Another MMF Empty Threat?

Hi All

 

After receiving an MMF 'Notification of legal action' threato'gram a few weeks ago (the one where they mention going to prison), that I have duly ignored.

 

I have now received a 1 line email yesterday, entitled '5 day Notice before action' which states:

 

Unless you call MMF in 5 days,a Court Claim will be issued and then enforced by Bailiffs or Attachment of Earnings on your employer.0800 9961103 Ref:M******

 

Do you think they are still puffing out their chests or should I now start to worry?

If they took you to Court, you would have the chance to submit a defence disputing either parts of the debt or in whole, which would either end with MMF backing out, mediation or a hearing in Court where the Court would then decide if, when and how it needs to be paid, failure to follow that payment plan would then allow MMF to apply for enforcement, read bailiffs.

 

Alternatively you would also have the possibility to accept liability for the debt, if you would do that and say you pay it in one go you would still have 28 days to pay without MMF being able to apply for enforcement.

 

Or you could accept liability and submit a payment plan, if you then stuck to that they also couldn't apply to have bailiffs sent your way.

 

Point being, Bailiffs are much further off than MMF implies.

I think the operative word here is IF, I know MMF have a reputation of threatening all sorts of things, but wondered if anyone else had had the same email regarding action and then found that they actually followed through.

 

There are a lot of posts on the boards that say ignore them and they will go away!

These fools wouldnt even know what forms to fill in to take you to court.

 

All empty threats and ones that are against OFT Guidelines by stating they will take action they legally cannot.

 

I would urge anyone who receives these kind of threats to report them to the OFT, if they receive enough they will impose huge fines or even better strip them of their licence.

Do you know this from experience?

 

I have had calls, texts, emails, voice mails from these people every day for the last 8 months, including all the special offer reduction emails etc.

 

You say

why can they not legally take action? I do actually owe the money on the accounts they are chasing me for (yes multiple!) but I am currently unemployed on JSA so am not in any position to make a payment arrangement, in which turn has meant I have just ignored them.

Nobody who chases you for 8 months has any intention of taking action against you.

 

If an original creditor was serious enough they would do it in a month or 2 if they really wanted to.

 

It was referring to their little line of we will take court action, get a warrant then have your goods removed. That is not how the legal process works! They would have to be granted a CCJ, then a payment arrangement made to pay it and only if you missed payments could they 'apply' for a warrant of execution. Even then you can suspend it.

 

They make out bailiffs will be round at your door straight away. They will NOT!

 

Report them to the OFT. If everyone who received these mails, texts and calls did then worms like this would be buggered!

They CANNOT do an immediate attachment of earnings here in the UK, they would need to go to court, you fail to keep up the repayment the court decided (should you loose) and then apply for an attachment. That is a threat which the OFT needs to know about.

Had another letter from these Jokers yesterday regarding one of my accounts. quite laughable really.

 

Entitled 'NOTICE OF VISIT WITHOUT AN APPOINTMENT

 

You have failed to provide an agreed appointment date for a home visit.

As such your account has been placed on our HOME VISIT SCHEDULE and an agent will visit you at home until they meet with you.

(hope he/she likes police officers, as I will call them as soon as they knock on the door as I have NOT made any appointment as they have so kindly pointed out in writing, so will be trespassing :) )

My point exactlyIf only everyone complained to the OFT these ompanies would not be doing it.The OFT acts on mass, 10 complaints wouldnt even bother more than likely, 500 coomplaints they would say right something going on here lets have a look!The only way you can punish is them is to add to their total number of complaints, do it and you have done your part!

The OFT acts on mass, 10 complaints wouldnt even bother more than likely, 500 complaints they would say right something going on here lets have a look! The only way you can punish is them is to add to their total number of complaints, do it and you have done your part!

OK Guys I get the message!

 

I will report them and help the cause. Is it something I can do on-line or do I need to call them/write to them (OFT) ?

complain to both oft and fos, also trading standards.

 

advantage with fos is they can take action in individual cases.

the others usually just pile up the complaints and then take action once they have a certain number of complaints, that action can be much more severe though like for example mco a pdl that got fined more than half a million pounds.

Just for your information, the OFT DO NOT deal with individual complaints for consumers, you'll need to go via the FOS. On occasion they may ask for evidence of bad practice if they are investigating a particular industry (this was recently undertaken for payday loans). Hope this helps.

No they do not issue individual replies, but each complaint counts, when they have enough which if everyone who got these letters complained they would then they will act

 

If you want an answer then your right in saying its the FOS
