Before going down court route, Issue them with an LBA.

The online system is mainly for England. You would probably be better getting yourself down to the sheriff court to file a claim (when and if you reach that stage). Take some time to read through some of the longer threads in the BOS/RBOS forum. That way there shouldnt be many surprises and you will get your money back fairly easily (even if it does take a couple of months)

hope this helps.

1/9/06 RBS claim #1

8/11/06 - claim settled

17/11 claim #2 started - incl creditcard

30/11 - CC statements received

31/11 - Prelims issued - RBS paying up, only M/C to go)

Persevere and don't despair. I've spent the last few hours reading up on the same problem with the same bank. The link that did most to clarify the procedure for me was Unfair UK Bank Charges | legal help from Govan Law Centre, Glasgow, UK . Follow their links and they'll show you exactly what letters to write. You might find letters a drag but for me it's better than losing my cool in a verbal argument.

It seems to me to be important to realise that victory will require a bit of patience and determination to stick to the gameplan.

Hope it works for you. Good luck!:-)
