      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Forum!

 

Here you got another victim and I signed the agreement on the 12/04/2010 but after 6 months i closed the business down because couldn't find the buyer but paid £500 plus VAT to phoenix business agent like everyone else and was promised if they fail to sell the business then they will refund the agreed fee, their response was almost zero and within 6 months only one person visited the business for couple of minutes and never returned and i am sure it was someone their own sheep.

 

I closed the business after 6 months and then in couple of months i changed my address as well but i never thought that these crooks will chess me up but soon they start searching me and i wasn't aware that these crooks are searching me and I have recently come to known that they used a company called 1ST DIRECT UK LTD to find out about my current address.

 

1ST DIRECT UK LTD is the company who charge around £36 to trace the people making unauthorized searches on people's credit reports and I understood this easily because I regularly check my credit report to keep my identity safe and secure. so this is a new development on this particular topic.

 

lets come to the point and let me tell you that after three years they sent me an invoice of £4800 to pay because i closed my business without letting them know and paragraph 10 of the terms and conditions apply on me according to the agreement.

 

I also have noticed from the copy of agreement they sent me ''THE ADDITIONS OF TWO AMOUNTS'' which clearly shows that the amount of asking price of the business in paragraph 1 and the amount of agency fee in paragraph 2 is recently added which is in different ink with different hand writing but bottom side of the page is photocopied where my signature and dates are.

 

when I sign the agreement I was told that I will get the copy of this agreement by post and now I know why because both places in paragraph 1&2 were left empty by the agent because he knew I would never have signed the agreement if the agency fee was shown in the contract, in fact I never received the copy in the post until last week and this is the trick which he played very nicely and of course I made great mistake as well who failed to read everything word by word before signing the agreement and it was of course due to agent's intervention to divert my attention who never wanted me to read the agreement properly.

 

The contract is same which is uploaded by ''vanity nails'' in page 2 of this thread so I don't need to upload it again. I am preparing for response and of course will use the all points which are raised in this entire conversation by other honorable members of this forum and lets see where it goes but I will very much appreciate if some one can post concluded case here briefly to use as a reference.

 

I have noticed ''vanity nails'' has settled and have received letter from phoenix stating that they have canceled the invoice as a goodwill gesture and after that post that member completely disappeared which is not fair because we are asking for help in the forum from every one and used their experience to solve our problems and when our problem is solved, then you can't just say thank you for the members and thank you phoenix for canceling the invoice and we are closing the topic. very disappointed and unhelpful.

 

I request this member ''vanity nails'' to please come forward and upload the communication letters without her details so others can use the same argument as a reference. Kind Regards
