    • Well tbh that’s good news and something she can find out for herself.  She has no intention of peace.  I’m going to ask the thread stays open a little longer.   It seems she had not learned that I am just not the one!!!!  plus I have received new medical info from my vet today.   To remain within agreement, I need to generally ask for advice re:  If new medical information for the pup became apparent now - post agreement signing, that added proof a second genetic disease (tested for in those initial tests in the first case but relayed incorrectly to me then ), does it give me grounds for asking a court to unseal the deed so I can pursue this new info….. if she persists in being a pain ? If generally speaking, a first case was a cardiac issue that can be argued as both genetic and congenital until a genetic test is done and then a second absolute genetic only disease was then discovered, is that deemed a new case or grounds for unsealing? Make sense ?   This disease is only ever genetic!!!!   Rather more damning and indisputable proof of genetic disease breeding with no screening yk prevent.   The vet report showing this was uploaded in the original N1 pack.   Somehow rekeyed as normal when I was called with the results.   A vet visit today shows they were not normal and every symptom he has had reported in all reports uploaded from day one are related to the disease.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

It appears that there are a number of companies now sending out emails offering 10 day free trials and access to your Callcredit report.

After giving your details you are then spammed with offers of Payday loans and even could be told that you have been approved.

 

The initial email will look like this;

This is clearly a very deceptive business practice.and I am reporting it to the OFT.

 

 

postcode HA8 5AW is also the one used by some of the most complained about Payday Loan Companies on this site including Lending Stream..

I have had this to, and have written to Call Credit to get

a statement about these contacts, not sure if this is contrived

or something set up by CC,as Noddle will be free always.

The trial seems to be working.

Yes but even if Callcredit are themselves not involved,they should make their position clear,and these companies that are using the free credit report carrot to get your details for the purpose of then offering payday loans should make this clear in their main advertisement.

Yep it sure is.

I am on a little project with the PDLCo's as are 1 or2 other team members.

The number of people having problems with these is escalating.

2 or 3 years ago there was a handful of players all of whome are very well known on CAG.

But in the last 12-18 months there has been an explosion and now there are 100s.

In fact it is not unusual to see a CC licence holder with up to 20 associated companies all offering payday loans under different names.

I recently saw there are at least 300 further ones awaiting decisions from the OFT.

Almost all of the payday loan companies are US and have targeted the UK market.Perhaps this demonstrates and poses many questions.

 

Being aware of all this,and of course seeing first hand the misery and soul destroying practices from them that we see on this site on a daily basis,absolutely infuriated me when they tried to sell me one after I had only given them my details in the understanding that it was for 10 days free access to Callcredit.

OFT takes action against online subscription operator

The OFT has taken action against Adaptive Affinity Limited to address concerns that some consumers were unwittingly signed up to online subscription schemes. In some cases people were incurring total monthly fees of almost £60. Tens of thousands of UK consumers are signed up to Adaptive Affinity Limited's schemes each month.

Adaptive Affinity Limited, the company behind QuickCreditScore, HighCreditScore, CreditScoreMatters, High Street Max, Rewards Now and Rewards First, has provided undertakings which prevent it from engaging in unfair practices or using unfair terms which could mislead people into signing up to subscription services which carry fees.

The OFT was concerned that some customers:

 

  • believed the credit score service was free
  • did not realise they had entered into a binding contract with Adaptive Affinity Limited and would incur a monthly charge if they did not cancel their subscription during the trial period
  • thought they had supplied their credit card details for identification purposes to facilitate a credit check, and so were unaware that these details would be used to take monthly payments which ranged from £9.95 to £29.95 per scheme
  • only discovered that they were being charged for a scheme or schemes when they saw the charges on their bank statements, sometimes after thinking that they had only entered details to claim a supermarket voucher or cashback discount.

Adaptive Affinity Limited fully cooperated with the OFT's investigation. The OFT has accepted comprehensive undertakings to address the full range of concerns identified.

Cavendish Elithorn, Senior Director of the OFT's Goods and Consumer Group, said:

'The OFT will take action to stop misleading business practices that develop online which leave shoppers out of pocket. Those that flout the rules risk enforcement action. We will continue to scrutinise the market to make sure that people have the confidence to use and receive the full benefit from the wide range of online services.'

About time but the damage has been done.

I am still getting up to 5 emails a day since I reported this here.

Even unsubscribing makes no difference as there are so many of them.
