      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Anyone heard of these?

 

Are they another in house collections unit of minicredit/opus limited?

 

I've had an outstanding balance of 1,336.20 in which they claim they are owed from a loan that started at 220.00 in which 19.50 of that 220.00 I never even saw...

 

I rang them and they said they will not even knock a single penny of this balance off at all... Saying it's in the T+C's etc...

 

They only offered a chance to pay back in installments and with that sum of money they are asking for they can have a pound a month from me!

 

Anyone know what to do in beating the crap out of these cowboys?

Sounds like someone acting for minicredit and trying to collect their unlawful charges.

 

You need to stop ringing them. They will say and do anything over the phone to threaten and intimidate you into paying what they think you owe. Not what you actually owe.

Their website looks a little suspect too. No mention of any credit or company licence number. Infact, the Oft has no record of any credit licenced company at that postcode either. They look like a normal DCA that collects for multiple companies, but there are a hell of a lot of complaints online about them.

So, Just as I thought, Another rogue trader... No idea what to do next... It was obvious from the outset that something fishy was going on since they are not prepared to lower the amount owed and claim further charges could be added on.

They cannot add on any charges whatsoever. The OC can try to do it, but they wouldnt be able to justify it so they would be unlawful and unenforceable. Sadly, minicredit are well known for this. The good thing though is minicredit could be facing losing their licence very soon.

So staying silent might still be my best option for now over a loan that was taken out in June 2012... It has been with Opos for about 18 months before being moved onto Oriel.

Yes, I knew that OPOS was part of minicredit, But I didn't know who were Oriel, And also why they are also still claiming the 1300+ amount that is unlawfully owed. This is why I have come on here so I can try and deal with this as best as I possibly can in the right way.

Opos prob just sent the original debt to them. As far as the new dca is concerned, thats the number that was sent, so thats the number you have to pay. Good news is, if they dont own the debt, then they cannot do a single thing to you apart from writing a few laughable threats in a letter.

I'm not prepared to pay back 1300+ though for a 220 loan... Maybe if they say 400 and I'd pay it just to get rid of them once and for all.

 

I tried once with minicredit/opos to lower the balance quite sometime ago but they wouldn't drop below 650 or about half the balance they say I owe.

It was a same day transfer saying that a 19.50 admin fee would be deducted from the original loan.

It's either that or its a "transmission fee or drawdown fee" I cannot find anything on their website about it.

Well you can make one to the oft that will get added with other complaints. Fos wobt get involved until you get a final response from minicredit or 8 weeks elapse since you started the complaint; whichever comes first.

Where can I obtain information on the breakdown of my debt, I may have to wait until they decide to take me to court, I'm prepared to fight the debt that way.

You ask the creditor for the breakdown. They cannot say no, although they will try and give you an incomplete statement. I think your best bet to find out exactly what has been going on is to send a SAR. It costs £10 but they are legally required to fulfil it. If they don't, then you can take them to court for disclosure and comp.

Oriel Collections have been instructed by Opos Ltd in respect of Mini Credit to recover the above outstanding debt.

 

Our Client has advised that this balance has been outstanding for some time. Oriel would like to discuss this matter with you and help resolve the situation. You may already have been contacted about this and we now need to resolve the situation with any further delay.

 

It may be possible for Oriel to reduce the balance owed and we would very much like to discuss this with you, but please not this is only possible if you contact our agents with delay.

Ignore. Keep pushing minimuppets/Opos.

 

if you want to tell this silly DCA anything, tell them the debt is still in dispute. Dont give them anymore info than that.

Update...

 

This thing is in a complete stalemate. Decided to take your advice of ignore and it appears to be the best way to beat these if you don't give a damn about getting future credit.

 

This was passed back to Opos then to Kapama and then back to Opos. Recieved assignment email back in January and now just recieved an email from Opos asking for immediate payment which I am going to continue to ignore... This is nearly 18 months since it went to Oriel collections. I don't see this getting resolved at a reasonable amount for quite some time.

Phone calls... Ignored

Even a letter recently which is the same as one of the emails... Ignored

 

This has been on going for over 3 years now with still no sensible resolution to payback a reasonable amount to the £220 short term loan and this is now the only payday loan I have outstanding. Just a little frustrating this isn't going anywhere anytime soon. How I wish the FCA ruling of never pay back 2x doesn't apply to pre-2015 pay day loans I would of been happy to pay £440 to just get this over with.

I am in the same position with minicredit

stalemate for the last 3 years

£3200 for a £500 loan

 

It's things like this is what is potentially stopping me from securing a 0% balance transfer deal with Barclaycard, They do 18 months at 0% for 'average' credit history and yet of course I get declined when in fact it would help me in a great deal to pay off existing debt on my Vanquis & Aqua accounts. This is the only thing that is holding me back now.

 

Default registered for 2015, When in fact it's in 2012.

 

All other payday loans were paid off between 2012-2013, with the exception of Wonga who wrote the entire balance off.

why not complaint about irresponsible lending?

 

 

if they don't help

goto the FOS about it.

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
