      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

My husband took out a Bright House agreement for a Wii U for our son for his birthday.

 

My question is if the Wii U which cost £472.68 in total (apr and good) for 52 weeks

 

The initial payment was £14.28 then 50 weeks @ £9.09 then the last week at £5.19

 

My working out is that we have paid in total £473.97 which is £1.29 more than the agreement was for.

 

We went into the store to query this and was told that the £5.19 was the P.I.F. (Payment In Full). But how can this be if the final amount should have been £3.90. Are we missing something obvious. (There was no DLC or OCS taken on this product).

 

Would welcome any suggestions as to what to do.

 

Also have noticed that this is not the first time this has happened but this is the most straightforward and less complicated as the rest have OCS and DLC and new credit agreements to take off the DLC and OCS, after we realised that we didn't need to have them (Thanks again to this group).

You are correct..

 

50 x £ 9.09 = £454.50 + initial payment of £14.28 = £468.78

 

Total cost = £472.68 - £468.78 leaves you with £3.90 to pay as the final payment.

 

I would ask them what the difference is for - if they do that to a lot of customers, that adds up to quite a few £'s at the end of the year !

I did ask the store manager of our local store and just got told it was the P.I.F figure (had to ask what P.I.F was) and said that would have been how it worked out for our account depending on the amount of days left and interest etc. Still can't seem to make it compute.

As a side note - should we just settle for the money back or +interest as they have had some it for over a year.... just wondering like and would it be normal interest / compound ? just trying to get it all straight before we go?

And at Jason - tbh the email address you are lucky if you get a response from - my husband did email them about a month ago and still waiting for a response - and the phone line they just told him that the regional manager would get back him - which he did saying go in store and sort it - and yesterday store couldn't help so told us to speak with the regional manager today - but still waiting for a call from the store to say that he is there - but like all things bright house doubt we will ever get that call

In this case, I kindly request that the account holder contacts our Customer Relations Team directly on 0800 526 069 so that we can confirm the account details and ensure that the Regional Manager contacts the account holder in order to discuss their concerns and put in place measures to resolve this.

I really don't see why you are unable to answer the question on the forum, Jason - it is a simple question. The last payment doesn't stack up !! It might only be £1.29 but if your stores are doing this to every customer, it is like the £ store saying they wont give you 1p change if the item you purchase is 99p and you give them a £1.00 ??

Hubby phoned as you suggested, told would be phoned by the regional manager as escalated to a complaint now. Will see if we ever hear back.

 

In the meantime - can someone point me in the direction of what what we need to do to reclaim past OSC, DLC and Late Payment Fees, and also claiming back the overpayments that BH have taken. Am sick and tired of the run around that we keep getting from them so time to make it legal me think

Do you have all your statements with the OSC, DLC and Late payment fees identified ? If you do, then you can go straight into completing one of the spread sheets in the link below. I am not sure which one, so will ask someone to look in and confirm.

Once you have entered all your figures onto the spread sheet, you simply send a copy, along with a covering letter requesting these monies be refunded, to their Head office.

 

If you don't have the statements, then you are going to have to send a Subject Access Request to BH - it will cost you £10.00 and there is a draft request in the link below.

Aye we have all the old statements containing all the information regarding the OSC / DLC / Late Fees, they kindly provided us with this awhile ago for free ;) so once someone lets me know which spreadsheet to use I will get started.

Had a look at all the spreadsheets and a few q's popped up?

 

1. Do I use a different one for each agreement?

2. Can I put DLC, OCS, Late payment fee's and overpayment figure all in the same spreadsheet?

3. If not which ones do I put in which ones?

4. I assume I use the contract apr of 29.9% for all?

5. Do I use the end date as today or the last day we paid osc / late fees etc

 

Just the ones I thought of to start with to save time later on :)

Hi

 

The sheet to use is the CI Sheet (the compound interest calculator).

 

If it were me I would do a separate sheet for each agreement.

 

Again, if it were me I would do separate sheets for each item you want to claim back. That way you have easily accessible information for each item.

 

You use the rate that they are charging you so if the agreement is 29.9% then use that.

 

The end date is today...it should be filled in automatically each time you open the spreadsheet.

Ok so we are talking £1.29 over nearly a year.

 

Rather than try and talk to them in person I would write and get their response in writing too. Ask them exactly what the PIF is and where does it state anything about this in the T&Cs of the agreement.

Aye but when you think that was just one of our contract we had another 9 with varying amounts totalling : £ 16.58 in overpayments and that is just one customer - think how many others they do it
