    • Dear Sir/Madam, TFL case number: **** I would like to thank TFL for providing me the opportunity to explain my behaviour. I realised the stupidity of what I have done and wish to seek a resolution to this matter. I have no valid excuse for this action and I am extremely sorry and deeply regret my action. I hope you will accept my sincere apologies. Nothing can justify my action. I am aware that TFL are only able to operate if everyone pays their fare correctly and I feel so guilty about attempting to breach public trust. This has caused me sleepness nights and raised my anxieties. I have history of anxiety. This has been a hard lesson learnt. I have never been in trouble with the law in the past and I ensure that I won’t be in the future. I am and will be using my oyster card (PAYG). I would like to humbly appeal to TFL to allow me to settle this matter out of court and avoid going to prosecution given the adverse consequences it can have on me and my family. I am very concerned that prosecution for the first time and I would like to make restitution for my action. Having a criminal offense on my record will have detrimental consequences on me. I have always been a law abiding person and have no previous offences. I would really appreciate if I can be given the opportunity to pay for any unpaid fares plus any charges and/or administrative cost which have been incurred by TFL due to this incident. I am sincerely remorseful and ashamed of myself, and I fully appreciate the severity and stupidity of my transgressions. Again, I would like to offer my sincerest apologies. Yours Faithfully, My Name

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I received a summons from these what ever you want to call them .

Saying on so and so date no TV licence was in force from XX date to XX date.

Also there was a statement by a officer which i had signed.

 

However the statement stated that i had a certain tv and i had also a certain sattelite system etc.

However the signature was mine but somehow the statement did not make sense.

 

I went to court with a no guilty plea.

 

At the hearing a trial date was set.

 

I then told the magistrates i would like the officer who interviewed me to be present at the trial so that i can ask him some questions.

to this the prosecutor jumped and asked why.

 

None of your business i said. Just some simple questions.

What simple questions he asked ?

 

Any way the magistrates agreed and i also asked for £200 in costs for the trial if i were to prove my innocence.

 

Now some 3 weeks later i have received a letter from the above saying the summons is being withdrawn.

 

I dont have a problem with this but i would urge anybody who goes to court because of these numpties to ask for the interviewing officer to be present at the trial hearing.

 

To be on the safe side prepare some questions and be prepared.

 

In the worst case there will be a hearing and the interviewing person present.

However more than likely they will pull the summons before the trial date.

 

I will scan up a copy of the letter from them.

 

Just havent got a scanner at the moment.

Never ever answer questions, don`t sign anything, ask them politely to leave & if they don`t , call the police. These people have no powers, none, absolutely toothless. They rely on you to hang yourself, tell them nothing, the only thing to give them is the sound of the door being slammed shut.

 

There is a private members bill being presented to try & give the TVL / Capita salesmen a lot more power. Here is a PDF of the bill.

Scan the required letters/agreements/sheets

as a picture file

remove all personal info including barcodes etc. using paint

but leave all figures and dates.

Go to one of the many free online pdf converter websites

convert the image to pdf format.

hit the add files button on the top right

hit select files, navigate to your file on your pc

Not sure if I am reading it correctly, but does the bill indicate that you can be prosecuted just for owning a TV even if the TV is only used to watch videos and cannot receive live transmissions?

 

It is proposing that any device capable of receiving live broadcasts should comes under a fixed penalty scheme. More men in yellow jackets issuing fixed penalty charges if you don`t confirm your status.If your property shows it is not licenced or you refuse to give out your identity or your live TV receiving status, or refuse to communicate with BBC/TVL/Capita, then the bill wants to give the power to issue charges/ fines on the spot, regardless of any proof . You will have no right to privacy or non communication, it will assume you are guilty if you don`t comply. The chances of the bill being passed are very slim indeed but it will be a door wedge to further bills of this nature. The BBC desperately need a tax on the internet , it is being left behind in its ability to compete with Sky,Virgin, & now BT. It needs to ring fence the tax for its very survival, seriously bad times ahead for the Beeb, output is poor at best, it can not compete financially for TV rights to major sporting events & it has spread its self far to thin in trying to be all things to all people, add to that the crazy pay off's & wages to the old boys network, failed IT systems [ 100 million lost] then you can see it does not look good . The next blow will be when a case is brought against them in the courts over ex & current employees involved in sex crimes.

It would be interesting to see how many genuinely don't need a license versus those who do but don't pay and should be prosecuted. If that bill does get passed then at least it will stop people who do need a license using their 'rights' to hide behind and get them to pay like the rest of us. I know it will impinge on the privacy of those who don't need a license, but I feel that it's a case of the minority ruining it for the majority of genuine none payers.

One issue overlooked is if you are working and suddenly end up on benefits, is the TV licence a priority debt?

 

Not for me, I have decided I have other things my money is needed for so no more live TV, so long rubbish mass entertainment

Just read thag on the link and its absolutly disgusting! In a nut shell just by having a tv you can be proscuted, they would have powers to remove your tv and effectivly hold it hostage until you pay the BBC the fee, and is opening a door to let the bBc set the fine rate if you caught.

Basically letting then charge what they like and your also guilty and charged if you refuse to probide your name

This bill is obsurd! How desparate are these idiots, why cant they just make it subscription based and leave people alone rather then forcing people to pay for a serice they genuinely may not want!! Arrhh rage!! Sorry lol but its rediculous. !

Take a deep breath:wink:. This bill will not be passed, as i outlined before, it is a door wedge , an opening shot, they are testing the waters to see if there is an appetite for this kind of approach. It dosen`t have the legal legs or the backing of the lords, contrary to stupid statements , you can`t hide behind a legal right. They [ BBC] have come under serious fire after yesterdays meeting before the board of governors, trying to explain the grotesque & obscene pay off's, some 25 million paid to managers who we`re no longer needed or sacked, on every payment the BBC voluntarily increased the final pay off figure, the old boys network is still alive within the walls of the BBC. I was listening to Nick Ferrari [LBC presenter] this morning who had a guest on who worked for the Beeb at a very high level for 20 yrs, he said it should be split up & considerably downsized,also it is now time for it too find its own funding via subscription & / or advertising.

A staggering fact came to light. The BBC employs twice as many people as the Royal navy, it has more managers than the entire football leagues put together. The recent move to new premises has been an abject failure, they have already out grown the space , they are now renting back the buildings they once owned because they have out grown a building they designed & had a hand in all the specifications , you simply could not make this up, no one would believe you. Now i ask you , why do people pay them money ?. Go legally licence free & if you really can`t do without your soap / reality / chefs dancing on ice...... watch them on catch up. Stop funding this madness.

It would never get around the Human Rights Acts.

 

I may even send it to my MEP in Brussels to let them know just how the BBC and this useless self serving government plan to run their 'dictatorship'

 

We haven't had much from Europe but the ECHR is a mighty sword to wield for the average person in the street.

No! You only need a license to use a tv for the reception of 'live' transmissions. Not for storage, or to sit there as an ornament or to use only watch pre-recorded dvd/tapes or as a computer monitor. The latter only if you are again, not receiving live broadcasts via the internet.

There is a huge move to tv internet streaming and catch up tv via boxes so the BBC and licensing people will lose a fortune if everyone knows they dont need a licence if they only use these facilities. That is why the beeb and their acolytes want this new law, they want to continue to waste your billions on retirement funds for failed managers and people you wouldnt leave your children with. Buffering make an internet broadcast outside the live bit as it is not a transmission cos the data is collected and resent in packets.

I don't think you are quite right there. If you are watching Wednesdays episode of Coronation St on a pc at the same time that it is being broadcast even if you are a few minutes behind, then you are watching a live broadcast.

 

Buffering isn't the same as recording.

Before long, a tv license will be required for the use of a washing machine simply because it resembles a tv, and yes the prove in court will be the alleged tv in question contains all the soaps. lol..
