    • Yes, await the Directions Questionnaire from the court. No, the Directions Questionnaire is just a short form and leads to the case being transferred from MCOL/CCBC to your local court.  If you Google "Form N180" you can see a blank copy on government web pages.
    • There will only be one hearing (typo possibly 25th is a Saturday Courts closed ) clarify with the court.
    • Upload a redacted copy of their statement (+ Exhibits) please.
    • No Andy, I'll scan, redact and upload later today. So the court sent me 2 letters, same envelope and stapled together but with different dates!. 1. N24 General Form of Judgement or Order, stating: UPON considering the papers herein IT IS ORDERED THAT The claim is listed for an attended hearing 25 May....... at which court will consider allocation..  etc   2. N24 Notice of PTR/Adjnd/Restored/Hrg/Management conference TAKE NOTICE that the hearing will take place on 24 May at....... When you should attend 30 minutes has been allowed for the Hearing   No other instructions anywhere in the envelope or on the letters. Do I attend both?
    • Then leave it just proceed with the claim( strike out/SJ application are risky).....the defendant will not be permitted to rely on written evidence (documented) only verbally as they failed to comply with the N157 (unless they have filed with the court and failed to serve you a copy) ?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi everyone!:smile: im currently in the process of claiming my bank charges back from yorkshire bank, ive had my statements and sent the first letter and got the reply that basicly im getting nothing back and to take it up with ombudsman, i wanting some advice as to what i need to do next, they owe me £870 plus interest (not sure how i work that out):confused: , my heads a shed reading through this site and i would appreciate some advice thank you.

I thought I'd gatecrash you back ;) haha

Good luck with the claim and they are right about reading all the FAQ's and afew threads. It'll help keep your head straight when YB try using stalling tatics or loads of jargon that really doesn't mean much.

The general pattern of starting your claim sort of goes...

 

1. You send LPA - they write back saying no chance. This is all fair etc etc.

 

2. 14 days later You send LBA - they write back still saying no.

Sometime after that they will write a letter saying if you go to court you will incur charges and they have expert wittnesses blah blah blah but they offer half of the amount you have claimed.

 

3. You send a rejection letter stating you will accept cheque as part payment but are still proceeding with claim. They will withdraw the offer of half requested money.

 

4. 14 days from your LBA You start MCOL. Which is the online MoneyClaim court thingy.

 

5. Then it can go afew different ways but that is a month off for you yet so I won't bore you with my waffle any longer!

 

I'm up to step 5 at the mo so any questions up to that bit I'm happy to try and help :)

Assuming that you are in England send all letters to your local branch, as Head Office is in Scotland. If you write to Scotland you will have to use the Scottish court system where small claims are limited to £750 instead of £5,000 in England.

:( I sent my LBA yesterday with my breakdown of the charges but ive checked my account today and realised theres another £70 of charges on it!:mad: if it goes to court can i ad these on? im expecting a reply from the bank soon as they replied within 2 days of the last letter.

Add each charge individually.

And make sure you get the date right for each charge as this affects your 8% interest when you get to the MCOL stage.

Yorkshire Bank:

LPA sent 21/08/06

LBA sent 05/09/06

Received and rejected offer to settle (half £amount) 18/09/06

MCOL started 21/09/06

Bank acknowledged claim 27/09/06

Defence received 21/10/06

Ok guys theyve thrown a spanner in the works! :?: ive got e reply to my LBA it says theyve reopened my complaint and a further review is being taken they apoagise for the delay but every effort is being taken to bring my complaint to a satisfactory conlusion, but the problem is its come from CR MANAGER in scotland but i started my letters in my local branch in west yorkshire, do i reply to him or my local branch? and what do i say? i know if i get involved with the scotland branch it will limit my claim.:eek:

This is fine, quite the standard letter that has been passed to head office from your branch. Keep all communication to your branch. Also remember you set the timescales not the bank. So they gave you 28 days but you gave them 14. So at the end of your 14 days file for your MCOL. Or if you chose to do you could wait the 28 days and see what communication they have which will probably be half of your claim back as full and final settlement which we can cross if it happens.

:rolleyes: OK guys its 2 days till their 14 days are up! im gunna work out the 8% intersest and any new charges, any advice for the money claim? does it cost £80 up front? do i need to tell the bank im claiming or does the court tell them?
