    • Well tbh that’s good news and something she can find out for herself.  She has no intention of peace.  I’m going to ask the thread stays open a little longer.   It seems she had not learned that I am just not the one!!!!  plus I have received new medical info from my vet today.   To remain within agreement, I need to generally ask for advice re:  If new medical information for the pup became apparent now - post agreement signing, that added proof a second genetic disease (tested for in those initial tests in the first case but relayed incorrectly to me then ), does it give me grounds for asking a court to unseal the deed so I can pursue this new info….. if she persists in being a pain ? If generally speaking, a first case was a cardiac issue that can be argued as both genetic and congenital until a genetic test is done and then a second absolute genetic only disease was then discovered, is that deemed a new case or grounds for unsealing? Make sense ?   This disease is only ever genetic!!!!   Rather more damning and indisputable proof of genetic disease breeding with no screening yk prevent.   The vet report showing this was uploaded in the original N1 pack.   Somehow rekeyed as normal when I was called with the results.   A vet visit today shows they were not normal and every symptom he has had reported in all reports uploaded from day one are related to the disease.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

In pay my tv licence every fortnight by payment card. The last 5 payments have been returned, which I then send back with a letter saying I will not be cashing. The letters state

 

" the attached cheque is a refund of the payment due to you as you are no longer paying for your tv licence by tv licence payment card. If you have not already done so please destroy your card"

 

Surely they are obligated to accept a means of payment do able for me not them?

 

It's obvious their setting me up so it looks like I'm not paying and will attempt court action.

 

They've also turned up a few times. Ive told them in writing and verbally I revoke permission for them to come to my property, which they have ignored.

 

What can i do here?

Yes phone them up, you apparently have enough time on your hands to send a letter so why not phone up in an attempt to get the problem solved?

It may be something simple such as your payment card has expired and you need a new one, or just an admin error.

 

It seems to me you are setting yourself up for attempted court action as you are using (presumably) a service you are not paying for, though I can appreciate you are trying to.

TV licence are a law unto them-self. After being made redundant i requested a payment card myself, THEY set the amount and payment dates. The whole idea of a payment card is that you make payments when you are able to in advance. Simple equation is that you work out the minimum to pay each month and divide by 4. As long as you do not get into arrears, you will be fine

 

TV licence or capita want direct debit and monthly payments in advance, Do not be bullied by these people, as long as you make regular weekly payments by payment card and keep the receipts to cover whats expected over a month, then they can go and swivel.

 

To be convicted of a criminal offence, you have to have a guilty mind. In Hacked=Off case, he has no guilty mind as payments are being sent to Capita, and Capita are returning for what ever reason

 

Just phone up TV Licence and request another payment card saying that is how all future payments will be made

my mum pays in full every year with her payment card last week she got a cheque back from them for the full amount 3 weeks after she paid it she called them up and they said her card has expired ( dont ask me why) that's why they sent her the money back so she just paid over the phone with her debit card

 

so it seems its happening to others too

exactly, i don't always follow what they TELL me to pay because its not always doable, i do however always have the payments up to date each month.

 

Also the mens rea principle does not always apply, in some situations there need not be intent. however, in this situation your are correct.

 

The card is up to date, in fact they just sent me a new one, but are still retuning payments.

I've had tv licence muppets come calling when i've been in the garden. I just look at them walk to the gate and close it. Dont hear from them for a while after that.

Yeah I have the same merry go round. I pay, they refund, I return cheques, they send a new card. Every year without fail.

 

Once they told me I had to pay two years in advance!!!

Previously I cancelled my DD and then attempted to buy the licence outright. This could not be done as I had 2 months credit due to paying my DD. I had to wait until the credit expired before I could purchase the licence so in effect it was several days or more after the licence had expired before I could buy one. Also if on DD and you decide you don't want a DD any more and want to pay the balance for that year they will do allow you to do this! It has to expired first and then a new licence has to be issued. Plain lunacy!

I doubt people pay it because it's the law - do people never speed, for example? - rather it's because they don't understand it isn't actually mandatory under some circumstances. It's lack of understanding, nothing to do with, er, the French Revolution...

It's unlawful. Not illegal. Completely different.

Technically it isnt mandatory at all. There are plenty of ways around not paying to subsidise a corrupt and outdated corporation.

another refund in the post today grrrrr

 

I would not even bother returning the cheque. I would just save them up as evidence that TV licensing were sending back payments what you had already authorised. You could however cash them on the understanding that they were sending you free money..

You can phone the Police and have them arrested for trespass if they've ignored your Withdrawal of Access Request.

 

BBC TV Licensing™ are money interested in collecting money for the BBC.

 

I never will understand why people pay it.

 

I've never paid it. The sooner those who want the BBC fund it themselves via voluntary subscription the better.

 

Because if you watch live tv, its the law. Some people think they are above this though, cake and eat it kind of people...

 

Some people think they can accuse (libel) people of breaking the law when they isn't the case

 

I see the Beeboids are still banging the drum, Digital Spy has become their bitch but it won`t happen here:whoo:
