    • Hello, Following the submission of my defense, last night I received an email from DCBL indicating that the claimant intends to proceed with the claim (I've attached a screenshot of the email for reference) along with the N180 directions questionnaire. I'm unsure how they obtained my email, but I suspect it was through the courts' form when I completed the Acknowledgment of Service. This email almost slipped my attention. I have also today received a letter from court to state they have received my defense.  It appears they are requesting an online telephone hearing with the court.     • Default Amount £9237.88, all this started in 2006 Admitted debt £9075.65 Weightmans added £1515.01 immediately they became involved, no explanation The Statement shows when Marlin bought debt in May 2011 £10439.25 Their statements, not received until the SAR, are based on this. Cabot deducted £1515.01on their statements in January 2019, again did not find this out until SAR. Weightmans added in  2007 after the CH1 etc was confirmed by the court £741.50, made up of Process server fees, Court Fee (they tried for bankruptcy), Solicitors fee and Land Registry fee. Unspecfied Legal costs were added by Marlin in March 2015, again I did not know this until statements received with SAR I had been paying monthly, without exception until December 2018. I am minded to take the property charge, CH1 amount ,deduct all my payments and the subsequent fees, and request/demand a refund on the final payment made? I consistently disputed Weightmans balances, but they never responded. I also told Mortimer Clarke/Cabot that I disputed their amounts.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi there..

I am just about to start the process of claiming charges back from capital one credit card...

I took the card out about 6 yrs ago...i was on benefits and cap one knew this.They advised me to take out ppi, so i did.

Well i am now over my limit on my card due to charges as a few months ago i got into financial difficulty and even though i contacted cap one about this, they continued to charge me, which has resulted in me now being over my limit.

I remembered the ppi, so contacted cap one thinking this should help me a lot. Cap one told me they dont deal with the ppi and gave me a number to phone.

I phoned this number and was told i could not claim a penny as i am not in full time employment....and as i wasn't in full time employment when i first got the credit card, i should not have been sold the ppi!

There was nothing the ppi could do and i was told to contact cap one again, which i did and was THEN told it basically had sod all to do with cap one!

PPi is still getting taken each month along with the charges, so i am getting more and more into debt!

Unfortunatley i do not have any proof of cap one mis-selling me the ppi.

The ppi totals up to about £360 SO FAR...money i have had taken from me, when there was NEVER any chance of me being able to claim anything!

Im going to try to cancel the ppi(I can never seem to get through to the right person to cancel)!

Is it possible for me to get any of this money back?and if so on what grounds?

My husband is now in full time employment, im not sure whether it would be worth me trying to claim on the ppi again(although his name is not on the card...it is soley mine)

Im really annoyed about this!:x

So using the OFT report of October 2006 (OFT869) and page 14 section 3.5

"Common minimum requirements for PPI are that a consumer must be living and working in the UK, be agedat least 18 and under 65 years, and be actively employed for at least 16 hours per week and have been so for a specified period of time"

 

Think you have case here, so sendLBA away listing charges for PPI and take it to small claims court.

I wrote to MBNA, because I took oy card two months before Iretired. cannot recollect taking out PPI, because that was always against my income conditions, in that I was in tenured position until 65, so would always have income. As I said two months later I had to retire due to ill health and have been oaying PPI since. Todays post brings in letter, giving me cbback mty PPI for the last year plus interest at 22.9% and they have ordered the previous years records from archive, and they will refund those PPI contributions also.

 

So persevere and best of luck

 

MBNA do sem to be taking this more kindly thatn other companies like Capital

Received statements back with p.p.i payments...will trawl through them and then get my pre-lim letter sorted.....Can anyone tell me where i should send the pre-lim letter? I don't think the p.p.i are directly linked to capital one are they?

Hi willow My ppi claim is thru allience and leciester and i know there ppi is sperate too.

I sent my prelim letter to the address they gave with my statements and it soon found its way to the right person!

 

Dont know if anyone else can help tho???

Hi Willow,

.. Do you pay for your PPI monthly ? If so I would use the same spreadsheet as for bank charges and work out the interest on each payment that you have made. Remember to use the same interest rate as they charge you.

 

If like the one I got ripped off with , was a single payment PPI, I would claim the full amount plus interest from the date the policy was taken out.

It is a monthly ppi, but i didn't realise they charged me interest, so am not sure how to work out the interest!!!

I'll have to have a look at my statements again, and if i have no luck then phone the credit card company?....

I would try and claim Interest of 8% APR on each payment, this is the rate that would be acceptable if your claim went to court. Basically that is an acceptable level of Interest to the court for loss of use of the Money that was taken as PPI Payments.

If you know all the dates that the PPI premium was taken you could add 8% Interest to each charge based on 8%APR the same as you do with the bank charges.

 

Maybe someone else will comment further on that , The only PPI I have claimed back have been single Payment Policies..so easier to calculate.

Yeah I would go for 8% APR on each payment taken, You can use the spreadsheet from the bank charges to work out the actual interest on each payment. After all they Mis Sold you the product and have denied you the use of the money taken in way of premium. Much the same as the banks deny you access to the money they take in way of charges.

 

I would include the Interest in Prelim and LBA. The if you go to court stage add Juditial Interest of 8% APR per day, from the date of your claim to date of settlement or Judgement.

Hi, sorry to gate crash you but did you manage to get an address from Capital One to send your letters for PPI. We are claiming PPI but the letters keep geting passed around. we also telephoned, it is just hopeless.

 

Would you mind letting us have the address it you have it

I am not happy now!

I received a letter today from Mr Udy...basically he has paid the ppi back that i requested, but the money went straight back to my credit card account and has therefore got eaten up as i am over limit (due to charges!) I also didn't get the chance to add the interest!

Im just about to send my pre-lim letter to capital one for the charges back, but i wasn't really expecting to have the ppi put back there!

Is there anything i can do?
