      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I realize this may have been covered before, but I think the scenario I have is complicated.

I took the 1st loan out with PPI cover which was over 60 months period.

After 36 months I took the 2nd loan out to pay 1st loan off and leave me with some cash over, this was over 60 month period and had PPI cover.

After 36 months I took out a 3rd loan to pay off the 2nd loan and leave me with some extra cash, this is over 72 months and has PPI cover. I had to claim on this loans PPI cover last year. This loan is still active till 2013.

I would like to know best way to tackle this.

The loan company is TESCO and all had Single Premium PPI.

When you say "tackle this" are we talking about reclaiming for mis-sold PPI? You haven't been completely clear although I suspect that is what you want to do?

Thanks for quick reply, yes it is about claiming back PPI.

I've read your posts (very good) but I'm a bit confused of whether I'd claim all the PPI insurance that's added to the loans when taken out. Or just the amount that a loan was not reduced by when paying it off with a new loan.

if you've refinanced you're in for a bigger windfall

 

as i bet you got no rebate either.

You will effectively be claiming it all back, plus the bank's interest on the payments you made plus 8% on the payments made.

 

That's why you will need to use a spreadsheet to help with the calculations.

Thanks I am subscribing to this thread...as my Halifax had original loan which was consolidated into loans 2 and three and PPI and costs/interest accumulated..so I will be watching this thread with interest...and clicking onto the links within it for further information.:-o:-)

Using the form provided is this how it’s filled out.

Claimant = me

Lender= Lender

Account= loan account Number

Claim from= loan start date

Claim to= loan finish or todays date*

 

Date of charges= date payment made

Decsription= PPI

Amount of charge= Monthly insurance payment.

 

 

As I’ve stated I have 3 roll over loans, used to pay off previous loans

Yes

 

And you need to work out the amount of PPI rolled in to each new loan from the previous one too.

Finally sent my forms to Tesco Bank over the 3 roll over loans I've had.

I explained that the loans had front loaded PPI attached.

And that when i finished the loans off early with another loan i received no rebates.

I stated that i would require all money paid for PPI and the rebates i never received for early payment.

I posted the letter (recorded) just over a week ago,up to now have not received a reply.

Post the letter as a PDF please

as a picture file

remove all pers info inc barcodes etc using paint

but leave all figures and dates.

goto one of the many free online pdf converter websites

convert the image to pdf format.

or ir you have PDF as an installed printer drive use that

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

UPDATE ON MY CLAIM

just had a phone call from Tesco. questions about when i was sold PPI in 2001, 2004, 2007. whether i was advised about restrictions or that i could cancel. i told them all of my applications where done on line and nothing stood out to alert me of these. I said on my cover letter it stated that i was claiming Front loading of the PPI, but all they wanted to ask questions about was the selling of the PPI. Wonder what there upto!

Strikes me that they don't know much then. If they are having to ask you the questions then it would suggest they have no evidence themselves.

 

That could be good for you because if they reject your claim then you can ask for evidence which they may not have.

I've been offered all the PPI payments on the 3 loans i took out.

 

Also any PPi that was carried over to the top up loans i took out.

 

Interest on all the PPI payments at 8%.

And because i had a claim on one loans PPI, the amount will be reduced by what i was paid in the claim.

 

i checked there workings and it comes nearly spot on to my workings.

 

So happy result.
