Hi

had a parking fine notice from the 15 of july

have ignored it until now due to family issues

 

it is time to deal with this

.It happened in Morrisons and the facts are as follows

 

i am the keeper of the car

my wife was driving at the time

she went to Morrisons to get money from the cash machine

couldn't have been more than 5 mins

 

camera catches you going in the time was 12.10 pm.

 

Now my wife picks me up from work everyday and then at 15.00 i pickup my daughter from school.

 

On this day though i went back to Morrisons in the early evening and their camera clocked my car leaving the carpark at 18.28

 

the policy is for this carpark stay for 3 hours no return within 3 hours

 

the sign on entering the carpark is not in a great place as its on a junction at which you are looking right

and the signage is offset to your left in palm bushes.

 

They have photos of the car

can see one person on entering but only back of car when leaving.

 

They have sent 3 letters atm the last being that e have 14 days to pay £85 pound or else.

 

Sorry for the long winded paragraph and any advice would be great.

Await the notice to driver, admit nothing as keeper :) You have no obligation to respond as keeper, no obligation to tell them who was driving.

 

Notice to Driver must arrive within a set time scale

 

THEN

 

You put in an appeal (Use this thread to draft one) to get POPLA code

 

Then using this thread draft an appeal to POPLA to make the bad man go away :)

just reading the last letter from them that they are coming after me the registered keeper

also that 29 days have past and

 

i have got 14 days to pay up

which are up today

 

oh dear didn't realise it was today

 

looks like the next letter is from there solicitor or inhouse one prob.

Can you tell us where it says parking fine please on any of their letters?

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

ParkingEye have sent a NTK. That was the first letter received by the OP.

 

You have left it too late to appeal according to their rules but you must send an appeal now.

 

This is a case of double dipping proving that the anpr system is not fit for purpose.

OK this is all about ANPR catching you out by " double dipping",

ie claiming that the time between the first in and the last out is the time you were parked.

 

 

Read up un this with the parking prankster

and decide what you intend doing but

 

 

I would suggest that you tell them that it was 2 visits and that their claim is as flawed as their equipment.

 

 

Tell them that you have proof of vehicle being elsewhere plus a number of witnesses to verify this

and say that they either accept what you say is true and drop the matter

or take you to court and lose and pay your cost along with those of your multiple witnesses.

 

They know that there is this technical problem with ANPR

and that is why councils arent allowed to use it

but they will never admit it publicly as they will never get a penny otherwise.

Thanks for your help all samething happened to my sister in law at the same place also have been to court before civil cases and had help from this site then but that was a few years ago and lost my old login details to do with that.Will have a look at those sites but will have to be tomorrow now.

you have to be firm in your letter to them,

make it clear that they are rubbish at their job

and you look forward to your day out at their expense.

 

 

You will probably get a mealy mouthed

"we will let you off this time" cancellation rather than an admission their system is not fit for purpose

and not compliant with anything that will stand up in court.

you dont have to prove anything,

they have to prove their claim and if they are stupid enough to try and tell lies to a judge

then you can show them up and claim your costs.

 

 

Dont make it easy on them,

make then have to consider their options for themselves.

 

 

Dont forget, if they decide to reject your submission

they ahve to provide you with a POPLA code so you can appeal

and that costs them money and time and a lot of a tree.

 

 

There are many more arguments you can sink their claim with even if you were parked there for several days.
