      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all

I have now recieved a response ot my CCA request to MINT and I'm not sure if what they have sent is enforceable?

 

This card was taken out in 1999 and defaulted in Sept 2010 when my financial problems started.

I have been paying £38 per month for some time until this Jan when I reviewed my finances and stopped paying all credit card debts.

Please can someone take a look at the info below that they sent me and in addition to that there was a very badly copied version of their terms and conditions and also another sheet where someone has written on it "reverse of appllication form ...." this is Page 4 of attached.

Now I'm no expert but this doesn't look like a valid CCA to me but if one of you experts can advise I would really appreciate it.

think you would have difficulty claiming unen with this as they have got the original. However the good news -you ticked the ppi box on this one, must be loads of reclaiming to do! Also I know from very recent experience that by sending one letter plus spreadsheet Mint will refund all your overlimit and late payment charges including of course the £12 ones plus interest., so if youve got all the statements do the spreadsheet and start reclaiming -it will make a big difference!

IMO you would have difficulty convincing a judge that no liability subsists here.

 

Payments made useage of the creditit facility support this.

I only have statement going back to Jan 2010 on this but the account started in 2000 so do I need to send a SAR request to get ALL the account transactions? Also if so does anyone have a link to the template letter to request one.

I also note that you say I ticked the PPI box and so need to reclaim but if I ticked the box then surely I can't reclaim something I asked for?

I understand about charges etc and can do from Jan 2010 but where do I find the spreadsheet. I'm just hoping if I can reclaim at least something it will help bring this one down for me.

Yes SAR request [letter in Library] with postal order for £10 to Data Protection Officer, RBS Credit Card Centre, PO BOX 6050, Southend-on-Sea, SS99 1WL. Make sure you send recorded. Have a read of no2 in DXs Signature for numerous reasons for PPI missale. Link for spreadsheets in PPI forum stickies but get all your statements first

Looking at the attached documents it appears the page containing the statement of credit limit was provided with the card and so could not have formed part of the application/agreement the OP signed.

 

It is my understanding that a statement of the credit limit is a prescribed term and must be found within the 4 corners of any agreement in order for that agreement to be enforceable.

 

I’m always willing to be corrected be those more knowledgeable but I just thought this was worth raising.

I've just got a letter from mint asking me to ring their office urgently to discuss the account but I really don't know how to approach this one. Everyone has said that the agreement is enforceable and I owe just over 7k. The only other point is that all of the balance is balance transfers as we were juggling one card to another at the time and only 129 of it is spending. Can anyone advise what approach to take ....I sent them an I and e breakdown showing no spare ,money and have been paying them 38 per month since 2010 up until this Jan. They stopped interest back in 2010 please can anyone help as I need to ring them x

Well what a nice surprise ... was cared to death about ringing them due to some horrible phone calls in the past with CC but the lady was lovely and said that they were willing to accept one pound token payment a month until Jan next year...whew bit of breathing space......not sure how this one is ever going to end though as the card defaulted 27/9/2010so does that mean as long as I keep making payments the six years on my credit file will never end or did the six year start back in 2010......

will drop off credit file sept 2016 but debt will still exist which is why it is so important to do all available reclaims to reduce as much as possible

what is the relevance of paying the £1 token payment tho .....that worry's me as I said to them that it is never going to end at £1 per month but the lady just said that it will prevent any further action being taken or the debt being passed on.......when it comes off my file in 2016 I know I will still owe the money but will it still show as a balance owing on it?

no your worrying far too much, when it drops off your file nothing will show in the meantime just enjoy the peace and quiet:-)-gives you space to plan all your reclaims!

Default will be removed from credit files on the 6th anniversary of the default paid or not, court action at this point

is highly unlikely to happen and even less likely to succeed.

arrangement in place to pay £1pm so thats keeping the dca's off my back but I have also sent off a full PPI claim to them on 04/06/2013 so allowing them the 8 weeks but not heard anything yet. I was working for Lancashire County Council at the time so missold the PPI.

Will let you know if anything happens.
