAR to Welcome, I received a few brokerage and commission sheets in which I was not made aware of. My case is still being looked at by the ombudsman on this basis.

 

Did you send an SAR to endeavour / HSBC ?

Hi

I have already tried the ombudsman.

It was rejected as no connection between dial4aloan and hfc could be found. it was rejected.

I still have all paperwork and bank statements.

 

 

They even kept taking monthly payments even when account settled in full.

I am now going down the rebate route.

 

 

As the loan was only 3 months in duration.

Yet only got a tiny rebate.

The ombudsmam confirmed that dial4aloan were registered under the mortgage code.

They still could not help.

 

 

Sent my formal complaint letter in on 19th sept still heard nothing.

However they have 8 weeks

oh the consistency of the Financial Ombudsman :x

 

Norwich Union / Aviva were regulated as I had it confirmed.

 

My original adjudicator rejected mine completely ignoring evidence provided, so it was passed to the ombudsman in which I submitted substantial additional evidence regarding the relationship between Dial4ALoan / Welcome / Aviva.

 

I have recently received an up-date advising that the matter is still being investigated (nearly 2 years with FOS) and that the unfair relationship, non-disclosure of commissions aspect was being looked at.

 

Sorry did you send a SAR to Endeavour / HSBC and Dial4ALoan ? You may want to send one to the underwriters also as you may be surprised what might turn-up :wink:

 

Don't give-up as my complaint as been going for approx 3 years in total.

I bet the HFC agreement you have says nowt about dial4aloan

so p'haps you need to start a thread for that one
