Hi, Can someone help me out there to get to the bottom of my problem. When we first moved into the bugalow we had a small dyke adjacent to our property. Over the years it has slowly be giving way, so instead of us being able to stand and cut the conifers it is now just straight down. We have been in touch with the people who dredge the dyke 2 or 3 times a year and they have said if we pay £4000 and an annual maintenance fee they will do the neccasary work to fill the dyke and stop it slipping away. I asked if the land would then become ours and they said no it belongs to them. I have tried taking it to the ombudsman but because North Level drainage are not FSA registered he cannot help us. So I am asking anyone out there if they could give any information or even take the case on for me.

This is just a suggestion but I'd be tempted to contact the environment agency. I believe the owner would be responsible for maintaining the dyke, but I'm sure the EA could provide you with info on this and who is responsible for enforcement.

 

If it borders your property I wonder if you may have vicarious liability to maintain your side.

As the property isn't showing as yours on your deeds and the owner admits it is his, then write and ask him to bring it back as it was at his expense or you will get someone to do it and pass him the bill.
