      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Crashed 767 - You should definitely refer to an Ombudsman. In my experience some of the adjudicators don't seem to understand the meaning of irresponsible lending.

 

 

I received a final response from an Ombudsman yesterday regarding my complaint against Lending Stream and in it he stated

 

 

"lenders need to do sufficient checks to make sure they are lending responsibly. I cannot tell Lending Stream what specific checks it should have done but if they had done the checks it would have soon become clear what Miss C's situation was. Further even if it knew nothing about the other loans Miss C had it did know it had lent to her 13 times in a 2 year period. "

 

Out of interest how long did it take from an ajudicator passing it to the ombudsman to the ombudsman making a decision?

Out of interest how long did it take from an ajudicator passing it to the ombudsman to the ombudsman making a decision?

It was referred to an Ombudsman on 10th Sept and I rec'd the final response on 1st October. I am still yet to get any correspondence from Lending Stream about getting my refund though.

I also have a complaint with the Ombudsman against Poundstopocket. This was also passed to an Ombudsman on 10th September but this has yet to be assigned to an Ombudsman. Don't understand it, so inconsistent.

I am thinking of complaining to Wonga after lending more or less every month between July 2012 until August 2015 when I set up a repayment plan.

 

Is there a template email/ letter I can use? Or can anyone help me word it as I have no clue as to what I am doing :-)

A template won't get you very far, just complain explaining that the loans were unaffordable, that proper checks were not carried out and that therefore their lending was irresponsible. It has to be based on your own circumstances. Make it clear that if they do not offer a satisfactory response you will take it to the FOS.

 

FOS route takes months, I'm now on 6th month and and only just waiting for an ombudsman to make a decision so bare that in mind.

So for those that have been following my complaint I have had a decision from the ombudsman. The ombudsman has agreed with the ajudicator that only part of my complaint be upheld. Mainly that the last loan in relation to my income was unaffordable. That the rest (10) in relation to my income were affordable. Basically because I didn't inform them I wasn't in financial difficulties they were not to know. "I also note that Mr C made his payments on time and didn't tell Wonga he was in financial difficulties". From what I understand from the decision and what the ajudicator has told me at the time I took the loans it was general practice for payday loans to be based on income alone and therefore Wonga were not to know.

 

So, the same day the ombudsman contacted me the ajudicator called to say that she had made her decision on the other case she had which was about wageday advance. She said the same reasoning will be applied and that therefore all their lending was responsible. I have my own thoughts on the impartiality of the same ajudicator dealing with both but well thats how they roll. Anyway, luckily I did send WDA a bank statement showing I had loans with Wonga and they still lent to me so I'm going to go down that avenue with them. And I'll carry on this on the WDA forum going forward.

 

Still, I have won and with Wonga and to me that's the most important thing, and every complaint made about their lending practices is one step towards making them think twice about praying on those who are obviously stuck in debt, and that was always my point!

Hi, I have read this forum with interest. I too have placed a complaint of irresponsible lending to Wonga. Basically had revolving credit between 2011 to 2014. Was only paid off with a fixed rate loan ! I have argued that the pattern of lending in itself was evidence of the unaffordability of the loans and that it is their responsibility to do the responsible checks, and that they would have found out I had a DMP and other payday lending stream running as well if they had. At one point they emptied my account with small withdrawals until they could get as much as possible on a day when there was insufficient in to cover the loan. Also I argue there is a self admission that it was irresponsible as like others I did get a refund for one loans interest when the FSA announced their decision against Wonga in 2014. My wife too had Wonga revolving loans, we haven't put a complaint in for those yet, just seeing how they respond to mine first, but that is a check not done also to see if any other household member was already on their customer list.

My complaint was responded to with a reply of give us 8 weeks to investigate. I'm hoping my case does not need to go to the FOS and some sense prevails. Thankfully my DMP has finished and while not flush with 2 of 3 kids at University needing financial support, managing to cope without the likes of Wonga.

Update **Success** Wonga have replied with an offer I am happy to settle on. I could have gone to the FOS as there were a few more loans that could have been included but upon consideration I am happy that they responded and concluded within 5 weeks and I think I may be talking only about possibly 10-15% more. So good news IMO.

I got into a terrible mess with payday loans. I ended a relationship and entered a downward spiral of borrowing. I had been in a DMP after graduating and crefit was shot, a sign that maybe I needed to just learn to live on a budget, however they leant to me despite the fact I had defaults on my credit file.

 

I started with QuickQuid, needing extra cash to go out, then Wonga. I carried on rolling over and soon, I was left with nearly nothing to live on each month. Far from the image of a desperate, poor person, I am a failry well paid rofessional, just bad with money.

 

I realised it was getting out of hand, but was trapped. No mainstream lender would touch me and could only take these loans, so carried on. Soon I was borrowing then paying back £ 1200 a month.

 

I eventually got out, bailed by a donation from a family member and started to rebuild, but leaving a number of entries on my credit file. Once the adverse data from DMP was gone, I was left with nearly 20 entries on my file. I wanted to get mortgage, and it meant that I was immediately not considered by a great number of providers.

 

I first, chased Wonga and Quickquid, asking them to remove the entries . Wonga, refused. QuickQuid agreed to remove some. This was using standard letter from this site.

 

I then made a complaint via the ombudsman, who were brilliant. I made my first complaint against Wonga, based on miselling. They upheld my complaint, I received £3000, refining the interest I paid at 8%. This was in October 2014, followed by a case against QuickQuid, which again, I won and was awarded £2500.

 

The money was not important, but, I wanted the loans removed from my file. Wonga, again refused. I then read about miselling and writing off of current loans and removal of entries from the CRA's. I approached Experian to dispute entries as I felt I should have been part of the customers that were misold loans. Experian ten contacted Wonga, who, in turn asked me to contact them directly. They poke to Ombudsman, who showed they upheld my complaint of miselling. They have agreed, 2 years later, to rive all entries from my file WITH ALL CRA's.

 

QuickQuid have ten days to answer the dispute, and, I think they will not respond. This means the 5 entries that still show will be removed.

 

So message is, you can have loams removed , if you can prove miselling. ..

Hi am in the process of a complaint, wonda has had my complaint so sent into onbudsman service a week ago intotal 14 weeks from the start of the complaint just wondering what is the time scales and likley of getting some compensation of wonga i had roughly 13 loans ranging from 100-600

All depends on how long wonga takes to reply.

 

I had success in getting back nearly £2000.

But it all depends on the FOS adjudicator you get to. But safe to say Wonga were upto a lot of dodgy lending, comes down to your own personal circumstances.

Just a update i have been advised by wonga my response should be there tomorrow 14 weeks after original complaint ombudsman are now involved but wonga insisting outcome tomorrow

 

Whats the chances of success? surely if i wasn't going to win they would of told me by now?

Payday Loan companies complaint success I have had below

 

Wonga - Debt written off - I was happy with this

Payday UK - Debt written off and £296 pounds refunded

Lending stream - Debt written off

 

All successfully upheld, I had become so dependant on Payday loans and juggling them all, used this as the evidence for lending cash when clearly was unaffordable to pay back and in-ethical lending, obviously the complaints were upheld ( with no admission of guilt of course ) the main thing is I have my debt under control and no longer depend on these loan, if you can get away from them and finally get out the payday loan trap do so.

 

 

Ones I have in the pipeline

 

Quick Quid - AKA Cash Euronet - Proving a problem and now in the hands of the financial Ombudsman

Swift Sterling - In the process of the complaint at the moment for loans I could afford to pay back. - Not going to hold my breath on this one due to the company being Malta based.

 

I will keep you all posted but to say I have had success and fought hard to get this far, never give up the fight it can be done :)

Hi just wanted to add, I got some advise on here in 2013 for payday loans. I paid them off, then complained to wonga and QQ. Both refused my claims stating credit checks were done and there was no irresponsible lending. Wonga agreed with the adjudicator and refunding all 12 loans charges and interest £1254 and remove all loans from my credit file, and QQ (who have been more difficult have agreed to refund 9 of my loan charges and interest, and remove these from my credit file. (I'm still trying to total this one up to make sure it's correct. So just to say it's worth the battle, if they turn you down take it to the ombudsman, so glad I'm out of this mess.
