      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I used to be a Job Centre advisor back in the late 90's. We were told to treat the people that came across our desk with respect and dignity because life had obviously become tough for them in that current moment, and to seek to do all we could to aid them in getting back to work.

 

Fast forward 16 years and I now find myself on the other side of the desk and claiming JSA. AND MY GOD HOW IT HAS CHANGED! The whole system has become a Spanish Inquisition, with us set up to fail. My advisor no longer even looks me in the eyes but taps at a computer screen looking at charts and numbers trying to find a way to catch me out or send me on some course/gulag to check a box. It is frightening and worrying, because I consider myself to be reasonably well-educated and intelligent, I know how to jump through the JCP hoops, yet still can't find a job and am made to feel like a genuine criminal for accessing the benefits that are rightfully mine.

 

With this new Community Service punishment mandating that's coming on stream, things will only get worse. SO my question is - when will we all rise up and say like Peter Finch in 'Network' - "I'm as mad as hell and I'm not going to take this anymore". ?

 

This situation cannot stand... Come on people. Stop getting as*-f*cked and rise up.

The problem is too many people are scared or simply do not have the knowledge to be able to stand up to authority. When I was younger I used to let people walk over me but that soon changed and I learnt to stand my ground when I was passionate about something or I knew I was in the right. From the moment I was made redundant in February 2013 I knew what the system was like and knew, with the help of people who had been through it and my Father as well I had to be prepared for the shambles that is the JCP (and now INGEUS) This is why to this day, 15 months on I have not had one bit of hassle from them as I am always armed with guidelines and always surpass my JSag terms and conditions.

 

Whilst I disagree with violence, in some countries there have been uprisings against policies, it may not change anything but they show passion and committment against rules and policies aimed at hurting the weak and most needy - the last time I remember this happening in the UK was the poll tax riots.

 

Surely the time will come when people just snap and fight back? Maybe not, Brits tend to be tolerant in the main and used to being treated like dirt, until you kick their cat or dog that is.

 

I said a few years back I don't think it will be long until there is a civil uprising in the UK - I thought it mayhave happened by now but I honestly thing the time will come when enough people snap and the proverbial can of worms is opened.

All I can say in response is - I hope so. When being poor becomes a crime something has gone wrong with society.

 

Respect to you EssexMat for standing your ground, but I worry you and me are people who have enough life-experience to be able to do that. What about the people who can't? Who is now looking out for them under this new judgemental and intolerant regime? What is a society, however rich, without compassion for the weakest?

There lays the problem, years of work experience, dealing with rules and regulations, standing up to authority, HR, management etc has taught me to stand my ground. I can take being beaten if I am in the wrong but the measures in place now are simply disgusting and the out of work are being terated like animals. It is the weak that suffer. Through no fault of their own they may be disabled, uneducated etc and the only way they can show their feelings is via aggression - I prefer to show it via calm proof and basically putting people 'back in their box'. Unfortunately under a conservative regime the weak and poor are a drain on resources - they only care for high earners and the rich

Hmmm, not sure I totally agree with you on that specific point, but even the 'great unwashed' deserve compassion and have feelings like someone as intelligent as you. Surely this mass of Eloi should rise up and refuse to accept this new draconian bullsh*t of signing everyday or doing mandatory 'voluntary' work? We really need to make a stand and say NO MORE! , like with the Poll Tax to make a change. I promise you I'll stand alongside anyone else who's on JSA (or ESA) and man the barricades sticking a flower down their gun barrels.

I wasn't being dismissive of the 'great unwashed' as you call them, of course everyone deserves help and compassion. People do need to make a stand but of course the usual outcome is a few do it and others hide and 'play ball'

Sorry, I was being glib. I've read your threads though and you seem like an intelligent person who is always trying to prove he's too good to sign on. But you haven't got a job, neither have I, so here's the news - we are in the same boat as anyone who's on JSA. Who cares what our past glories were - in this moment we are signing on and are living at the bottom of society's barrel. That's my point though - it is now unacceptable to even try hard to find a job and prove it each week at the JCP. It's like they are being paid to catch us out and show we aren't, we are just lazy criminals trying to abuse the good tax-avoiding millionaires who already feel a bit annoyed they have to share our stink on the central London streets. They'd rather we all just went away and left them free to slap hands with the Russian Oligarchs.

Oh I agree, we are no different, waht we earnt and done in the past has long gone, we are unemployed, we are trash and of course we are wasters and scroungers. What does annoy me though, and I have said it on other threads is: Someone that has not worked, aged 25, never paid in to the system = £72.40pw JSA - me (and you I guess) 18+ years of working, NI and tax contributions (I am 39 years old) .... drum roll please ..... £72.40pw - brilliant!

I was treated the same - 30+ years of work experience and they tried to get me on a CV writing course - I pointed out if they had actually READ my CV they would see that I have experience, can write a CV according to the job spec and then they tried to muck me about how to write down the jobs I applied for!

 

Eventually I re-wrote my CV including an old skill and have been using that skill for the last year - this current temp job has been going on since January and should last until the end of July, when I hope to pull some pension money early and go self employed.

 

The system would be fine if jobs were plentiful but they are not - and as for the 'voluntary work experience' when you have that already what is the point - oh, it might stop people 'earning a bit on the side', but of course the government don't do this, do they - with their 'consultancy' jobs and 'non-exec director' posts as well as inflated MP expenses and salary.

Got the memo but my secretary didn't action it. My bad. ;) Come on my friends - this current situation is untenable. I'll do what it takes to make it stop, I just lack the genius to know how to make it change. But change it must. Who else is with me? This signing every day or criminal community service option just to get our tax-paid JSA is disgusting.

 

Don't mean to sound glib, but remember that old poem about the Nazis (and I'm paraphrasing here so apologise) 'When they came for the Jews, I didn't make a sound, when they came for the gays I didn't make a sound, when they came for the immigrants I didn't make a sound... when they came for me there was no one left to make a sound.'

Although I have not had to go through the misery of being unemployed under the current regime, I have seen what it does to people and am utterly appalled and disgusted. Our welfare system, which was one of the great things about this country, is being torn apart, and I get the feeling that the politicians (I won't bring party politics into this as I'm not sure (m)any of them want to stop the rot) won't be happy until they can get back to the workhouse system!! I have found how extremely difficult it is to get people to rally together and take positive action, but if something can be done to help, then count me in.
