      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Good afternoon ,

 

I have a CCJ for a Blackhorse loan that I have,

 

This was issued in January and I have complied with the CCJ requirements ever since,

all payments have been made , 2 a couple of days late but always in full.

 

I have never received any comunication from BH about the 2 late payments so assumed everything was Ok.

 

I received a letter this morning from DLC instructing me to now pay them not Blackhorse with an attached peice of paper from a solicitor who claim to be now overseeing the CCJ.

 

I am due to make payment today but as I have not heard anything from BH I am inclined to follow the original judgement and pay BH

as I have since the CCJ was given

 

Another thing I noticed was that the county court was listed as my local one although the judgement was awarded at Northampton ...

. does this mean they are going for enforcement action

 

if this is the case I would want to defend against charging orders or attachments to earnings etc

as the payment history is good .

Continue to pay whoever the court ordered you to pay, if this DLC, outfit thinks you should pay them, then they need to go back to court and get a redetermination of the CCJ.

 

By DLC do you mean direct legal & collections?

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

I would gladly do that, my thought though is that Black Horse just assigned it to them but forgot to tell me, what could DLC gain from falsley telling me to pay them instead of paying as instructed by the court. Surely this would drop them in it I supose the best plan of action is to send the letter from DLC to the issuing court asking their advice on what to do

IMO I would continue to pay who the court ordered you to.

 

Give the court a ring and ask them for advice, and state that you fully intend to continue paying who the court ordered you to, and that if BH wanted to offload the CCJ onto this DLC outfit, shouldn't they be going through the correct legal channels??

 

As long as you adhere to what the court ordered then you can't go far wrong!

have you ever SAR'ed BH?

 

if not do so

 

they typically inflate all loans with unlawful charges

 

what about PPI?

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

if you have never defaulted from the time you got your ccj then they cannot get a charge but bh are sneaky with me I din't know jack until I got a letter stating i had an interim called bh and they refused to co-operate and at that time my house had been sold aftern the move they went to court dispite being told severasl times thst the house wasn't mine any longer and got a full charge thank goodness I managed to get it deleted as they were holding the new owners to ransom confirmed in writing . is there anything ppi to be disputed on this ? did you defend the claim when you recieved it and I know its nosy but do you have equity in your house because they might use thast to try and get the chasrge.

I didnt dipute the claim as to be honest I had stopped paying , i admitted and offered a monthly amount with an i and e form, the judgement was granted and the court set an amount roughly in the region of my offer , i have been late 2 times in the period but only by 10 days each time and am currently fully up to date , there is currently no equity in the property and doubt there will be prior to the debt being paid which would be roughly 2 years . I also have no plans on selling or moving so a charge would be a pointless execise on their partTo be honest i thought this one was put to bed , they got the CCJ , i pay for the amount of time stated and then it goes away simples or so i thought

also there wasnt ever any PPI on the loan
