      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all

 

Returning to these forums which helped me greatly before as several years on, something has cropped up again

 

I received 3 letters recently which I have now connected and pieced together

 

First off was a letter dated 13 Feb 2014 from Shoosmiths solicitors

requesting info on myself asking if I lived at this address naming their client Arrow Global Geurnsey Ltd,

 

they said it was a matter regarding something from an old address,

the old address they quoted was somewhere I moved out in early 2008

(it was re-possessed at the peak of my troubles)

 

I dismissed this as fishing and they didn't say what the matter was concerning anyway

 

Then on 27th February I received a letter from Arrow themselves

saying account has been transferred to Shoosmiths and that I should deal with them

 

It quoted an alleged debt figure and said it was from a Royal Bank Of Scotland card,

date of original agreement Dec 2006

 

Now I had a Royal Bank Of Scotland card from about 1997-2000,

no way did I take one out in 2006

and by 2006 it had been many years since I last had it

 

I wondered if it may be a Nat West card,

I did have one of these, but again it would have been taken out way before 2006

 

Then today I received another letter from Shoosmiths

saying they are chasing up this alleged debt for Arrow

and that Arrow obtained a judgement against me in April 2012

 

Now I never received this, and if it was sent to my old address from 2008 its not surprising,

and no mention of a judgement was used in the first 2 letters

 

I have checked Experian (not Equifax yet) and there is no judgement on there, in fact my credit record is now fair

 

Are they trying it on?,

even if they do have a judgement it would be unenforceable,

the agreement dates are certainly wrong etc etc

 

Any idea what my first steps should be?

just did that,

nothing registered at all at the old address they were quoting,

wont be anything at this one as I didn't move here until September last year,

so seems they are trying it on maybe?,

 

would the court themselves tell me just to clear my mind?,

if its not on trust nor on cra file

 

as long as with the CRa file - your name are correct and your old address shows

then there no CCJ.

Thanks again, did check my current address too just to be safe and nothing there either, and no links to previous addresses

 

It amazes me that debt agencies/solicitors can get away with these things still

Make sure to report them as they are trying to spoof you. Dont jusy say you will, make sure you do.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Hi again

 

 

Didn't see the last post until I logged in today, think I will have to report them now

 

 

Received another letter today, this time they are now claiming they have a charging order on my property

 

 

Only problem is that I haven't owned a house since 2007, and the alleged date of judgement is 2012 (of which there is no record of course), so more lies

 

 

It seems each letter they are escalating to make it sound worse, first one no mention of a judgement, second one claiming a judgement, third one charging order

 

 

As I said previously I never even had a RBS card since about 1999/2000 (which was paid off), and haven't signed up to any credit card agreement since about 2004 (they reckon this was an agreement in 2006)

 

 

All in all complete fabrication, what should my next step be?

 

 

I am loathe to get in touch directly with these people as past experience years back has taught me that they are not interested in reason and getting in touch will just confirm I am here, and they will hassle me even more

 

 

Any advice would be appreciated, thank you

Ask them to prove the charging order as you havent owned a property for almost a decade. make sure you are getting those complaints going as well.

can you scan up these letters please?

 

**you can post up images/letters by this method immediately..you don't need 10 posts**

set your default scan page size to A4 less than 300DPI [150 will do]

scan the required letters/agreements/sheets - as a picture[jpg] file

don't forget you can use a mobile phone or a digital camera too!!

ENSURE: remove all pers info inc. barcodes etc

but leave all monetary figures and dates.
