Can deductions be made to Back pay for childs DLA for my benefit overpayment

Hi all!

 

I hope someone can advise me here,

 

 

I'm due to go to appeal for my daughters DLA and it is likely we will win (again!).

 

 

My problem is i owe a large amount of money to the DWP and to the housing due to a massive over payment.

 

 

I strongly suspect the backdated carers allowance, DLA and housing benefit will be taken off my debt so i wont receive the back pay?

 

 

Am i correct?

 

The Housing underpaid us recently by over £500 and that got deducted from our debt.

 

I will get to keep the backdated tax credits i assume but i was looking forward to buying some specialist ( and very expensive!) equipment for my daughter to improve things :)

I doubt they can take it from a benefit not in your name

so the DLA should be safe?

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

The DLA aspect will be safe, if there is a payment they owe you they will probably take the overpayment from that.

 

 

Side note here Have you checked the web site for your local Council to see if they can offer any assistance by means of a grant for your daughter for adaptions and aids, Social services can also help with this with aids from their stock.

 

 

These can be free to the disabled person if the aids improve the quality of life for the disabled person. If your daughter has mobility issues you can even apply for funding for a powered wheel chair/scooter.

 

 

If your daughter gets the highest rate for care and mobility there are a number of schemes available for a care like you to apply for the funding. Including a blue badge bus pass and much more...

Thank you ever so much!

 

We won middle rate care previously and i will look into the local councils and social services, they did provide specialist toys when she was younger!

 

So hopefully the backdated DLA will be ok and i can use it for her :)

Call you local social services and ask them for help, depending what care your daughter needs they can offer advice and things to help you out. Also while you ask for your daughter you should also ask what help is available for you, please bear in mind there are something's that need a different point of view. like help with care respite for you and for you daughter.

 

 

Sometimes disabled people need a different face once in a while, no disrespect meant by this comment, it is widely noted that a change of carer even for a day a week makes a big difference. You can apply for a disabled railcard and reduced fees for many hobbies including swimming, the cinema and so much more.
