Hi guys,

 

A friend of ours has an issue with a neighbour. The fence between the 2 properties is in such bad repair, that their dog and get into the next door's garden, which the neighbour moans about. The fence is the neighbour's responsibility to repair, but hasn't. My friend has even offered to go 50/50 in getting the fence repaired, to stop the doggy getting through, but the neighbour still doesn't seem interested in fixing the fence.

 

My question is, does the neighbour have the duty in stopping the dog getting through or is it my friend's responsibility to stop their dog from going through the broken fence

If it's their boundary then yes. Is he private owner, renting etc? That would decide who your friend needs to go to next, seeing as being reasonable doesn't seem to be working. Your local council should have a department that deals in mediation and sorting out neighbourly issues.

 

Its unreasonable to not let the dog out into the back yard to do its business, but it is unreasonable to moan about the dog getting it yet won't do anything about the fence. Your friend should have no issues getting this taken further.,

As far as I know its a dog owners responsibility for their own dog.......their responsibility to keep it in their garden, not the neighbours to keep it out of theirs. Especially when its the dog owners fence causing the issue. Agreeing with porkyp1g, the landlord is where to take this now.
