    • How was the "receiver" appointed and what is their role? Appointed by the lender under the terms of their security on the loan (sometimes referred to as "LPA Receiver")? Or are they acting for you in insolveny? What's the current role of the agent?
    • Wait for more replies, but that letter to me can be interpreted as a letter before action. Ignoring it can have consequences. The court to impose sanctions for failure in responding to a letter of claim.
    • I'm still pondering/ trying to find docs re the above issue. Moving on - same saga; different issue I'm trying to understand what I can do: The lender/ mortgagee-in-possession has a claim v me for alleged debt. But the debt has only been incurred due to them failing to sell property in >5y. I'm fighting them on this.   I've been trying to get an order for sale for 2y.  I got it legally added into my counterclaim - but that will only be dealt with at trial.  This is really frustrating. The otherside's lawyers made an application to adjourn trial for a few more months - allegedly wanting to try sort some kind of settlement with me and to use the stay to sell.  At the hearing I asked Judge to expedite the order for sale. I pointed out they need a court-imposed deadline or this adjournment is just another time wasting tactic (with interest still accruing) as they have no buyer.  But the judge said he could legally only deal with the order at trial. The otherside don't want to be forced to sell the property.. Disclosure has presented so many emails which prove they want to keep it. I raised some points with the judge including misconduct of the receiver. The judge suggested I may have a separate claim against the receiver?   On this point - earlier paid-for lawyers said my counterclaim should be directed at the lender for interference with the receiver and the lender should be held responsible for the receiver's actions/ inactions.   I don't clearly understand that, but their legal advice was something to do with the role a receiver has acting as an agent for a borrower which makes it hard for a borrower to make a claim against a receiver ???.  However the judge's comment has got me thinking.  He made it clear the current claim is lender v me - it's not receiver v me.  Yet it is the receiver who is appointed to sell the property. (The receiver is mentioned/ involved in my counterclaim only from the lender collusion/ interference perspective).  So would I be able to make a separate application for an order for sale against the receiver?  Disclosure shows receiver has constantly rejected offers. He gave a contract to one buyer 4y ago. But colluded with the lender's lawyer to withdraw the contract after 2w to instead give it to the ceo of the lender (his own ltd co) (using same lawyer).  Emails show it was their joint strategy for lender/ ceo to keep the property.  The receiver didn't put the ceo under any pressure to exchange quickly.  After 1 month they all colluded again to follow a very destructive path - to gut the property.  My account was apparently switched into a "different fund" to "enable them to do works" (probably something to do with the ceo as he switched his ltd co accountant to in-house).   Interestingly the receiver told lender not to incur significant works costs and to hold interest.  The costs were huge (added to my account) and interest was not held.   The receiver rejected a good offer put forward by me 1.5y ago.  And he rejected a high offer 1y ago - to the dismay of the agent.  Would reasons like this be good enough to make a separate application to the court against the receiver for an order for sale ??  Or due to the main proceedings and/or the weird relationship a borrower has with a receiver I cannot ?
    • so a new powerless B2B debt DCA set up less than a month ago with a 99% success rate... operating on a NWNF basis , but charging £30 to set up your use of them. that's gonna last 5mins.... = SPAMMERS AND SCAMMERS. a DCA is NOT a BAILIFF and have  ZERO legal powers on ANY debt - no matter WHAT its type. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

difference between me and them is i am not trying to get them banned, i believe in freedom of speech,i just want them to go and hassle someone else

Chris, let's make a few things clear.

 

Freedom of speech and expression is bi-directional so if you're unwilling to have other people respond to your posts then a blog might suit you better than an open forum.

 

The only person making any reference to social class thus far has been you. I have no interest in your or indeed anyone else's perceived position in society and as just another member here I'm sure that no one has enquired yet as to my own perception of status.

 

Although you might not find posts that do anything other than agree with your point of view of value, those other people finding themselves in a similar situation may, such is the purpose of an open forum.

 

CAB are but one option but if you're able to research the shortcomings of an organisation then doing your own research on matters that affect you personally might be the best option in future.

 

I'll not comment any further but to say good luck for the future.

sorry, i dont block peoples threads, that admin, i suggest you to speak to them. Please find something more constructive to do than continue this ridiculous debate. Maybe some of the other threads have members more congenial to your tastes

 

if i do not want to enter a discussion about who is paying taxes and who are the workers and who are the supposed scroungers in our society, then i have the right to say so. I can not force people to stop their bigotry behavior, but as long as I am still alive i will challenge it. you obviously have a problem with my stance

The problem with debate is that other people will have views that do not conform to what you want to hear.

If you wish to brush aside such views or tell them to go away then all you are doing is creating a thread with people who agree with you. Problem with a thread full of nodding dogs is that it does not improve your position unless you can argue constructivly against the points raised against you. Nor does it help any Poseter looking for advice if respondents blindly agree with no basis on which to do so, leading posters into worse situations.

 

You asked for opinions, you got them. Sorry if you do not like them. Clearly your attitude is not geared towards a public open forum.

 

I appreciate you have been through a hard time, matters made worse by your own inactions and that you feel you have a right to be angry. Maybe you should do a bit of soul searching and examine your own situation from an outside perspective.

 

As for you dismissing any idea of point raised against you telling them to get lost, that leads me to think that you are in fact trolling this forum. I suggest you tone down the attitude and enter constructive debate, or maybe find a different forum more suited to your needs.

I am at a loss as to what it is your either saying here or what response your after.

 

As I've looked at your link & from what I've seen & read on there;

 

You made a complaint to the Council & they investigated it.

 

In their reply letter of which there's only 1 page showing, which to my mind, is clear, concise & fully explained in detail, with regards to the Door lock complaint.

 

I also fail to see how this relates to Council staff & indeed the Ombudsman doing there jobs unsatisfactory.

 

Could you enlighten us more?

 

I've a feeling after reading your previous thread (on which I replied) that you are upset &/or angry with regard to your local Council.

 

I do hope you are able to sort out the issues your having & are able to move on them.

I am merely trying to highlight a few things and add to the knowledge base of the services/ conditions/ treatment of individuals with in our country today. If I can learn from other bloggers then thats all the better. I am way past being angry. All of what I am adding to this discussion is from personal experience. Thanks for reinstating my thread, be nice to see a more bottoms up approach to the governance of the forum

I think the main reason why your last thread was closed was because you were attacking people who provided their opinions which you did not agree with, the thread served its purpose, your question was answered and was just going round in circles.

 

I think a blog would be more suited for you rather than a forum.

 

As for other peoples opinions you have asked for? I see nothing wrong in your photo streams. I do not see what your complaint actually is about?

I can't see what the problem is if you turned down a home and then say you are homeless because of it.

 

From the video it's clear that the property wasn't ready to be lived in yet but with some TLC and elbow grease it's a roof. . I don't know about Scotland but council homes in England are being bought up to standard and you are given grants or the property renovated after the previous tenants have left. So what you see initially is not what you get.

 

My local council have spent weeks renovating a property just opposite me after the last family seemingly trashed it before they were evicted. It's the second family to have had that house and been evicted for anti-social behaviour and it's been refurbished completely previously after a fire gutted the roof.

 

Buy your own house and then see how easy it is to afford repairs! You think a chipped door is a problem or a lock? Repairs are handed out by councils for free for their subsidised tenants! IMHO you are lucky to be offered anything and if you're blogging about it then you have too much time on your hands. You have to help yourself and that means saving money to rent or buy. Quit complaining as I'm sure someone has snapped that up after you refused it.

 

It's always easier to move from a home or a job if you already have one.

For future and others reference I would like to point out a potential solution to the dilapidated home problem.

I have been given and then given back help, paint, material, carpet and all sorts of house accessories and furniture from kind people on freecycle - freegle.

You will be pleasantly surprised at how many people are ready to help when you post a "wanted" message on these local sites.

Just a few months ago a couple in their 60s and I fitted a kitchen, almost entirely donated by members for a 78 year old gentleman.

The council didn't want anything to do with it.

Next time ask the community, we're still available to help genuine people in need.

Yes, and gumtree has a section for freebies to.

 

Im fine though, i just rented a house on private sector and billed the council.

 

Stung themselves in the bottom, landed up costing them more in the end.

 

Point being most unemployed cant get anything on the prtivate sector,

 

i am one of the lucky ones who knew a x-landlord who knew i was a good tenant

I suspect he meant he claimed HB - but if he thinks it cost the Council more - then he is sadly mistaken
