      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I received my bank statements last week, so far free of charge. I calculate they owe me about £1700. I posted my preliminary letter through their letter box last night and I have had a phone call today.

They were asking if they could borrow my copies of my bank statements as if they requested their own it would take a week or so, therefore eating into their 14 days.

 

I couldn't see any reason to refuse and said I would drop them in tomorrow. Anyone see any problem with this?

 

At least they not just telling me to get lost or at least not yet!!

Yeah ask them to copy them as you want them back.

How many statement pages are you talking about? It may take them a while to copy them all!! :)

Showing you are willing to help speed up the process will only help your cause as well.

(Yes I work for a bank but am here to help! Please be nice to me! :))

I received a reply last week, very similar to those others have had, going to send the "the letter before action" one tomorrow. Does the 14 days exclude weekends and bank holidays?

not looking forward to court action part, but at the moment so skint with their fines, will certainly be going ahead with it.

Mebbees you should also make a charge for the copies as the banks are not slow in asking for a fee for any of my requests for a copy of my statement. :o)

Hi

I've just had confirmation that my small claims action has been issued by my local county court, RBS have until 09/06/06 to acknowledge it. My claim is about £2500 including interest but I haven't put an actual amount as if it goes to court i want the payment to be as upto date as possible.

 

By the way the RBS have only just cashed my cheque for the DPA info which was sent to them about 8 weeks ago, so don't think they won't. It was at a very inconvenient time for me, ie. no money!!!!

update: RBS only have until tomorrow to acknowledge my claim but knowing my luck they will. The b******s will have had £300 off me in the last 2 weeks, talk about stuffing me up good & proper!!!!

I have applied for my judgement today, as the RBS have not acknowledged my claim, or at least as far as I know as the clerk who is dealing with it at the court has, needless to say been away and there is a delay of about 2 weeks before I might hear anything more definite.

 

I claimed an unspecified amount which seems to make it more complicated and require a hearing with the judge. Anyone else had this or got any info or advice?

My judgement will be issued against rbs on monday, which is i assume they will recieve it according to the court. I suppose they will then just have it set aside to delay things even more.

My Branch have asked for copies of my statements from me after telling me twice that they are only able to order them at weekends because of the amount of statements and after 2 monday morning phonecalls was told it would be another week.

I took a copy and gave them the originals... they have had them 2 days now and apparently they are sitting on the branch managers desk... is she using them to scribble on? If I dont get a result by this monday i'll be starting a small claims, I'm due about 1500 worth of charges.

Well! according to the Court, the bailiffs have signed off as the RBS told them they had paid me in full on 02/08/06. You would think I might have noticed a little matter of £2500 going into my account. I didn't because, of course it hadn't!! Lying *****'s So now I have to re-issue the warrant - more time.

 

I also don't understand why I wasn't contacted at the time to make sure I had been paid. All a bit strange and very annoying.

When I phoned the bailiffs, which I did about 4 times :rolleyes: I was told that I would get a report in due course. Needless to say, I never did. It wasn't until I acted on your post (thanks) that I found out what was going on. I still haven't heard from RBS though :rolleyes:
