    • In terms of "why didn't I make a claim" - well, that has to be understood in the context of the long-standing legal battle and all its permuations with the shark. In essence there was a repo and probable fire sale of the leasehold property - which would have led to me initiating the complaint/ claim v SPF in summer 19. But there was no quick sale. And battle commenced and it ain't done yet 5y later. A potential sale morphed into trying to do a debt deal and then into a full blown battle heading to trial - based on the shark deliberately racking up costs just so the ceo can keep the property for himself.  Along the way they have launched claims in 4 different counties -v- me - trying to get a backdoor B. (Haven't yet succeeded) Simultaneously I got dragged into a contentious forfeiture claim and then into a lease extension debacle - both of which lasted 3y. (I have an association with the freeholders and handled all that legal stuff too) I had some (friend paid for) legal support to begin with.  But mostly I have handled every thing alone.  The sheer weight of all the different cases has been pretty overwhelming. And tedious.  I'm battling an aggressive financial shark that has investors giving them 00s of millions. They've employed teams of expensive lawyers and barristers. And also got juniors doing the boring menial tasks. And, of course, in text book style they've delayed issues on purpose and then sent 000's of docs to read at the 11th hour. Which I not only boringly did read,  but also simultaneously filed for ease of reference later - which has come in very handy in speeding up collating legal bundles and being able to find evidence quickly.  It's also how I found out the damning stuff I could use -v- them.  Bottom line - I haven't really had a moment to breath for 5y. I've had to write a statement recently. And asked a clinic for advice. One of the volunteers asked how I got into this situation.  Which prompted me to say it all started when I got bad advice from a broker. Which kick-started me in to thinking I really should look into making some kind of formal complaint -v- the broker.  Which is where I am now.  Extenuating circumstances as to why I'm complaining so late.  But hopefully still in time ??

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Karen,

Yes I am well aware of cassava. I have done extensive homework on these people, believe me. Months upon months of countless emails/phonecalls back and forward...........pointless all of it. I take it you know these :censored: withheld 22k from me? 22k that they actively let me win I might add!

Why not take Cassava to court which you are entitled to?

 

If the court deems in your favour then they must pay up!!

 

Its doesnt cost much to put a claim to the court.

So why would theynot pay you if i have had money owed to me they have paid me or refunded me bt we talking 40 - 50 pounds ot bibbest win i have was 429 they still paid that so why not you ? karen

They not payig me because I more than one account with them which is against thier "rules" yea mickey mouse rules! That and other things they reckon are reason enough to keep 22 grand from me.

 

You should go back to the beginning of my story. It explains everything this company have done to me.

Hi. Tried all that Lucky7even, but no lawyer will touch a case involving an online gambling site. The online laws are too complex, hence the reason why companies such as cassava get away with these kinds of things. No one is properly policing these sites and until someone does, this shocking behaviour will only continue.

 

It really IS like banging my head against a brick wall! :frusty:

Yep that's correct your not supposed to have more than one account on each site well some you can others you can't it's the card they use though !!!!

That's why I was pushed off I had loads of accounts all over their bingo sites they had not noticed for 6 months

But then they keep writing to you asking you to join

So I think it's partly their fault Cos if they send after having your address not to see you have it's their fault for asking you to join again again !!!

A few the sites say ...you try making a second profile won't let you

All should be like that

There are so many bingo sites I forgot making accounts

That one about having 2 accounts is in the 3 hundred page terms and conditions asking even though it is awful after they let you win the money to get that far

What Can you do ?????

The same has happened to my brother - started with all of the family getting a letter about a new bingo site called gueslistbingo - my brother joined first on 22/06/2013 and deposited £100 over the following days - On Monday he won £17,500 on slots and with drew £1000 of that as you can only withdraw £1000 day Max £3000 a month - The following day his account had been blocked so went through all email channels and today received an email today saying he abused the bonus bla bla - He won on slots, which cannot be played with bonus money - Also had my account blocked and my daughters account has been blocked. Im not letting this go surely something can be done against these crooks

Can't you ask them how you broke this bonus ???

Ask them to prove to you you did?

You forgot bonus when you want take the money before you finished the bonus

But ask them to prove to you how you did ???

Thanks for your reply Karen - but on the site in question you can only spend the bonus money when you have spent your real cash that's what I don't understand it told me when I was withdrawing that I would lose the bonus - So basically they are talking rubbish when they say I have abused the bonus

 

the grounds for banning me are

In the event that the Company believes a Bingo user is abusing or attempting to abuse a bonus or other promotion, or is likely to benefit through abuse or lack of good faith from a gambling policy adopted by the Company, then the Company may, at its sole discretion, deny, withhold or withdraw from any user any bonus or promotion, or rescind any policy with respect to that user, either temporarily or permanently, or terminate that user's access to the Games and/or block that user's account and confiscate funds therein

Too many similar stories :(

 

I play a few sites. I did register a new account ( even though I had an existing one to get the deposit bonus, deposited a few times without problem and then won £1700. Only then did they close the account down... However, after I emailed them telling them I didn't use the old account and wanted to keep this one, to my shock and surprise they reopened the account and my £1700 was sat there with no withdrawal restriction!! Cashed out and ran!

 

So sorry to hear that the op has been deprived of their win. My guess is they'd keep taking your deposits without question but know there's always some clause in their terms and conditions to refuse your withdrawal.

 

I'd keep chipping away at them. At best they might give you a gesture of goodwill payment because they won't want the bad publicity.

HELP

i had a account with tasty bingo run by cassava, didnt use it, i recieved a flyer through the post with a bonus offer so a group of us got together and all put a few pound in and we won £500 really pleased but we found out we were blocked, now there saying i entered the wrong date of birth so my id is not good enough, also i am breeching there bonus scheme... 1st they sent me the offer it never said it couldnt be used by others, secondly.. if they take the bet dont they have to honour it like betting shops ??

really angry as i have the tennancy agreement and birth cirtificate they asked for just i must have messed up when doing the drop down date of birth options acan i do anything ? :(

Anyone get their issues resolved? its 2017 and i am having a nightmare with them! i won £660 with real money... not bonus money. i had another account on a different site which i closed down. i had already gone to the withdrawal process which doesnt complete until 48 hours after as they will try what they can to get you to cancel it. Anyway i had an email saying my account was blocked as i had closed an account down on another site, what kind of joke is that, why would anyone in their own sanity knowingly cancel their withdrawal by doing something like that! under investigation it seems i have found the gambling commission site has hundreds of websites all under the same licence! they emailed me saying they will transfer my deposits back but thats it. what an absolute [problem]. I spoke on the phone to a man and he gave me advice on contacting the gibraltar gambling commission and sending a recorded letter. just want to know if anyone got their case resolved and how?

Give up honestly save your time, i went to citizens advice about it all and the short of it is what ever they say gos i have avoided every cassava site since and still makes me angry i won £700 and with all there small print when you agree its impossible to get your winnings when they decide not to pay out sorry :(
