      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Today I received another letter from Iqor regarding a sainsburys visa card I do not and have never held.

 

Supposedly issued by Bank of Scotland,

 

contact was made with the bank in writing complaining about wrong info given to Iqor.

 

Bank admitted they had made a mistake and Iqor were told of the error and would not contact me again.

 

Bank also paid compensation for the error.

 

Seems Iqor are totally stupid,

 

can't read or understand instructions from clients as they are still contacting me.

 

Very stern letter now en-route to Iqor and copy to Trading standards and FOS.

 

Any further advice I can follow, Your comments would be appreciated.

IMHO, it is very likely IQor that you should now be leaning towards.

 

Make sure that your credit records are not being affected ?

Requested from AA a true copy of agreement under sec 77/78 CCA1974.

 

 

They generously replied with a set of terms and conditions and a photo copy of an application form signed back in the early 1990s

 

 

stating these coply with the 1974 act and subsequent legal decisions.

 

 

Your thoughts and comments would be much appreciated.

Recently received letter and assignment notice from 1st credit regarding an AA CC BOUGHT FROM BOS. Replied that BOS 4 years ago could not produce CC agreement relating to the account. Are they (1st credit ) stuffed.

 

No. They can still chase you for the debt and update your credit record to include their details against the debt. They can even try to enforce in court, but if the CCA was issued before April 2007, they would need the original. But of course you would defend any such action and make them produce it to avoid a default judgement.

We could do with some help from you.

Account is from 1994,

been through 5 DCA's and one group of solicitors

all of whom have backed off when confronted with letter from BOS stating no copy of original agreement and would therefore no pursue claim.

 

 

All BOS can produce is a recon agreement ( of whatever date ) and a set of T&C's again date of ?

 

 

Account has also been in the past mistaken for a Sainsburys CC by BOS and one DCA which cost them £100 in compensation.

Just send them a copy of the BOS letter and suggest that they don't pursue this any further or you will start a complaint with regulators.

Before I have had chance to send them a copy of letter BOS letter stating no agreement,

 

 

1st have today sent me a letter offering 30% discount if I pay NOW.

 

 

Seems they may have worked things out for themselves I think.

Good evening to all,

 

Today received a letter and application form and set of terms and conditions from 1st credit regarding an alleged debt on a credit card

 

the last payment or acknowledgement being Jan 2010.

 

Been through several DCA's before this outfit who claim they now have all rights ect., since June 2015.

 

Have written back to them stating no acknowledgment of the debt which I believe now becomes SB in Jan next year.

 

These people are incredible as all previous DCA's have backed away when advised that the OC admitted that they do not have

and cannot produce a copy of the alleged original agreement.

 

Hope I am right about the SB bit.

1st credit are well known for stating they have a correct copy, but upon inspection lacks in multiple areas.

 

When did you take the credit card out?

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Then they DEFINITLEY wont have the original. Especially since no other DCA or even the original creditor could get it. And they will need the original to do any legal action on it.

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
