    • Well tbh that’s good news and something she can find out for herself.  She has no intention if peace.  I’m going to ask the thread stays open a little longer.   It seems she had not learned that I am just not the one!!!!  plus I have received new medical info from my vet today.   To remain within agreement, I need to generally ask for advice re:  If new medical information for the pup became apparent now- post agreement signing, that added proof a second genetic disease (tested for in those initial tests in the first case but relayed incorrectly to me then ), does it give me grounds for asking a court to unseal the deed so I can pursue this new info….. if she persists in being a pain ? If generally speaking, a first case was a cardiac issue that can be argued as both genetic and congenital until a genetic test is done and then a second absolute genetic only disease was then discovered, is that deemed a new case or grounds for unsealing? Make sense ?   This disease is only ever genetic!!!!  Rather more damning and indisputable proof of genetic disease breeding with no screening yk prevent.   The vet report showing this was uploaded in the original N1 pack.  Somehow rekeyed as normal when I was called with the results.  A vet visit today shows they were not normal and every symptom he has had reported in all reports uploaded from day one are related to the disease.

    • I think you have the supremacy of contract as it allows you to park in designated areas. I would argue that there being parking enforcement there clearly means its to be used as parking and as such you can use it under your lease. Only need to worry if they ever follow through with a letter of claim and a claimform though

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

One for the news books, Im affected by this, you should reclaim ASAP!

 

 

More than 92,000 customers of payday loan firm, Cash Genie, are due a share of £10m in redress after the firm was found guilty of making a number of "serious failings", including charging unfair fees and rolling customers' loans over without consent.

 

It would appear they are also withdrawing from the UK market, although claims should still be supported by the FOS.

Im not apparently due a redress from them, because the FCA have told Motormile Finance that they have to pay out too!

Oh this is comedy gold!!!

I've sent an email enquiry now to see if I'm due a redress. Should be because I think I paid them through Carter Forbes

Well thats scripted... I suspect its an auto response but.... Ive emailed their Complaints Team and The MD Emma Steeley... Already had a response to it with a reference...

Lets see, I used logical answers to their compensation analogy...

 

Things like the £51 DD Returned charge, Thats unjustifiable as per their reasoning. Things like the continuing rollover and it reaching £1332. Lets see how this goes.

I had an interesting email direct from Emma Steely this morning asking me why I think I should deserve compensation... As I havent been identified that I was affected by there policies.

I have a quick question and this one involves MMF...History is MMF picked up 5 accounts for me, They were all written off as a goodwill gesture as they lost my letter stating 4 of them were fraudulent.

 

Emma asked me why I would be claiming compensation if the debt was written off by MMF and the points I stated were that they;

 

- Transferred the account to Carter Forbes

- Charged me £51 for a returned DD when they didnt take one.

- Didnt send me a statement every 12 months minimum.

 

I dont use this term ever but, Am I going to the well once too often? Or do I have a valid point ?,

I didnt pay anything to MMF until the situation was resolved... Which the account was written off...

Did you receive the charge for the returned DD (even though it wasn't taken)

I think Sainsbury's and one or two other banks are sending out £50.00 comp cheques for not having sent statements as per the regulations

Not sure I understand the Carter Forbes bit.. however if you were harassed, then I guess you are entitled to something !

The response I got was;

 

Our parent company announced on 6th October 2014 that the they were pulling out of the UK online market, which is Cash Genie, but that it was committed to the Voluntary Requirement that I had signed when I joined the business in July 2014. As such, we have the parental support required to carry out the redress programme as agreed with the FCA.

 

When we liquidate the business, your FOS rights will still stand.

 

I understand your point that annual statements were not issued and redress is being paid for all of these cases in the form of a cash refund or write down. However, your account never received any payments, no matter what fees were applied, so I am unable to refund anything to you.

 

I apologise for any distress or inconvenience that may have been caused to you, but reiterate that I am unable to refund cash that has never been received. It would be unfair of me to do so when there are many customers who did suffer detriment that we are working very hard to redress fairly.

MMF did...I went after Cash Genie to get the fees back ;)

 

I think ive been greedy? ... My view is this...

 

Account sold to MMF - No Payments made

MMF Write off account in 2014 as GWG after other 4 accounts they held was fraudulent.

No payments made to MMF. When sold Balance on Cash Genies Books should be zero.

Charges owed caused by Cash Genie, and FCA said they should be refunded... But Cash Genie say that as no payments received, there isnt anything to refund.

Well if the account has been written off, no monies ever paid into the account - then on this occasion I think I would agree with Cash Genie.. however much it hurts to do so.

 

I guess you could ask for some compensation for the hassle as the debt was never yours in the first place, was it ?

That Im not 100% sure as cash genie havent ever sent me anything to say its not.

Oh well Ill close it :/ However, Could you please put something like an announcement at the top of the forum to say if you have had a loan with Cash Genie that they need to reclaim quickly as very shortly, they will be liquidating the business..

People need to know CitB...

 

Although they will be contacting the affected, some people havent been included and they are still paying out on a case by case basis...

I see the cashgenie website already seems to have disappeared - given what we have seen with Minicredit not honouring FOS complaints after they went out of business, I'd agree with fkofilee that people should get in quickly

I emailed Cash Genie (Emma Stanley) and got a swift reply stating I was not entitled to redress as my loan was outside the period they were automatically redressing (pretty much expected) so I swiftly complained and they are looking at my complaint. I will follow this up as I don't agree with the FOS decision to take loans from x date to x date when clearly this was their normal modus operandii for a long time.

I agree SG - I think this has all the hallmarks of the way in which PPI claims were automatically rejected. So think it might be a good idea to persist and escalate the to ombudsman if you believe you have a claim and it is being rejected out of hand.

I spoke to Emma and she says it is because they "Voluntarily Agreed" to refund charges and write off debts due to their behaviour and treatment unfair to customers. They said as I had paid nothing towards the loan, I was not due any refunds etc

But as the balance had been wiped out as a GWG by MMF, The charges still stood in my opinion... Anyway... Get reclaiming! :)
