Ok guys

alot of negatives comments could come out of this but im looking for the supportive comments

I took out a contract back in December 2011 phone was a Samsung Galaxy S2 now what really miffs me off with these companies is they only offer a 12 month warranty with all phones and they give you a 24 month contract

Now i had the S2 for 9 months brilliant phone i loved it only until one day i woke up and the phone wouldn't turn on took the back off to check for any signs of water damage and all the little strips was white so that indicates no damage to the phone so i sent it off to Vodafone waited for a week to be told it had liquid damage inside the phone and wanted to bill me £100 to fix it i kicked off stating the phone has no damage to it and i am not paying £100 for nothing so then Vodafone said they would pay half to fix the phone again i refuse to pay £50 for something which is still in warranty.

They was having none of it so i told them give me the phone back and ill have it checked by someone i know who specializes in Samsung mobile phones he took the phone apart and said there is no sign of liquid damage in the phone all the strips inside the phone was white as i said

Contacted Vodafone and they was having none of my findings so i left it at that

So the guy i know tried to fix the phone and said that its had its days and would be far to expensive to repair the phone.

I have sent Vodafone an email today to Stefan Langkamp asking if vodafone could kindly reset my contract from scratch and issue me with a new phone of my choice

way i see it is they get my custom again for another 24 months and they dont get the hassle about the S2 which is now broken.

Still not had a reply yet hopefully if that dont work then people here may have some kind advice.

I dont want the contract cancelling as i would struggle to obtain another contract due to some debt i have recently cleared off. I just want a phone which i would feel like im getting my monies worth

i had paid for that S2 within the 10 month period of having the phone as all my bills was averaging around £45 - 50 a month due to work commitments etc

i tried contacting Samsung regarding the issue but i had no reply off them

The only solution is to get a couple of written assessments of the problem and then to sue VF. Once they receive the court papers they take you seriously. Until then, you are just another troublesome account.

I had the same issue with my HTC desire HD. Got the run around from vodafone, so went back to the place i got the phone from. They did an investigation which took a few weeks, and gave me an unlocked S2 as a replacement. Good thing is, the Desire HD plan was much cheaper than the S2 plan :)

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

If my advice helps you, click the star icon at the bottom of my post and feel free to say thanks

OK guys

hope you are all well, I took out a contract last year for a Samsung Galaxy S2 which lasted about 9 months before the phone started to act up a little bit and then stopped working i sent it to Vodafone for repair to be told i will have to pay them £100 to have the phone replaced if i refuse they will send it me back unfixed so i said right OK send it me back as i aint paying them £100 to fix it when its under warranty and am paying £38 a month.

They claimed it had liquid damage even though the phone didn't indicate any liquid damage so i constantly tried emailing them to be ignored by the CEO office and instead the customer service tried emailing me but did not understand a word they said so i gave up and decided to buy a cheap android phone in its place as i really couldn't be arsed with the hassle. I tried to lower my tariff on my phone but they refused to do it so again frustrated to the max, 2 months down the line i constantly lost signal on vodafone for 3 - 4 hours at a time sometimes happening twice a day this went on for about 2 months they refused to credit me back for there f ups.

If they want to send me letters with threats of a debt collection agency then thats fine.

I will fight it aswell as making an offer of payment per month to the debt collectors.

i dont care to be honest i know its not the right attitude but i have given up with them if i make an offer per month they cant touch me is that correct ? they will just default it on my credit file ?

What debt collection do they use by the way ?

What was the fault with the phone (your own thoughts)

How did they determine liquid damage ?

Hi MARTIN3030

Thanks for your quick reply.

When i was using the phone it got really warm, it didnt charge properly so im guessing the charge port was faulty i tried replacing the battery this was going on for about 6 weeks but i just lived with it, over the 6 week period the phone kept repeatedly freezing when texting, browsing ebay etc then few days later the phone wouldn't turn on again tried a new battery and still the same i took the phone to a friend who specilises in mobile phone repairs and he said there was defiantly no water damage/liquid damage and the phone would need sending back to Vodafone if its in warranty. Vodafone had tampered with it sent it me back took the crappiest picture you could imagine trying to prove the liquid damage to me but all it was was a bit of tape sticking out of the charger port when they returned it back it didn't indicate anything was wrong with the phone so i emailed them back and got no reply from them.

I don't mind paying a debt if i think i am at fault for not paying it but i feel ive unfairly been treaten they think you sign a contract and they have rights and we don't it doesn't work like that

Ok Chris,thanks for clarity.

The burden of proof that there was no water damage could be used by expert witness if your friend is deemed to be be in a position to make that determination.

I can see your frustration and thoughts.

Vodafone are not alone in getting things wrong, our forums are full of similar stories from all providers.

Fortunately,we do have a rep from Vodafone on The CAG who has dealt with complaints on here and I am sure will look into things for you.

It is certainly worth a try.

  • 3 months later...

Today i received a letter from Vodafone stating that i owe £567 to them, i admit i did refuse to pay the bills but i had all right to do so after Vodafone did not want to help me, i took out a Samsung Galaxy S2 probs paid the phone twice over with hefty bills with using it for work so the bills was paid in full all the time never missed a single payment for about 7 months but 4 months down the line my phone decided to act all strange and slow then the screen froze and went fuzzy a few times so i went to the vodafone store to have it checked they sent it off to the repair team and said i would get it back within the week.

Week had passed and i get a phone call & an email stating that the phone had liquid damage (pulling a fast one to make an extra £100 out of me) but the phone had never been near liquid, water or rain because i am extremly careful what i do with my belongings so i asked for the phone back and took it to a local phone repair shop and he took the phone to bits and claimed there was no sign of any liquid damage and would put it down to hardware related fault, so now that vodafone had there non repair on the system with the words LIQUID DAMAGE they kept mithering me if i was having the phone repaired so i said to them i am not paying £100 and its covered by the manufactures warranty they was determined to get this phone in for repair then decided they would cover half the costs which would still leave me with paying out £50 plus my phone bill on the same day

So now that vodafone would not repair it after several attempts the phone just went in the bin, i the direct debit with them and told them im going somewhere else

I am now with Virgin with a Samsung Galaxy S3 with no issues whats so ever great phone just a shame that Vodafone would not treat me as a customer instead of a mug.

So now ill probs just have to wait for the debt collection letter plus the 15% charges they claim.

Thanks for reading guys

It's a shame that you binned the phone

If vodaphone supplied the phone then they are responsible for any repairs

Presumably vodaphone took some photos to prove the water damage ...

Vodaphone might try suggesting that the phone was free and so is separate from the monthly fee that you pay for your contract. You only have to look at the pricing (and compare to a sim on ly deal) to see that isn't true

The value of the phone is factored into the price of the contract. You are effectively paying for the phone by installments. Vodaphone (and all the other mobile suppliers) are really trying to avoid the consumer credit act by saying that they are free but then charge a substantially higher monthly rate

I would say that you clearly have a dispute with vodaphone due to their refusal to repair the phone, that you took as their termination of the contract

Try writing to them, explain the background & bits of what I have posted & see what they say ...

Most likely it will be "pay up", but at least you will have made your position clear.

Vodaphone will have trashed your credit file, so do take that into account. If you pay, they will not remove any defaults, so there is no incentive for you to do so.

Even in other circumstances, it would be difficult for vodaphone to justify the amount that they are claiming, so rather than take you to court, they will farm the alleged debt out to DCAs then sell it for a fraction of the face value.

Hi Lee

Many thanks for your reply no offence to you my friend but you didnt really help me last time all i got was what i was expecting, Ive took my complaint to a higher level CEO Office Stefan Langkamp hoping this can be rectified as all you need to do is look at the contract and see it has not even been used since July 2012 so dont see how you can bill me for something i am not getting the use out of, end of the day the phones been paid for in my eyes and what loss are Vodafone at ?

If i dont get anywhere is there any ombudsman i can call and bring there attention to the issue.
