Hi all,

 

 

I was wondering if someone could offer up some help or advice.

 

 

We recently received outline planning permission for a plot at the end of our garden. During the process the local council sent up a tree specialist to have a look around. He confirmed that he saw no problem with the trees on site as they were either very common trees or in a poor condition due to being so close together.

 

 

The sale for the plot has been progressing however yesterday we received a letter from the local council saying that they had place a six month TPO order on three trees (and a forth not even within our property) and we have 28 days to appeal this before they confirm the outcome - within the next six months.

 

 

From the outlined plans, only one of tree is causing particular problems in terms of building. My question is, are the council allowed to give you outline planning permission whilst knowing the location of the trees on the plot and confirming these are not a problem (also evidenced via the planning process) and then 8 weeks later place a TPO on them knowing that if this is confirmed and the TPO is upheld that it makes the site impossible to build on?

 

 

Interestingly, our neighbour a year back build a house close to our boundary and is well within the circumference that the council have advised we can not build in.

 

 

Any information on where we stand with this would be great as we want to get all the facts before we appeal. Its an ironic situation because we have been very specific about trying to retain the woodland feel of the surrounding area and really trying to avoid damaging any tree unnecessary.
