Hi all,

 

No idea where to post this so thought I would try here!

I have tried to get justification from my local council over the costing of this; but get the standard "we have overheads" response.

£100 fine if the 42 page application is wrong and £50 extra for every tenant over 5 - sounds like profiteering too me.

But who do I complain to?, i.e. who do I complain too about my council????

 

Any advice/suggestions welcome

Could you post up the exact letter which states the "fine" -

A fine cannot be levied without some law or statute to back it up.

Your local council (which is?) should have a complaints department, or at the very least a

"formal complaints procedure" on their website.

 

What, exactly, is the licence application for? (licence to be a private landlord?)

 

It is quite possible that the £100 fine *is* proportionate to the council's costs - how much is the licence fee?

That would be a pointer to how much it costs to check a correct application.

It would cost more to point out errors in an incorrect application, then send it back to you, then check the corrected application

HMO licences are issued by the council and the charges they make will be clearly set out in their application packs or online. charges for various licences are agreed by the licensing committee if they fall under their remit or by government if they dont (ie licensing Act/gambling Act fees)
