Hi,

The Office of Fair Trading lost its legal battle over bank charges with eight High Street institutions in the Supreme Court in 2010.

The Supreme Court went against earlier findings by the High Court and Court of Appeal and decided the OFT did not have the right to assess the charges for fairness.

However, there are still a handful of ways you can still try and reclaim bank charges - especially if you can prove you are in financial hardship.

The fos says approximately half of those in financial hardship that complain get at least some of their debts written off, but this does not just relate to bank charges: a person could have some of the interest on their debts frozen, some of it written off, their debt restructured at a lower interest rate or have some charges cancelled.

Regarding the process, and what you can try to reclaim would be charges and related costs for going beyond your overdraft limit, or bounced cheque's and direct debits. Traditionally these were about £35 per transaction, but can now range from around £5 up to £35.

Any advice I give is honest and in good faith.:)
